APPLICANT C/C April 23, 2009 DR -07-64 FINDINGS OF FACT AND CONCLUSIONS OF LAW AND DECISION AND ORDER OF APPROVAL OF REVISED DESIGN REVIEW The above entitled matter coming on regularly for public hearing before the City Council on April 23, 2009, at the hour of 6:30 p.m. o'clock p.m., at the McCall City Hall, 216 E. Park Street, McCall, Idaho, and the hearing was opened on the revised Design Review application and Michelle Groenevelt Planning Manager, and Dan Scott, Dave Peugh, Wayne Ruemmele, Dennis Moyer, Willie Beebee, Mike Hormaechea, David Carey, and Rick Harvey, testified at the hearing, and the City Council being fully advised, finds, concludes and orders as follows: FINDINGS OF FACT a) An application for approval of design review, pursuant to McCall City Code Section 3.16.02, was submitted on September 21, 2007 by Dan Scott on behalf of McCall Aviation, Inc., the owner of the property, and said real property is described as: FBO 1 at the McCall Municipal Airport, City of McCall, Valley County, Idaho. b) The McCall Area Planning and Zoning Commission held a properly posted and noticed public hearing on the application on December 4, 2007. FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE l AND DECISION AND ORDER OF APPROVAL OF REVISED DESIGN REVIEW c) The Commission denied the application on December 4, 2007 because the application was not in conformance with the Airport Zoning Map Amendment development agreement. d) The Commission discussed some of the design review elements but did not make any formal recommendations on the design review criteria. The application was denied because the Commission determined the project was not feasible with the development standards in the Zoning Map Amendment development agreement. e) The applicant appealed the Commission's decision on December 24, 2007, according to McCall City Code Section 3.15.08. f) The McCall City Council held a properly posted and noticed public hearing on January 24, 2008 for the appeal of the DR-07-64, at which hearing it denied the appeal. g) The applicant timely filed a Petition for Judicial Review in the District Court of the Fourth Judicial District. On December 8, 2008, the parties participated in a mediation session that included the Mayor, Council Member Bailey, the Community Development Director Michelle Groenevelt, and City Manager, Lindley Kirkpatrick. h) A Conditional Settlement Agreement was entered into on January 22, 2009, which required the McCall City Council to hold a public hearing on revised plans submitted as part of DR-07-64. i) The applicant submitted a revised Design Review application pursuant to the terms of the Conditional Settlement Agreement. j) The McCall City Council held a properly posted and noticed public hearing on the revised Design Review application on April 23, 2009. k) City Staff submitted a staff report with recommended conditions of approval for consideration at the April 23, 2009 public hearing (Exhibit 1). 1) The property is generally located along Deinhard Lane and Third Street at the McCall Municipal Airport, McCall, Valley County, Idaho. m) The location of the subject property is located in the "Airport" (AP) zone at the McCall Municipal Airport along Deinhard Lane, McCall, Valley County, Idaho. FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 2 AND DECISION AND ORDER OF APPROVAL OF REVISED DESIGN REVIEW n) The complete legal description of the property is on file in the City Clerk's office, which is located at 216 E. Park Street, McCall, Valley County, Idaho. o) The revised Design Review application seeks approval to construct a hangar along Deinhard Lane with lobby and reception area for passengers and crews, additional restroom facilities, paved surface parking, and sidewalks, curbs and gutters to tie into the Four Corners project. p) The applicant has requested approval to construct a 120' x 120' (14,400 sq. ft.) commercial hanger building, along with a 53' x 78' (3,452 sq. ft.) lobby/office space. The combined square footage of the new building would be approximately 17,800 sq. ft. The existing hangar is 80' x 145' (11,600 sq. ft.). The proposed building would have a reduced and limited maximum height of 42 feet. q) The height of the proposed hangar is 42' and the height of the proposed lobby building is 34'4". The height of the existing hangar is 28'. r) The new hangar is to be constructed out of profiled metal with a wainscoat of stone veneer. The existing hangar will also receive updated finishes. The applicants plans, attached hereto as Exhibit 2, (Sheet 01.1) provide the material samples and color renderings. s) The presented color renderings and the presented materials samples differ in color. The final exterior wall materials are proposed to match the presented samples. t) The new sign for McCall Aviation will be 14 feet wide and 7 feet tall for a total of 98 sq. ft. The sign will be attached to the new hangar without lighting. u) The applicant's proposed landscaping plan, attached hereto as Exhibit 3, (Sheet 01.4) provides for all landscaping to comply with the City of McCall landscaping requirements, specifically MCC 3.8.13 Landscaping, Screening and Buffering regarding the screening of parking lots. v) Pertaining to the number of parking spaces, the applicant does meet the intent of the McCall City Code (57 proposed parking spaces) regarding the number of required parking spaces and the proposed parking spaces should be sufficient to serve the development. w) The Future Land Use Plan (adoption December 2007) identifies the property as "Airport" (AP) zone. FINDINGS OF FACT AND CONCLUSIONS OF LAW - PAGE 3 AND DECISION AND ORDER OF APPROVAL OF REVISED DESIGN REVIEW CONCLUSION OF LAW 1. The revised Design Review application as supplemented by the inclusion of the updated landscaping plans and architectural drawings presented at the public hearing on April 23, 2009 complies with all provisions of McCall City Code, Title 3, Chapter 16. 