RESOLUTION NO. 2020-10-02
A RESOLUTION APPROVING A MINOR SITE PLAN FOR 120 RAILROAD AVENUE,
FRASER, COLORADO, TO ALLOW A VACANT LOT TO BE USED FOR TEMPORARY
OVERFLOW PARKING ASSOCIATED WITH HILLY'S HOOKER SERVICE WITH THE
CONDITIONS STATED HEREIN
At the regular meeting of the Fraser Planning Commission held on October 28, 2020,
Chris Hillison, owner of Hilly's Hooker Service, and permittee, requested a recommendation of
approval for a Minor Site Plan to replace Development Permit#019; and
WHEREAS, the owner of Hilly's Hooker Service has received several violation letters
relating to property maintenance and violation of conditions specified in Development Permit
#019; and
WHEREAS, the Planning Commission has discussed the appearance of the property
with the property owner at several Planning Commission meetings; and
WHEREAS, Chris Hillison has provided the Town of Fraser with a land survey plat and
renderings indicating where an eight-foot fence will be located on said property; and
WHEREAS, Staff and Planning Commission have determined that the renderings
provided by Chris Hillison will mitigate the sight of the wrecked/impounded vehicles.
NOW THEREFORE BE IT RESOLVED that the Fraser Planning Commission has voted
to approve a Minor Site Plan for 120 Railroad Avenue, Fraser, Colorado with the following
conditions:
1. The terms of approval include representations made by Chris Hillison at several
Planning Commission meetings as to the nature of the project.
2. The allowance of 20 cars in the lot until the fence is built.
3. The fence will be erected by June 30, 2021.
4. No stacking of vehicles.
5. The fence will be eight feet tall.
6. The gates on the fence will be closed at all times unless vehicles are being
maneuvered in or out of fenced-in parking area.
7. Ongoing maintenance of the fence will be required.
8. The only vehicles parked outside of the fence are to be removed within 48 hours.
These cars are being removed by other parties that do not have access inside the
fence. Maximum number of vehicles parked outside fence is 3.
9. The Planning Commission reserves the right to revisit this application if they feel that
these conditions are not properly addressed.
10. The applicant will obtain the necessary building permit for the eight-foot fence.
11. Chain link materials are not acceptable.
12. Acceptable fencing materials include the following: wood, vinyl, composite or
corrugated metal.
13. Fence shall be a privacy fence which means a fence with close fitting vertical pickets
to screen the sight of the wrecked/impounded vehicles.
14. No vehicles are permitted to be parked on the railroad ROW or adjacent to Town
easements. No vehicles are permitted to park off 120 Railroad Avenue or in Town
ROW's, or on property not owned by permitee without a parking easement.
15. East fence can be eliminated if property owners at 425 N Zerex Street (Fraser 1St—
Eastom 1St Lots 3-10, Block 7 less ROW) agree. Property owner consent in writing is
required.
16. If property is conveyed to another owner and/or business is leased to another owner,
this permitted use will need to be reviewed and approved by the Planning
Commission within 30 days of such transaction.
