AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY
OF TIFFIN, IOWA, TO REZONE DAYTONA ESTATES FROM ESTATE
FAMILY (R -1E) TO A PLANNED DEVELOPMENT OVERLAY CONCEPT
AND SITE DISTRICT/TWO FAMILY RESIDENTIAL DISTRICT (R-2/OPD)
IN THE CITY OF TIFFIN, IOWA, JOHNSON COUNTY, IOWA, AND AS
LEGALLY DESCRIBED HEREIN
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1. Purpose. The purpose of this ordinance is to amend the
official zoning map of the City of Tiffin, Iowa, and rezone the area known
as Daytona Estates, Tiffin, Iowa, in accordance with the recorded plant,
containing 4.33 acres, and subject to the easements and restrictions of
record as more particularly described on the attached documents from
Estate Family (R -1E) to a Planned Development Overlay Concept and Site
District/Two Family Residential District (R-2/OPD), one lot constating of
20 units in 10 duplexes.
Section 2. Amendment. The following legally described
property:
DESCRIPTION REZONING PARCEL - R -1E TO R-2/OPD
BEGINNING AT THE SOUTHWEST CORNER OF OUTLOT "B" OF PRAIRIE VILLAGE- PART 2, TIFFIN,
IOWA, IN ACCORDANCE WITH THE PLAT THEREOF RECORDED IN PLAT BOOK 64, AT PAGE 280 OF
THE RECORDS OF THE JOHNSON COUNTY RECORDER'S OFFICE; THENCE N06°24'20"E, ALONG
THE WEST LINE OF SAID OUTLOT "B", 63.34 FEET; THENCE N04°09'01"E, ALONG SAID WEST LINE,
85.92 FEET; THENCE N08°24'03"E, ALONG SAID WEST LINE, 85.92 FEET; THENCE N12°39'02"E,
ALONG SAID WEST LINE, 80.20 FEET; THENCE N26°36'02"E, ALONG SAID WEST LINE, 91.49 FEET;
THENCE N09°%o5D46'42"E, ALONG SAID WEST LINE, 149.86 FEET, TO THE NORTHWEST CORNER
THEREOF; THENCE N89°15'18"E, ALONG THE NORTH LINE OF SAID OUTLOT "B", 94.70 FEET, TO
THE WESTERN MOST CORNER OF OUTLOT "D" OF PARK PLACE - PART THREE IN ACCORDANCE
WITH THE PLAT THEREOF RECORDED IN PLAT BOOK 63 AT PAGE 137 OF THE RECORDS OF THE
JOHNSON COUNTY RECORDER'S OFFIC; THENCE NORTHEASTERLY, 77.38 FEET, ALONG THE
NORTH LINE OF SAID OUTLOT "D", AND AN ARC OF A 333.00 FOOT RADIUS CURVE, CONCAVE
NORTHWESTERLY, WHOSE 77.20 FOOT CHORD BEARS N82°35'53"E; THENCE NORTHEASTERLY,
83.41 FEET, ALONG SAID NORTH LINE, AND AN ARC OF A 267.00 FOOT RADIUS CURVE,
CONCAVE SOUTHEASTERLY, WHOSE 83.07 FOOT CHORD BEARS N84°53'28"E; THENCE
S86°09'33"E, ALONG SAID NORTH LINE, 18.87 FEET; THENCE SOUTHEASTERLY, 37.63 FEET,
ALONG SAID NORTH LINE, AND THE EAST LINE OF SAID OUTLOT "B", AND AN ARC OF A 25.00
FOOT RADIUS CURVE, CONCAVE SOUTHWESTERLY, WHOSE 34.18 FOOT CHORD BEARS
S43°02'17"E; THENCE SOUTHEASTERLY, 10.24 FEET, ALONG SAID EAST LINE, AND AN ARC OF A
860.00 FOOT RADIUS CURVE, CONCAVE NORTHEASTERLY, WHOSE 10.24 FOOT CHORD BEARS
S00°15'28"E; THENCE S00°35'56"E, ALONG SAID EAST LINE, 257.62 FEET; THENCE S25°15'09"W,
338.23 FEET, TO A POINT ON THE SOUTH LINE OF SAID OUTLOT "B"; THENCE S89°24'04"W,
ALONG SAID SOUTH LINE, 60.59 FEET; THENCE N78°42'58"W, ALONG SAID SOUTH LINE, 207.85
FEET, TO SAID POINT OF BEGINNING, CONTAINING 4.33 ACRES, AND SUBJECT TO EASEMENTS
AND RESTRICTIONS OF RECORD.
shall be changed from zoning classification R-1 E (Estate Family) to
R-2/OPD (Two-Family/OPD) and that the official zoning map of the City
be amended to reflect the change described herein.
Section 3. Repealer. All ordinances or parts of ordinances in
conflict with the provisions of this Ordinance are hereby repealed.
Section 4. Severability. If any section, provision, or part of this
ordinance shall be adjudged to be invalid or unconstitutional, such
adjudication shall not affect the validity of the ordinance as a whole, or
any section, provision, or part thereof not adjudged invalid or
unconstitutional.
Section 5. Effective Date. This ordinance shall be in effect after
its final passage, approval, and posting as provided by law.
On the 7th day of November, 2023, at a regular meeting of the Tiffin City
Council, Tiffin, Iowa, Councilperson Limkemann introduced Ordinance
No. 2023-506, and moved that it be given its first reading. The motion
was seconded by Councilperson Havens.
Ayes: Havens, Olney, Orris, Schnedler, Limkemann.
Nays: None.
Five members of the Council being present and having voted "Aye",
Mayor Steve Berner declared the motion carried, and Ordinance No.
2023-506, was read the first time, discussed, and placed on record.
On the 21St day of November, 2023, at a regular meeting of the Tiffin City
Council, Tiffin, Iowa, Councilperson Limkemann introduced Ordinance
No. 2023-506, and moved that it be given its second reading. The motion
was seconded by Councilperson Havens.
Ayes: Havens, Orris, Olney, Schnedler, Limkemann.
Nays: None.
Five members of the Council being present and having voted "Aye",
Mayor Steve Berner declared the motion carried, and Ordinance No.
2023-506, was read the second time and discussed and placed on
record.
On the 5th day of December, 2023, at a regular meeting of the Tiffin City
Council, Tiffin, Iowa, Councilperson Limkemann introduced Ordinance
No. 2023-506, and moved that it be given its third and last reading. The
motion was seconded by Councilperson Havens.
Ayes: Schnedler, Limkemann, Havens, Orris, Olney.
Nays: None.
Five members of the Council being present and having voted "Aye",
Mayor Steve Berner declared the motion carried, and the ordinance was
passed and adopted.
Whereupon the Mayor declared that Ordinance No. 2023-506 be adopted
and signified his approval of same by fixing his signature thereto. Passed
by the Council on the 5th day of December, 2023 and approved by the
Mayor on the 6th day of December, 2023.

ordinance entitled AN ORDINANCE AMENDING THE OFFICIAL ZONING
MAP OF THE CITY OF TIFFIN, IOWA, TO REZONE DAYTONA ESTATES
FROM ESTATE FAMILY (R -1E) TO A PLANNED DEVELOPMENT

COUNTY, IOWA, AND AS LEGALLY DESCRIBED HEREIN, and known as
Ordinance No. 2023-506 was duly passed by the Council on the 5th day
of December 2023, and signed by the Mayor on the 6th day of December
2023, and published on the 6th day of December 2023, by posting copies
thereof in three public places within the limits of the City of Tiffin, Iowa.