2. Applicant is entitled to approval of its revised Design Review application. DECISION AND ORDER Pursuant to the City Council's authority as provided in McCall City Code Section 3.16.03 and based upon the above and foregoing Findings of Fact, which are herein adopted: IT IS HEREBY ORDERED AND THIS DOES ORDER, the revised Design Review Application, which includes a building construction height not to exceed a height of 42 feet for the proposed hangar and the lobby height not to exceed a height of 32 feet, is hereby approved, and the applicant shall comply with: (1) the conditions listed in the Staff Report attached hereto as Exhibit 1, (2) the further condition that if there are any significant or major revisions between the final landscaping plan and the landscaping plan presented on April 23, 2009, then no building permit shall be issued until the revised landscaping plan has been approved by City Council, and (3) all other applicable ordinances and regulations (e.g. building codes, etc.). Application: Design Review application to construct a new commercial hangar at 300 Deinhard Lane Zoning District: AP- Airport Zone The Application A revised design review application was submitted to construct a hangar along Deinhard Lane with lobby and reception area for passengers and crews, additional restroom facilities, paved surface parking, and sidewalks, curbs and gutters to tie into the Four Corners project. Background Information The applicant initially submitted a design review application for a new commercial hangar at 300 Deinhard Lane on September 21, 2007. The McCall Area Planning and Zoning Commission denied the application on December 4, 2007, because the application was not in conformance with the Airport Zoning Map amendment development agreement (that has since been determined void.) The applicant appealed the decision to the McCall City Council. The City Council held a public hearing and denied the appeal, because at the time the application was filed, the Airport Master Plan Update had not been approved and therefore the design review was subject to the height restrictions imposed by the Scenic Route Overlay Zone (35'). The proposed building exceeded the maximum height allowed at the time the application was filed. The applicant filed a Petition for Judicial Review in the District Court of the Forth Judicial District. On December 8, 2009, the parties participated in a mediation session that included Mayor Kulesza, Council Member Bailey, Community Development Director Michelle Groenevelt, and City Manager Lindley Kirkpatrick. The Conditional Settlement Agreement was entered into on January 22, 2009. The Agreement (see attachment) requires the City Council to hold a public hearing on the revised plans submitted as part of DR-07-64. The hangar proposed shall be reduced and limited to a height of forty-two (42) feet. The applicant submitted revised materials for the material board, material list, elevations, an artist rendering of the building and landscaping, and a preliminary landscaping plan. Deinhard Lane March 17, 2009 The proposed landscaping plan that includes plantings along 3rd Street (Highway 55), Deinhard Lane, the internal parking lot and structures meets the McCall Design Guidelines. Specially, the plan addresses Design Guideline #38 to screen parking lots: "Use landscaping to mitigate the visual impact of parking lots. Well placed groups of appropriate trees and shrubs can improve the appearance of these vast expanses of asphalt. It is recommended that at least one-fourth of any such parking area larger than 5,000 square feet be shaded by planting trees and shrubs. The objective is to create a park or architectural form in what is otherwise a waste land." Application Details The applicant proposes a 120'x120' ( 14,400 sq. ft.) commercial hangar building, along with a 53' x 78' (3,452 sq. ft.) lobby/office space. The combined square footage of new buildings would be approximately 17,800 sq. ft. The existing hangar is 80' x 145' (11,600 sq. ft.). The height of the proposed hangar is 42' and the height of the proposed lobby building is 32'. The height of the existing hangar is 28'. The final exterior wall materials is proposed to match the presented samples. The new sign will be 14 ft. wide and 7 ft. tall for a total of 98 sq. ft. The sign will be attached to the new hangar without lighting. The applicant has proposed a landscaping plan (Sheet 01.4). All proposed landscaping will comply with City of McCall landscaping requirements, specifically MCC 3.8.13 Landscaping, Screening and Buffering regarding the screening of parking lots. (closest corner) Maximum lot coverage 50% 45% Minimum property width 75 ft. 245 ft. Parking McCall City Code Section 3.8.06 does not have a specific parking calculation for hangars or airport terminals. The Code does contain a generic requirement of 1 parking space for every 300 square feet of "All other types of businesses or commercial