KNOW ALL MEN BY THESE PRESENTS, that Mirella M. Ventress, as Trustee of the
Ventress Survivor's Trust, under agreement dated May 28, 2005, the Grantor as to one-half
(1/2), and Mirella M. Ventress, as Trustee of the Ventress Marital Trust, under agreement dated
May 28, 2005, the Grantor as to one-half (1/2), collectively the Grantors, for value received do
hereby grant unto City of McCall, a political subdivision of the State of Idaho, the Grantee, the
right to go upon, occupy, and use a portion of the following described real estate situated in the
City of McCall, Valley County, State of Idaho as a permanent landscaping easement, to -wit:
A permanent landscaping easement located in Section 9, Township 18 North, Range 3
East, Boise Meridian, Valley County Idaho, being more particularly described as follows:
Commencing at a Found 1/2 rebar marking the Northeast corner of Lot 11, Block 3,
Thence South 11'47'34" East a distance of 35.93 feet to a point;
Said point also being The Point of Curvature of a Non -Tangent curve to the right having a
radius of 1869.86 feet; Thence South along the arc of said curve a distance of 66.15 feet,
through a central angle of 2°01'37" and a chord which bears North 10°46'36"West a distance
of 66.15 feet to a point;
Said point also being The Point of Curvature of a Non -Tangent curve to the right having a
radius of 1869.86 feet; Thence South along the arc of said curve a distance of 20.00 feet,
through a central angle of 0°36'46" and a chord which bears
North 09°27'12" West a distance of 20.00 feet to the Southeast corner of said Lot 11;
Thence South 08'1Y56" East a distance of 60.11 feet to the TRUE POINT OF BEGINNING;
Thence South 78'18'18" West a distance of 34.57 feet to a point;
Thence South 29°55'14" West a distance of 4.02 feet to a point;
Thence North 89°09'06" East a distance of 36.99 feet to a point;
Thence North 06°26'39" West a distance of 10.01 feet to the TRUE POINT OF BEGINNING.
FOR THE PURPOSE OF CONSTRUCTING OR INSTALLING THEREON public facilities for
landscaping by the City of McCall or its agents or contractors. The aforesaid facility shall
remain in place as constructed or installed for its intended purpose and shall not be removed or
relocated by the Grantors, their heirs or assigns, without the prior approval of the City of McCall,
or its assigns.
The City of McCall, its agents or transferees, shall have the right to perform any
maintenance it may deem necessary or wish to exercise in connection with aforesaid facility
(including but not restricted thereto, the right to make necessary repairs, alterations, removals, or
replacements thereof).

Together with the right and privilege of ingress and egress to and from said property for
said purposes.
It is expressly intended that these burdens and restrictions shall run with the land and
shall bind the Grantors, and their assigns, forever.
