HomeMy Public PortalAboutOrd. 366 - CurfewORDINANCE NO. -364, AN ORDINANCE RELATING TO CURFEW; REPEALING CHAPTER 6 OF TITLE IV OF THE VILLAGE CODE OF McCALL, IDAHO; STATING A DECLARATION OF PUR- POSE; ESTABLISHING, CURFEW; DEFINING UNLAWFUL ACTS; PROVIDING EXCEPTIONS; AND PROVIDING A PENALTY. WHEREAS, the Constitution and statutes of the State of Idaho empowers cities to make and enforce local requirements by virtue of police powers not in conflict with the general law; and WHEREAS, it has been found necessary and desirable to protect and control persons living or found within the County of Valley and the cities thereof under the age of 18 years, to promote the safety and welfare of the residents thereof; NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF McCALL, IDAHO, AS FOLLOWS: Section 1. That Chapter 6 of Title IV of the Village Code of McCall, Idaho, be and the same is hereby repealed. Section 2. It shall be unlawful for any person under the age of 16 years to be or to remain, and it shall be un- lawful for any parent, guardian or other person having the care and custody of any person under the age of 16 years to permit such person to be or to remain in or upon any street, alley, public ground, public place or any places open to the public or exposed to public use within the boundaries of the City of McCall between the hours of 11:00 o'clock P.M. and 5:00 o'clock A.M. Section 3. It shall be unlawful for any person having attained the age of 16 years and prior to having attained the age of 18 years to be or(t6)remain, and it shall be un- lawful for any parent, guardian or other person having the care and cusotdy of any person who has attained the age of 16 years and prior to having attained the age of 18 years to permit such person to be or to remain in or upon any street, alley, public ground, public place or any places open to the public or exposed to public use within the boundaries of the City of McCall between the hours of 11:00 o'clock P.M. and 5:00 o'clock A.M. Sunday through Thursday evenings and between the hours of 12:00 o'clock midnight and 5:00 o'clock A.M. on Friday and Saturday evenings. Section 4. The provisions of this Ordinance shall not apply to any person who is accompanied by his parent, guar- dian or other adult person having the care and custody of him, nor to any person who is in the performance of an errand or duty directed by his parent, guardian or other adult person having the care and custody of him, nor to any person who is actually at the time engaged in legitimate employment for profit.' a Section 5. Any person found guilty of a violation of this Ordinance shall be fined in a sum not to exceed one hundred dollars ($100.00) or sentenced to not more than 30 days in the county jail or both such fine and imprisonment.
