AN ORDINANCE RELATING TO MOTOR VEHICLES, TRAFFIC AND
PARKING; AMENDING TITLE VII OF THE VILLAGE CODE OF
McCALL, IDAHO, BY THE ADDITION THERETO OF A NEW CHAPTER
1 A, ADOPTING THE MOTOR VEHICLE LAWS OF THE STATE OF
IDAHO, 1979 REVISED EDITION; REPEALING SECTION 7-3-10
OF THE VILLAGE CODE OF McCALL, IDAHO; AMENDING CHAPTER
3 OF TITLE VII OF THE VILLAGE CODE OF McCALL, IDAHO, BY
THE ADDITION OF A NEW SECTION 7-3-10 THERETO, PROVIDING
FOR PROMULGATION OF TRAFFIC RULES AND REGULATIONS UPON
THE STREETS AND ALLEYS OF THE CITY OF McCALL, IDAHO, BY
THE CHIEF OF POLICE; PROVIDING A PROCEDURE THEREFOR,
MAKING IT UNLAWFUL TO VIOLATE SUCH RULES AND REGULA-
TIONS AND PROVIDING A PENALTY THEREFOR; AMENDING CHAPTER
7 OF TITLE VII OF THE VILLAGE CODE OF McCALL, IDAHO, BY
THE ADOPTION OF A NEW SECTION 7-7-23, PROVIDING FOR
ISSUANCE OF PARKING TICKETS, PROVIDING A PROCEDURE FOR
PAYMENT THEREOF TO THE CITY TREASURER; MAKING IT UN-
LAWFUL TO FAIL TO MAKE SUCH PAYMENTS AND PROVIDING A
PENALTY THEREFOR.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE
CITY OF McCALL, IDAHO, AS FOLLOWS:
Section 1. That
McCall, Idaho, be and
addition thereto .of a

Title VII of the Village Code of
the same is .hereby amended by the
new chapter to be known and designated
read as follows:
7-1A-1: TRAFFIC CODE ADOPTED: It is hereby declared
to be the intent of the Governing Body of the City to
aid and assist by whatever means possible, for the
utmost consistency in traffic regulations among and
between agencies of Idaho having jurisdiction. Toward
that end, adoption of the Idaho Motor Vehicle Laws by
the cities of Idaho is anecessary mens of assuring
maximum uniformity within the State.
There is hereby adopted, therefore, for the purpose of
establishing rules and regulations for the use of all
streets and public thoroughfares of the City, that
certain code, identified as the 1979 revised edition,
Idaho Motor Vehicle Laws, more particularly Title 49,
Idaho Code, published by the Department of Law Enforce-
ment, and as the same may hereafter be revised by the
Idaho Lejislature, or amended by the Governing Body,
and the same is hereby adopted and incorporated as an
ordinance of the City as fully as though set forth at
length herein.
In the event that a conflict shall arise between the
provisions'of this section and the existing laws and
ordinances of the City relating to this subject matter,
the stricter of the conflicting laws shall apply. ,

Section 2. Section 10, Chapter 3, Title VII of the
Village Code of McCall, Idaho, be, and the same is hereby
repealed.
Section 3. That Chapter 3 of Title VII of the Village
Code of McCall, Idaho, be, and the same is hereby amended by
.the addition thereto of a new section to be known and desig-
nated as Section 7-3-10 and to read as follows:
7-3-10: TRAFFIC RULES AND REGULATIONS: The Chief_ of
Police of the City.of McCall, Idaho, shall have the
power to promulgate traffic rules and regulations upon
all streets and alleys within the corporate limits of.
the City of McCall, Idaho, as follows:
(A) Designate by proper signs highways and streets or
parts thereof upon which parking is prohibited .or
limited.
(B) Prohibit left or "U" turns by vehicles at desig-
nated street or alley intersections.
(C) Mark streets for guidance to vehicle parking.
.(D) Establish parking time limitations.
(E) Provide safety zones for pedestrians.
(F) Designate location of "STOP" signs at street
and alley intersections.
The Chief of Police of said City shall have the further
power to promulgate any other traffic rule that would
be advantageous and desirable; provided, no rules
promulgated as herein stated by said Cheif of Police
shall become operative unless a copy of said rules
shall have been first filed with the Clerk in writing
and shall have been approved by the City Council at a
regular or special session, and provided also that
suitable signs orstandards or guides stating the
substance of the rule are placed upon conspicuous
places in the highway, street or part thereof. affected.
Such signs or standards or guides shall be of suffi-
cient size tobe clearly visiAble by occupants of motor
vehicles.
It shall be unlawful to violate any such regulations as
above provided and any person convicted of a violation
thereof shall be punished as provided in Section 1-3-1
of the Village Code of McCall, Idaho.
Section 4. That Chapter 7 of Title VII of the Village
Code of McCall, Idaho,. be, and the same is' hereby amended by
the addition of a new section thereto to be known and
designated as Section 7-7-23, and to read as follows:
7-7-23: PARKING TICKETS AND PROCEDURES: The Police
Department shall have authority to issue parking tickets
as follows:

(A) It shall be the duty of the Police Department upon
observing a vehicle parked, standing or stopped in
violation of the provisions of this Chapter to leave at
or upon such vehicle a notice that such vehicle has
been parked or stopped in violation of the provisions
of this Chapter. Among other things, the notice shall
bear the date and hour of leaving the same at or upon
the vehicle, make of the vehicle, and its license
number, the specific Code Section violated and the
amount of the fine, instructing the owner or operator
of such vehicle to report to the traffic ticket section
under the jurisdiction of the City Treasurer's office.
The notice orr notices herein mentioned shall be filed
as follows: One copy shall be retained by the police
officer leaving such ticket upon the vehicle, one copy
shall be filed with the traffic ticket section of the
City Treasurer's office, and one copy shall be filed
with the Treasurer.
(B) In order to eliminate burdening courts with vio-
lators of ordinances and to eliminate insofar as possible
public inconvenience, each person receiving a parking
ticket under this Chapter left upon his or her vehicle
shall:
1. Within twenty four (24) hours of the time of such
notice, pay to the traffic ticket section of the City
Treasurer's,office in full satisfaction of such vi-
olation, three dollars ($5".00) for each notice left
upon his or her vehicle;
2. Within ten (10) days from. the date of said parking
violation ticket, if same has not been paid within the
twenty four1(24) hours above prescribed, pay to the
traffic ticket section of the City Treasurer's office
an additional tdia dollars ($6:00) for each said
ticket being deemed necessary to defray administrative
and clerical expenses.
The failure of any operator to report and/or make such
payments to the traffic ticket section of the City
Treasurer's office within the times prescribed above
shall render the operator thereof subject to penalties
as provided by Section 1-3-1 of this Code.
(C) If any, vehicle is found stopped, standing or
parked in any manner violative of the provisions of
this Chapter and .the identity of the violator cannot be
determined, the owner or person or corporation in whose
name said vehicle is registered or the named lessee in
a rental or 'lease agreement of said vehicle shall be
held prima facie responsible for said violation..
