AN ORDINANCE REGULATING THE CONSTRUCTION OF FIREPLACE S ,CHIMNEYS AND
SMOK_EPIPES;TO PROVIDE FOR TIIIE INSPECTION,SUPPRESSION,®R CLEANING of
A,:IMPLACES,CHIMNEYSi,SrMOKEPIPES,OR ANY APPARATUS USED IN ANY BUILDING
WHICH MAY BE DANGEROUS IN CAUSING FIRES;PREVIXTING THE PLACING OF ANY
NATERIAL-,RUBBIOR IFR WASTE IN SMETS OR ALLEYS; RE UIRING THE OWNERS OR
OCCUPANTS TO ALTER OR REPAIR DEFECTIVE PIPES,FLUE'? AND CHIMNEYS AND
ORDEPLING THE CONSTRUCTION OF BRICK OR TERRA COTTA FLUE£ TO BE BUILT IN
THE PLACE OF STOVEPIPES \'ITHTN A CERTAIN DISTRICT IN THE VILLAGE OF McCALL,
AID PROVIDING A PENALTY FOR THE VIOLATION THIII`iLQF .
of the Village of McCa1l,Boise County,Idaho;
Section I. That any chimney or flue that may hereafter be built within the
Village of MoCall,shali he constructed of brick or terra cotta,anca_ if of
brick .spy -tea shall have walls of good quality of brick at least four
inches in thickness and shall have a bottom of at least six inches in
thickness of same material,and shall be laid in good lime mortar and be
plastered on the inside,and when passing through or near woodwork shall
1ae plastered on the outside.
Section 2. No chimney or flue shall be built which shall have any wood
or combustible material resting upon,supporting or entering into it further
than will leave at 1eaA four inches between the said material and the in—
side of the chimney or flue. All chimneys shall rest upon a firm foundation
and be well secured aria f shall extend at least three feet above the roof of
he building to which they are attached,and shall extend at least three feet
below the eeiling,and should any such chimney or flue be deemed unsafe to
the building or to adjoining buildings by the Board of Trustees,it shall,
upon their order,be built to such height as they deem necessary.

^cation 3. No smoke pipe shall enter any flue or chimney unless the said
pipe shall be at least eight inches from either floor or ceiling,and in all
cases where pipes pass through wood or combustible partitions,ceilings or
floors of any kind,whether they be plastered or not ,said pipe shall be
guarded by a double collar of metal with at least four inches of air space

floors. No smokepipe shall pass through any window, side or roof of any
ailding,nor nearer than I8 inches to any wall of combustible material,
except at right angles therewith in passing through the same.
Section 4.. No person shall place or maintain any combustible material,
waste,or rubbish of any kind on any of the streets,or alleys of the
Village of McCall,without first obtaining from the Chairman of the Board

Section 5. The „J a, 6T-=-Trusees. shall have authorety,and
he is hereby required once every six months,and at any other time when
'iirected by the Board of Trustees to examine the conditions of stovepipes,
chimneys and flues in McCall and shall have general authorety to enter any
premises or building therein for the purpose of carrying into effect the
purpose of this ordinance,who shall make a report thereof in writing to
the Board of Trustees,and if he shall judge any flue,pipe or chimney to be
unsafe so as to endanger any property with fite,he shall notify the owners
.,r occupants thereof in writing to alter or repair such defective pipe,
flue or chimney and in what manner,and if such owners or occupants fail
to make such necessary alterations and repairs within 15 days,it shall be
the duty of said Chairman to make complaint of such violations of this
ordinance before the Police Judge or Justice of the Peace,and the said
Chairman,shall also have the authorety to tear down,suppress(,alter or
repair such defective pipe,flue or chimney as may be necessary, or cause
the same to be done,for the protection of the community.
sction 6. That the owners of all buildings situated in that portion
of the Pillage of McCall,which is bounded on the west by Ist street,on the
south by Park street,between Ist and 4th streets,on the east side by 4+th
street,from Perk street to Lenvia street,thence easterly with Lenvia street
to McCall avanue to Pine street,and thence along McCall avenue to Pine street,
thence westerly along Pine street to Lake street,and thence southerly and
sterly along Lake Street to Ist Street,are hereby ordered to construct,
and build brick or terra cotta chimneys or flues in place of stovepipes
now running through the roof or side walls of buildings,_,�.�
Section 7. That the owners of such buildings shall have th..Q-Q is from
and after the passage and approval of this ordinance in which to comply
with the provisions of section 6 of this ordinance.
Section 8. Any violation of any of the provisions of this ordinance by
any person shall be deemed guilty of a misdemeanor and on conviction thereof,
efore any court having jurisdiction MINIM shall be punished by a fine not
to exceed $I90.03 and costs of prosecttion,and in default of payment thereof,
shall be imprisoned for a time not to exceed one day for $2.99 of such fine,
_ind each day of maintaining or continuing such violation shall be deemed a
new offense and be punished accordingly.
