HomeMy Public PortalAboutORD15093SUBSTITUTE BILL NO. 2012 -136 SPONSORED BY COUNCILWOMAN Carroll ORDINANCE NO. 15093 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, SUBMITTING A PROPOSED AMENDMENT TO THE CHARTER OF THE CITY OF JEFFERSON TO A VOTE OF THE CITIZENS OF THE CITY OF JEFFERSON TO ELIMINATE PRIMARY ELECTIONS. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Article VIII (NOMINATIONS AND ELECTIONS), Section 8.2 (Nominations), of the Charter of the City of Jefferson shall be amended to read as follows: Section 8.2. Nominations. (a) Declaration of Candidacy, Independent Candidates. Nomination of candidates for election to elective city offices shall be made by declaration of candidacy filed with the clerk in the form and manner prescribed by ordinance. No declaration of candidacy shall indicate the affiliation or membership of the nominee with any political party organized or recognized under the laws of the State of Missouri. (b) Election Winner. The winner of the election shall be the person who receives the highest number of ballots cast in the election. (c) Regulation by Council. Nothing contained in this charter shall prevent the council from further regulating the conduct of nominations and elections consistent with the provisions of this charter and applicable state laws. Section 2. The amendment as set forth in Section 1 shall be submitted to the qualified voters of the City of Jefferson, Missouri, for their approval, at the election to be held on the 8th day of April 2014 day -ef August, 201.3, at the places designated by the Election Authority for said election and the ballot shall be in substantially the following form: Drafter's Note: Deleted text is shown thus. Substitute Bill 2012 -136 — Page 1 SUBSTITUTE PROPOSITION Shall Section 8.2 of Article VIII (Nomination and Elections) of the Charter of the City of Jefferson be amended to eliminate the primary election and therefore the candidate receiving the most votes at the general election would win the office as provided in Ordinance No. 15093 passed and approved by the City Council on March 18, 2013.
