Councilman Presents the following Ordinance Seconded by Councilman
ORDINArNCE OF THE BOROUGH OF CARTERET, IN THE COUNTY
OF MIDDLESEX, ADOPTING A REDEVELOPMENT PLAN FOR THE
LANDFILL 1I REDEVELOPMENT AREA
WHEREAS, the Local Redevelopment and Housing Law, N.J.S.A 40A:12A -1 et seq.,
as amended and supplemented (the "Redevelopment Law"), provides a process for municipal
participation in the redevelopment of parcels of property located within designated "areas in
need of redevelopment "; and
WHEREAS, by Resolution No. 08 -14, duly adopted on January 6, 2008, the Mayor and
Council of the Borough of Carteret ( "the Borough Council ") authorized and directed the
Planning Board of the Borough of Carteret (the "Planning Board ") to undertake a preliminary
investigation to determine whether those properties identified as Block 9.03, Lot 21, Block 10,
Lots 8 through 21 and Block 11.01, Lots 6 through 16, 27 and 28 on the tax map of the Borough
(the "Initial Properties ") meet the criteria set forth in the Redevelopment Law as an "area in need
of redevelopment" as defined therein; and
WHEREAS, by Resolution No. 09 -238, duly adopted on November 23, 2009, the Mayor
acid Council of the Borough of Carteret ( "the Borough Council ") authorized and directed the
Planning Board of the Borough of Carteret (the "Planing Board ") to undertake a preliminary
investigation to determine whether those properties identified as Block 10, Lot 11 and Block
11.01, Lots 6, 7, 9, 15, 16, 27, 48, 53 and 54 on the tax map of the Borough (the "Additional
Properties ")(collectively with the Initial Properties the "Study Area" or the "Properties ") meet
the criteria set forth in the Redevelopment Law as an "area in need of redevelopment" as defined
therein; and
WHEREAS, on January 23, 2008.and December 2, 2009, respectively, the Planning
Board undertook said investigation and conducted public hearings in accordance with NJS.A.
40A:12A -6 and recommended to the Borough Council that the Study Area be designated as an
area in need of redevelopment; and
WHEREAS, on October 20, 2011, the Council reviewed the recommendation of the
Planning Board and designated the Study Area as an area in Deed of redevelopment (the
"Landfill II Redevelopment Area "); and
WHEREAS, in furtherance of the redevelopment of the Landfill II Redevelopment Area,
a redevelopment plan was prepared by Beacon Planting and Consulting Services, LLC for the
Landfill II Redevelopment Area (the "Landfill II Redevelopment Plan"); and
WHEREAS, the Council further directs the Planning Board to review the Landfill II
Redevelopment Plan and provide its recommendations pursuant to NJS.A. 40A: 12A-7(e).
NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND BOROUGH
COUNCIL. OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX,
NEW JERSEY, as follows:

Section 1. The Planning Board is hereby directed pursuant to N.J.S.A. 40A:12A -7(e)
to review the Landfill II Redevelopment Plan and provide a report with its recommendations to
'I. the Borough Council within 45 days of the date of the introduction of this Ordinance.
Section 2. Pursuant to KJSA. 40A:12A -7(e), the Borough Council hereby adopts
the Landfill B Redevelopment Plan, which is attached hereto as EXhibit A and made a part of this
Ordinance, subject to the report containing the recommendations of the Planning Board, which
report must be reviewed by the Council prior to final adoption of this Ordinance if received from
the Planning Board within 45 days of the date hereof.
Section 3. Upon final adoption of this Ordinance, the sections of the Zoning Map of
Borough that relate to the Landfill B Redevelopment Area are hereby amended to incorporate
provisions of the Landfill H Redevelopment Plan.
Section 4. If any part of this Ordinance shall be deemed invalid, such parts shall be
and the invalidity thereby shall not affect the remaining parts of this Ordinance.
Section 5. A copy of this Ordinance shall be available for public inspection at tare
>ffrces of the Borough Clerk.
Section 6. - This Ordinance shall take effect immediately upon final adoption and
mblication thereof according to law.
Section 7. Upon final adoption hereof, the Borough Clerk shall forward certified
of this Ordinance to Borough Law D for distribution as he determines appropriate.
