A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
DESIGNATING THE DEPUTY CITY CLERK AS THE ELECTIONS OFFICIAL FOR
THE GENERAL MUNICIPAL ELECTION.TO BE HELD ON NOVEMBER 8, 2011
WHEREAS, Section 320 of the California Elections Code defines an
"elections official" as "(a) A clerk or any person who is charged with the duty of
conducting an election"; and
WHEREAS, Section 6 of the California Elections Code states: "Whenever a
power is granted to, or a duty is imposed upon, a public officer, the power may be
exercised or the duty may be performed by a deputy of the officer or by a person
authorized, pursuant to law, by the officer, unless this code expressly provides
otherwise"; and
WHEREAS, the City Council shall, by resolution, appoint an elections official of
its choice to render specified services in a regular or special municipal election held in
the city and the elections official may, but need not be the city clerk; and
WHEREAS, the City Council determines that appointing the Deputy City Clerk
as the Elections Official for the upcoming election in which the City Clerk, who currently
serves as the City's Elections Official, intends to run for re-election, would best serve
Lynwood in providing transparency, fairness and neutrality in the upcoming election
process.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS:
Section 1. A�pointment of Elections Official. The City Council hereby
appoints Kristina Santana, Deputy City Clerk, as the Elections Official for the City of
Lynwood General Municipal Election to be held on November 8, 2011.
Section 2. Duties of the Elections Official. The duties of the Elections Officiai
shall be as set forth in the Elections Code and Lynwood Municipal Code, which duties
include, but shall not be limited to, the following:
a) Supervise the general municipal election and prescribe rules and regulations for
the conduct of such election that are not in conflict with the provisions of this
chapter or constitution and general laws of the state.
b) Upon the filing of nomination papers by a candidate for elective city office, the
election official shall receive and shall cause to be deposited in the general fund,
a filing fee in an amount established by resolution of the city council.
c) In addition to the other duties required for the election of#icial in connection with
municipal elections, the election official shall:
i
a. Supply appropriate forms and manuals prescribed by the California Fair
Political Practices Commission. These forms and manuals shall be
furnished to all candidates and committees and to all other persons
required to file reports;
b. Determine whether required documents have been filed and, if so,
whether they conform on their face with the requirements of state law;
c. Notify promptly all persons and known committees who have failed to file
a document in the form and at the time required by state law;
d. Report apparent violation of this section and applicable state law to the
City Attorney;
e. Compile and maintain a current list of all statements or parts of statements
filed with the election official pertaining to each candidate for elective city
office;
f. Assist the Franchise Tax Board and the Fair Political Practices
Commission in conducting audits and investigations of reports and
statements filed by candidates and committees supporting or opposing
candidates for elective city office at such times and in such manner as
may be required under the political reform act of 1974, as amended.
Section 3. This Resolution shall take effect and be in full force immediately or
as authorized by law.
Section 4. The City Clerk shall certify to the passage and adoption of this •
Resolution.
