ORDINANCE NO. 347
AN ORDINANCE AMENDING CHAPTER 7 OF TITLE V
OF THE VILLAGE CODE OF MCCALL, IDAHO, RELATING
TO SNOWMOBILES ; AMENDING SECTION 5-7-3 TO PRO-
VIDE THAT NO SNOWMOBILES SHALL BE OPERATED IN
THE CITY OF MCCALL UNLESS NUMBERED BY THE OWNER
AS PROVIDED BY CHAPTER 338- OF THE IDAHO SESSION
LAWS OF 1969 ; AMENDING SECTION 5-7-5 TO PROHIBIT
THE OPERATION OF SNOWMOBILES ON THE MCCALL GOLF
COURSE AND IN POSTED HOSPITAL ZONES OF THE CITY;
AND BY ADDING A NEW SECTION THERETO TO BE DESIG-
NATED SECTION 5-7-7 PROVIDING SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF
THE CITY OF MCCALL, IDAHO, AS FOLLOWS :
Section 1. That Section 5-7-3 of the Village Code of
McCall, Idaho, shall be and is hereby amended to read as
follows :
5-7-3 : OFFENSES BY PERSONS OWNING SNOWMOBILES :
A. It shall be unlawful for any person to - knowingly
permit, allow or encourage the operation or driving of a
snowmobile by a person under the age of fourteen (14) years.
B. No snowmobile shall be operated ini--the City of
McCall, by any person unless such snowmobile has been num-
bered by the owner as provided by Chapter 338 of the Idaho
Session Laws of 1969.
Section 2. That Section 5-7-5 of the Village Code of
McCall, Idaho, shall be and is hereby amended to read as
follows :
5-7-5 : REGULATIONS FOR OPERATION OF SNOWMOBILES :
A. It shall be unlawful to drive, operate or park a
snowmobile on any sidewalk in the City.
B. It shall be unlawful to operate or park a snowmo-
bile on any portion of the premises known as the McCall
Golf Course.
C. It shall be unlawful to drive or operate a snowmobile
within any posted hospital zone in the City.
D. No snowmobile shall be operated at a speed in excess
of twenty (20) miles per hour in the City.
E. No_ snowmobile shall carry passengers or weights in'3�
excess of the capacity recommended. by the manufacturer thereof.
F. No sled, toboggan, trailer or any other device
shall be towed by a snowmobile except by means of a rigid
tow bar connecting the same to such device.
G. No person on skis shall be towed behind a snowmobile.
H. It shall be unlawful to drive or operate a snow-
mobile while under the influence of intoxicating liquor.
I. All snowmobiles shall come to a full stop at all
street intersections.
J. All snowmobiles shall be operated only in single
file on the extreme right hand side of the street.
K. Operation of snowmobiles on the streets of the
City shall be limited to ingress and egress to and from the
City; that City streets are not to be used as a place of
recreation for snowmobiles.
L. No snowmobile shall be operated within the City
limits after 10 :00 P.M. except for the purpose of going
directly to or from the place of residence of the operator
of such snowmobile or to its- place of storage.
M. No person shall operate a snowmobile carelessly and
heedlesslyg or without due caution and circumspection and at
a speed or in a manner as to endanger or be likely to en-
danger any person or property.
Section 3. That Chapter 7 of Title V of the Village
Code of McCall' Idaho, is further amended by the addition of
a new section thereto to be numbered 5-7-77 to read as
follows :
5-7-7: SEVERABILITY: If any portion of this Chapter
or the application "-thereof to any persons or circumstances
is held to be invalids the invalidity shall not affect other
provisions or applications of the ordinance which can be
given effect without the invalid provision or application,
and to this end the provisions of this Chapter are severable.
