am amenable to the Town identifying which records are responsive to the corresponding request in an effort to
prevent duplicative efforts.
I request an estimated production schedule and if the Town needs an extension of time for any reason, please let
me know and I am sure we can work something out that is fair to all sides. I will note that the utility of these
records is time sensitive and I will need them within 30 days.

The Town of Gulf Stream has received your public records request dated February 2, 2018. The

In regards to #1, the Town notes that this request is identical to a request that was made by your
client Stopdirtygovernment, LLC more than four years ago, on February 7, 2014. The Town
acknowledged that request on February 8, 2014 and responded on February 19, 2014. During
that time period, the Town was receiving and processing a very large number of public records
requests, and at all times acted in good faith to promptly provide all records responsive to the
request as it was understood by Town Staff.
With respect to the February 7, 2014 request, the requestor Stopdirtygovernment, LLC did not
follow up to clarify the request or seek any additional records, but instead the next contact with
Stopdirtygovernment, LLC was through the O’Boyle Law Firm, who filed suit on March 27, 2014,
alleging that the Town unlawfully withheld records responsive to that request. The complaint
stated that “Plaintiff has reason to believe that Defendant’s response is incomplete.” See
Complaint at ¶ 15. The Town was never advised by Stopdirtygovernment, LLC that the response
appeared to be incomplete, and first learned of this alleged deficiency by being served a lawsuit.
Because this request is identical to the one in litigation, the Town interprets the request to seek the
same records sought when the request was made in 2014, namely, electronic communications sent
or received by Commissioner Ganger from the time period beginning November 1, 2012 through
February 7, 2014, the date the original public records request was received. However, at different
times during the four years that case has been pending, you, lawyers from your law firm, or other
lawyers hired by Stopdirtygovernment, LLC have alleged that this interpretation was incorrect and
that a variety of other types of records should have also been provided. As recently as last week,
a lawyer hired by Stopdirtygovernment, LLC stated that he understood “the Town has thousands
of responsive records under its own control.” However, as the request was understood in 2014,
that is not so.
Based on this statement, the Town believes our interpretation of your request may be different than
yours. Therefore, if you provide a clarification as to the records you seek, the Town will promptly
provide you with an estimate or estimated cost to respond to your request as clarified. We
appreciate the opportunity to work with you in providing you with the records you seek.
In regards to #2, the Town will require one hour of information technology support at $75.00 per
hour, the labor cost of the personnel providing the service, per Fla. Stat. §119.07 (4)(d).

response is duplicative, I am amenable to the Town identifying which records are responsive to
the corresponding request in an effort to prevent duplicative efforts.

Commission members were provided with Town e-mail addresses to use for Town business. Many
e-mails regarding Town business were subsequently forwarded by the individual Commissioners
to these Town e-mail addresses, and the Town is in possession of these e-mails. A check with
some of the Commissioners that are subject to these public records requests has resulted in no
records that would not be in the possession of the Town. Based on this information that had to be
