The Special Magistrate appointed by the City Council to hear code enforcement cases for the
Town of Gulf Stream, in accordance with Chapter 162, Florida Statutes, has heard testimony at the
Code Enforcement Hearing held on the 14th day of November, 2006, and based on the evidence and
testimony presented, the following FINDINGS OF FACT, CONCLUSIONS OF LAW, and ORDER
are hereby entered:
FINDINGS OF FACT
1. The Respondent, ANTHONY S. TURNER, was represented at the hearing by attorney
Keith Kern.
2. There was a finding of proper notice.
The Town Manager testified to the violation.
CONCLUSIONS OF LAW
Respondent remains in violation of the above listed code sections of the Code of Ordinances
of the Town of Gulf Stream.
ORDER
It is the Order of the Code Enforcement Special Magistrate that Respondent, ANTHONY S.
TURNER, shall immediately comply with the above listed code sections of the Code of Ordinances of
the Town of Gulf Stream.
A fine of fifty -dollars (550.00) per day is hereby assessed for the violation that has existed.
The fine is imposed for the period beginning November 4, 2006, and will continue to accrue at fifty -
dollars ($50.00) per day until the completed permit is applied to the Town. The Special Magistrate
continues to reserve ruling as to whether the dock is in compliance with all applicable codes.
A certified copy of this Order may be recorded in the Public Records of Palm Beach County,
Florida, and, once recorded, shall constitute a lien against the property upon which the violation
existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter
162, Florida Statutes for the original amount.
Upon complying, it is the responsibility of the Respondent to notify the Town of Gulf Stream
Code Enforcement Clerk at (561) 276-5116 to request a reinspection of the property.

MOTION, NOTICE AND ORDER OF DISMISSAL FOR LACK OF PROSECUTION
This matter came before the Court on its own motion. The Court finds flint it appears on the face of the
record that there have been no filings for a period of ten (10) months or more immediately preceding
service of this Notice and no stay has been issued or approved by the Court. Pursuant to Florida Rule of
Civil Procedure 1.420(e), if there are no filings within sixty (60) days following the service of this Notice,
and no stay is issued or approved during such sixty (60) day period, this action may be dismissed by the
Court on its own motion. Therefore, it is
ORDERED AND ADJUDGED as follows:
1. if there is a filing in this case within sixty (60) days immediately following service of this Notice,
counsel and all pro se parties shall appear before tike Court for a Mandatory Status Conference/Scheduling
Conference on December 10, 2012 at 9:00 am, in Courtroom 11A, at the Palm Beach County Main
Courthouse, 205 North Dixie Highway, West Palm Beach, FL 33401. A courtesy copy of any filing made
after the date of this Notice and prior to the above hearing shall be furnished to the Court. Failure to
appear at the hearing may result in the imposition of sanctions.
2. If there are no filings within sixty (60) days of this order but Plaintiff files a Showing of Good Cause
after the expiration of the sixty (60) day grace period, Plaintiff MUST appear before the Court on
December 10, 2012 at 9:00 am, in Courtroom 11A, at the Palm Beach County Main Courthouse, 205
North Dixie Highway, West Palm Beach, FL 33401, for a hearing on die Courts Determination of Good
Cause. The Showing of Good Cause shall be filed with tlhe Clerk and Comptroller's Office no less than
five (5) days prior to the hearing and a courtesy copy shall be furnished to the Court. Plaintiff is directed
to bring a copy of the Showing of Good Cause and a proposed order (with stamped envelopes) to the
hearing. Failure to appear at the hearing may result in this matter being dismissed.
3. if no stay has been issued or approved by this Court, no filings made within the sixty (60) day grace
period, and Plaintiff does not comply with the requirements of paragraph 2 above, THIS ACTION
SHALL STAND DISMISSED FOR LACK OF PROSECUTION WITHOUT FURTHER ORDER OF
COURT on the date specified in paragraph 2, pursuant to Rule 1.420(e), Florida Rules of Civil Procedure.

In reply to your letter of May 14, 2009, this is to confirm that there is a code
violation lien that was placed on this property on April 8, 2009. This covers
unpaid fines that were assessed beginning November 4, 2006 at $50.00 per day
until the violation is corrected. The violation has not been corrected as of this
date and the fines continue to accrue with interest as established by law.
This violation consists of the installation of a dock without first obtaining a
building permit. It is possible that the dock is not in compliance with all
applicable codes and the Special Magistrate reserved ruling on this.
There are also unpaid fees for water usage and garbage collection in the total
amount of $1,853.20. The Town turned off the water to the property and
discontinued the garbage collection as of April 21, 2009 so this amount will not
increase until such time as the water is reconnected.

FINDINGS OF FACT

1. The Respondent, RICHARD LAVOIE, was present at the hearing, however, there was a
finding of proper notice.
2. The Town Manager testified to the violation and submitted photos and other evidence.
CONCLUSIONS OF LAW
Respondent is in repeat violation of Sections 22-31 (4), and 42-26 of the Code of
Ordinances of the Town of Gulf Stream.
It is the Order of the Code Enforcement Special Magistrate that a fine of five -hundred -dollars
($500.00) per day shall be assessed beginning April 2, 2009, in accordance with the above listed
Code Sections of the Code of Ordinances of the Town of Gulf Stream for each day the violation
continues to exist.
A certified copy of this Order may be recorded in the Public Records ofPalm Beach County,
Florida, and, once recorded, shall constitute a lien against the property upon which the violation
existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter
162, Florida Statutes for the original amount.
Upon complying, it is the responsibility of the Respondents to notify the Gulf Stream Code
Enforcement Clerk at (561) 276-5116 to request a reinspection of the property.

It is the Order of the Code Enforcement Special Magistrate that Respondent, CHARLES
SUNUNU, shall immediately comply with the above listed code sections of the Code of Ordinances
of the Town of Gulf Stream.
A fine of twenty -five -dollars ($25.00)per day is hereby assessed for the violation that has
existed. The fine is imposed beginning April 22, 2006 and will continue to accrue at twenty -five -
dollars ($25.00) per day for each day the violation(s) continue to exist.

We are enclosing an Affidavit of Compliance covering Code Violations
at 820 Canary Walk, Gulf Stream, Florida 33483 cited under Cases
91-06 and 12-07.
As you are aware, a fine of $25.00 per day for non-compliance was
levied by the Code Enforcement Special Magistrate commencing on April
22, 2006. On July 25, 2006 a lien was filed against the property
at 820 Canary Walk as a result of non-payment of the fines. As of this
date none of the fines have been paid and the lien is still in place.
Inasmuch as the violation was corrected as of April 25, 2007, the fine
of $25.00 per day is no longer being charged as of April 25, 2007.
However, the interest on the unpaid balance is still being applied.
As of April 25, 2007, the total amount of the fines plus interest as
determined by Florida Statutes was $9,710.81. We are enclosing herewith
a daily chart showing the amount of the lien as computed from April 22,
2006 through May 30, 2007.