uses permitted in any zone", but it is unclear whether this is intended to capture the square footage of a hangar or of the associated lobby/office space. Upon review of the proposed plans, and based on the Code's indeterminacy, the applicant meets the intent of the Code (57 proposed parking spaces) regarding the number of required parking spaces and this number should be sufficient to serve the development. Deinhard Lane March 17, 2009 McCall Area Comprehensive Plan The Future Land Use Plan (adoption December 2007) identifies the property as "Airport" (AP) zone. Agency Reviews The revised project plans have been distributed to various agencies. Comments have not been received to date, but any comments will need to be fully addressed by the applicant per the associated condition of approval. Staff Recommendation Based on the McCall City Council and Design Guidelines, staff recommends approval of the revised DR-07-64 application subject to the conditions of approval. Original Staff Report vs. Revised Staff Report — Topics for Consideration/Comment The original staff report for DR-07-64 included conditions relating to the following topics. This staff report, and associated conditions, stay within the confines of these topics and do not include discussion or conditions that fall outside these boundaries. The project is in general conformance with the Comprehensive Plan. 2. The project does not jeopardize the health, safety or welfare of the public. 3. The project conforms to the applicable specifications outlined in the City of McCall Design Guidelines as well as all other applicable requirements of the Zoning. The Council concludes that: 1. The applicant shall provide calculations regarding the amount of impervious surface relative to the amount of indicated snow storage (see Sheet 01.4 for indicated snow storage locations). The amount and location of snow storage shall be approved, as a part of a require stormwater/drainage plan, by the City Engineer. 3. The applicant is responsible for removal of noxious weeds, if present, on the property. 4. The applicant shall meet all of the underlying requirements of the Airport Zone to include setbacks and lot coverage requirements. 5. The applicant has proposed an outdoor lighting plan consisting of five (5) street lights, no outdoor lighting has been proposed for the proposed, or existing, structure(s). The final design and specifications of the proposed street lights shall be approved by the Lighting Administrator in accordance with McCall City Code Title 3, Chapter 14, especially in regards to maximum lumen output, foot-candle illumination, and mounting height for parking lot lighting. Any desired outdoor lighting for the proposed structure(s) or sign(s) shall be approved by the Lighting Administrator. All existing lighting on the property shall be brought into conformance with the current code. A Certificate of Occupancy shall not be issued for the proposed structure(s) until this condition has been satisfied. The lighting plan shall be approved prior to the issuance of a building permit. 6. The applicant shall comply with all applicable federal, state, local and special purpose standards as they apply to this project. 7. The applicant shall acquire all required business licenses and permits and be subject to all public inspections and approvals. 8. The applicant shall receive written approval from the McCall Fire District prior to the issuance of a building permit or business license. 9. The applicant shall obtain a letter from the City Engineer recommending engineering approval of the following prior to the issuance of a building permit: a. construction drawings b. drainage and stormwater plan c. lighting plan 10. The applicant shall provide the City Engineer with fire flow, water distribution and wastewater calculations and acquire all necessary permits and pay all associated fees. The City Engineer will review the water modeling results and irrigation plans. 11. The applicant shall install sidewalks, curbs and gutters (and associated stormwater solutions) along Deinhard Lane, connecting into the monument feature at the northeast corner of the subject property. The design of this section shall include an 8' sidewalk and street trees. The applicant shall also install all of the indicated pathways on Sheet 01.4 (both along Highway 55 and connecting to the parking lot). The overall design shall incorporate the comments and requirements of the Public Works Department, the City Engineering and the Planning Department. A change to the details and type of design may be warranted by a design considered, jointly reviewed, and approved by the aforementioned departments. Deinhard Lane March 17, 2009 accepted/approved by the City of McCall prior to the issuance of a Certificate of Occupancy. 12. The applicant shall maintain all sidewalks and pathways and keep the improvement free of snow. 13. The applicant shall submit a construction plan per MCC 9.6.08 prior to the submittal of a building permit. 14. The landscaping plan shall be implemented prior to the issuance of the Certificate of Occupancy. 15. Address Design Guideline #39 Irrigation System Required: All projects must provide an irrigation system. Landscape plans must include an irrigation system. Items of most importance include full coverage; water conservation through proper design; and automatic systems for commercial projects. Low water consumption irrigation systems are encouraged.
