ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH THE HOUSING
AUTHORITY OF THE CITY OF JEFFERSON, MISSOURI, REGARDING SEWER
SERVICE DEPOSITS.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1. The Mayor and City Clerk are hereby authorized and directed to
execute an agreement with the Housing Authority of the City of Jefferson, Missouri.
Section 2. The agreement shall be substantially the same in form and content as
the agreement attached hereto as Exhibit 1.
Section 3. This Ordinance shall be in full force and effect from and after the date
of its passage and approval.

AGREEMENT
This Agreement, entered into t hi s _ _...9...,___ day of ___,~=-:=-:+=::::::__:::::...=-.~...--'' 20 13 , by and
between th e C ity of Jeffe rso n , a muni c ipal corporation, referred to he rein as the City, and the
Housing A uthority of th e City of J efferso n , M isso uri , a political subdivision of the State of
M i ssouri , referre d to herein as the Housing A uthority .
WITNESSETH:
WHEREAS, the City requires new acco unts to post a d e pos it for sewer services in o rde r to
protect itself from d efault on sewer pay m e nt ; a nd
WHEREAS , one of the Housing A uthority's purposes is to assist families , the el derly and
handi capped individuals of limited financial means with housing within J efferson City; and
WHEREAS the Housing Authority is willing to assist their tenants by indemnifying the
City as set o ut below fo r the sewer bill s for their ten ants, in or to relieve the need of their Tenants to
post a deposit for sewer serv ices; a nd
NOW , T HEREFORE, for the considerations he re in expressed, it is agreed by and between
the City and the Housing Authority as follows:
1. The C ity will not require persons moving into Housing A uthority p roperties to post a
d eposit before obtaining sewer service.
2. The Housing Authority agrees to hold ha rml ess and indemnify the C ity of Jefferson for up
to ninety d ays of unpaid sewer bill s for any Housing A utho rity te nant who fails to pay the ir
sewer bill within 30 days of receipt of noti ce fro m the City of Jefferso n . A copy of said
notice will also be sent to the Housing Authority at the same time.
3. If not sooner paid by the tenant , payments due from the Housing Authority shall be made to
the City within 30 days after receipt of written notice from the City that a Housing
Authority tenant is in arrears for his/her sewer bill.
4. This contract shall be for the period of one year beginning on or about March 1, 2013, and
terminating on February 28 1h 2014 unless sooner terminated as set out below. The
contract shall renew on the anniversary date of the contract on the same terms and
conditions unless one party notifies the other thirty (30) days prior to expiration of their
intent not to renew.
5. Either party may tenninate this agreement without cause upon ninety days written notice.
6. No amendments shall be made to this agreement except by written instrument signed by
each party.
7. This agreement shall be construed according to the laws of the state of Missouri.
In Witness Whereof, the parties have executed this Agreement the day and year first above
written and acknowledge receipt of one copy of the Contract.
