AN ORDINANCE ORDINANCE AMENDING CHAPTER 4 OF TITLE V OF THE
VILLAGE CODE OF McCALL, IDAHO, REGARDING DOGS, BY
ADDING.THREE NEW SECTIONS THERETO; DEFINING NUIS-
ANCE WITH REFERENCE TO KEEPING.OF DOGSAND MAKING
IT UNLAWFUL TO MAINTAIN SUCH NUISANCE; MAKING IT
UNLAWFUL TO FAIL TO PROVIDE -A DOG WITH SUFFICIENT
FOOD, WATER,'CARE:AND-SHELTER; AND PROVIDING A
PENALTY.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF
THE CITY OF McCALL, IDAHO, AS FOLLOWS:
Section 1. That Chapter 4 of Title V of the Village Code
of McCall, Idaho, be, and the same is hereby amended by adding
three new sections thereto to read as follows:
Section 1. NUISANCE: It shall be unlawful for
any owner to fail to exercise proper care and
control of his dog to prevent it from becoming
a public nuisance. Excessive, continuous or
untimely barking, molesting passersby, chasing
vehicles, habitually attacking other domestic
animals, trespassing upon public or private prop-
erty in such a manner as to damage the property,
shall be deemed such nuisance.
Section 2. FAILURE TO PROVIDE CARE: It shall
be unlawful for any owner to fail to provide a
dog with sufficient good and wholesome food and
water, proper shelter and protection, veterinary
care when needed to prevent suffering, and humane
care and treatment.
Section 3. VIOLATIONS; PENALTY: Any person, firm,
company, corporation or association violaing any
of the provisions of this Ordinance shall be deemed
guilty of a misdemeanor and upon conviction thereof,
shall be fined not exceeding one hundred dollars
($100.00) or by imprisonment for not more than
thirty (30) days or by both said fine and imprison-
ment.
