AN ORDINANCE MAKING IT UNLAWFUL TO STORE DELETERIOUS
MATERIAL IN SUCH A MANNER THAT SUCI MATTER WILL OR
BE LIKELY TO ENTER THE WATER OF BIG PAYETTE LAKE OR
THE PAYETTE RIVER AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THF
CITY OF McCALL, IDAHO, AS FOLLOWS:
Section 1. It shall be unlawful for.any person to
store, dSpose of, or allow.to.accumulate any deleterious
Material adjacent to or in -the immediate vicinity of any
portions of the waters of Big Payette Lake or Payette River
in such a manner that -such material will or is likely -to
enter such water at times of high water or runoff -or where
drainage from such materials or accidental failure of storage
facilities may transport or allow deleterious material into
such water. Such material shall include, but not be limited
to, trash, rubbish, garbage, oil, gasoline, chemicals,
sawdust and accumulations of manure and.snow containing the
same or any thereof.
Section 2. Any person convicted of a violation of this
ordinance shall be guilty of a misdemeanor and shall be
punished by a fine.not to exceed $300.00 or imprisonment in
the County jail for a:period not to exceed six (6) months
or by both such fine and imprisonment.
