The regular meeting of the Planning Commission of the City of Temple City was called to order at 7:45 p.m. August 10, 1982, by Chairman Abraham. 2. PLEDGE OF ALLEGIANCE Commissioner Breazeal led the Pledge of Allegiance to the Flag. 3. ROLL CALL: Present: Commissioners Breazeal, Stacy, Abraham Absent: Commissioner Froehle Also present: City Attorney Martin, Planning Director Shaw and Senior Planner Peterson. Commissioner Froehle's absence was excused for cause. 4104. APPROVAL OF MINUTES: Meeting of July 27, 1982 The minutes were approved as written by roll call vote with Commissioner Breazeal abstaining. 5. PUBLIC HEARING: MODIFICATION OF CONDITIONAL USE PERMIT 71 -344 James R. Keese, Jr., Applicant for First Lutheran Church - Owner Site: 9123 East Broadway (R -1 Zone) Director Shaw said applicant is requesting modification of a conditional use permit to allow expansion of the existing elementary school by the addition of a portable classroom building. The classroom building will be located about 450 ft. north of Broadway and 64 ft. east of Noel. It will be a portable structure 24' x 60' and is intended to be used as kindergarten and day care facilities. He referred to the Plot Plan "A" on exhibit, and added that there will be a gate in the 10 ft. high chainlink fence which encloses the playing field and a concrete side- walk around the perimeter of the temporary classroom building for all - weather access. By law all fire department regulations must be met and will include exiting and fire protection requirements. The project is categorically exempt from EIR requirements, and staff recommends approval of the request as it meets the requirements for granting under Section 9203 of the Zoning Code. " " The Public Hearing was declared open. Mr. Ernest Roper, 9141 Wedgewood, asked if the baseball diamond would be moved as a result of the new portable structure. Mr. Jim Keese, Jr. 5635 Encinita, applicant, said the baseball diamond referred to is no longer there. The backstop will be moved to the far northeast corner of the playing field. Presently the subject area is a playing field and will remain so. The public hearing was closed, there being no one else to address the matter. Commissioner Breazeal said the request meets the requirements of Sec- tion 9203 of the Zoning Code in that the site for the proposed use is adequate in size, shape and topography, and has sufficient access to streets and highways, and finally, it will not have an adverse effect upon the use, enjoyment or valuation of adjacent property. He moved to grant the request with conditions imposed as proposed by the staff, and to adopt by title only the resolution granting same. Motion was seconded by Commissioner Stacy and carried. City Attorney Martin read title to Resolution No. 82- 1023PC, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING A MODIFICA- TION OF CONDITIONAL USE PERMIT IN CASE NO..71 -344. PLANNING COMMISSION MINUTES MEETING OF AUGUST 10, 1982 PAGE TWO • 6. PUBLIC HEARING: SITE PLAN REVIEW 82 -64 Donald F. Laughlin - Applicant for Jayco Acceptance Corp. Site: 4509 Temple City Boulevard (C -2 Zone) The Planning Director said applicant is 'requesting approval of a site plan to allow development of a two -story commercial office facility at the subject address. He described the exterior of the proposed building, and said there will be 20 parking spaces provided on the site via the alley to the north of the subject property. Staff reviewed the request and, pursuant to the California Environ- mental Quality Act of 1970, as amended, a Negative Declaration of Environmental Impact was filed stating that the proposed project will not have an adverse impact on the environment. Commissioner Stacy asked the condition of the alley, and whether it wasn't unusual for an office building to have access from an alley. Mr. Shaw said the original plan submitted by the applicant did not have this access, but in working with the staff it was determined that the present plan would make the best and most use of the property and still meet all City requirements. Mr. Stacy was in favor of re- quiring the applicant to upgrade the alley. The public hearing was declared open. Mr. Jim Harley, 314 Euclid Ave., Upland, speaking for the applicant, said they plan to use Temple City Blvd. for entrance and exit to the facility, not Lower Azusa, and,because the alley drains 6" for 150', they intend to relieve the water problem and repair the alleyway. He had no objections to a requirement to rework the alley for the portion that abuts his facility. Responding to Commissioner Breazeal's question, he said he does not plan to erect any signs on Lower Azusa indicating ingress and egress to the facility. Mr. John Ullman, 4505 Temple City Boulevard, asked how many offices were planned in the building, and would there be adequate parking for the personnel occupying the offices. He was told the parking was figured by the square footage of the facility, not by the number of offices. He also said that the building of this facility will dis- place parking for number of people employed at the plant across • the street (Temple City Blvd.). He asked whether there would be windows on the second floor, and which way would they face, and was told by the Chairman that the Planning Commission had no control over that as long as the number of windows met the requirements of the Building Department. Mr. Ullman felt the windows would cause an in- vasion of his privacy if located on the second floor, and was told Temple City has a permitted height of 35 ft. for structures in any zone, and that the office structure would be primarily be used in the daytime, and not on weekends. Mr. Ullman said his wife teaches oil painting, and students come to his home for lessons. There is already a shortage of parking in that area. Mr. Breazeal pointed out that the applicant is requesting approval of a legal and permitted use on the subject property, and Mr. Ullman's concern is that it will work a personal hardship on his wife because of her business. The City cannot penalize the applicant because of existing businesses having inadequate parking. The proposed structure and plan meets all park- ing requirements, is in conformance with the Zoning Code and the General Plan. There is no reason to deny the request. Mr. Harley, in rebuttal, said that three of the offices would be used by the plant across the street, so the people presently parking on the vacant site will be accommodated. • Mary Moehringer, 9575 Bisby Street, asked if the refrigerator trucks which presently park, and run their engines all night behind the plant on the east side of Temple City Boulevard, will be permitted to do so when the offices for that plant are located in the proposed facility. She was told they would not be permitted to do so. " " PLANNING COMMISSION MATES MEETING OF AUGUST 10, 1982 PAGE THREE Marjorie Ullman, 4505 Temple City Boulevard, asked if there was a wall separat- ing the facility from adjacent properties and was told a 6 ft. high wall would be required along the east and south sides. There being no one else to speak to the issue, the public hearing was closed. Commissioner Stacy moved to certify filing of the Negative Declaration of Environmental Impact, and to approve the site plan with additional conditions that the applicant shall improve that portion of the alley that abuts the proposed facility, and that the storage of trucks or trailers would be prohibited in the parking lot of the facility. Motion was seconded by Commissioner Breazeal and carried. 7. COMMUNICATIONS - There were none. 8. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK - No one came forward. 9. MATTERS FROM CITY OFFICIALS (a) Environmental Quality and Code Enforcement Report - 7/1 -30/82 The report was received, reviewed and filed. (b) Water Adequacy Report Article from the Temple City Times summarizing the East Pasadena Water Company's recent endeavors to resolve their problems was received, reviewed and filed. (c) Report on Rand Corporation Study Staff's summary and critique of the results of the Study, from the published articles in local newspapers, and from the Study in its entirety (copy of which is in the Department's library), were re- ceived, reviewed and filed. 10.
