HomeMy Public PortalAboutORD15103BILL NO. 2012 -158 SPONSORED BY COUNCILMAN Scrivner ORDINANCE NO. 1 5-10:5 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH COLE COUNTY SPECIAL SERVICES TO PROVIDE HANDI - WHEELS TRANSIT SERVICE TO THEIR CLIENTS. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and City Clerk are hereby authorized and directed to execute an agreement with Cole County Special Services of Jefferson City, Missouri. Section 2. The agreement shall be substantially the same in form and content as the agreement attached hereto as Exhibit 1. Section 3. This Ordinance shall be in full force and effect from and after the date of its passage and approval. Passed' J / ,AA /5 Approved: /142— Presiding Office Mayor ATTEST: APPROVED AS TO FORM: City Counselor CITY OF JEFFERSON GRANT AGREEMENT THIS AGREEMENT, made and entered into this 13 day of April, 2013, by and between Cole County Special Services (hereinafter referred to as "CCSS "), and the City of Jefferson, Missouri, a municipal corporation of the State of Missouri (hereinafter referred to as the "City "). WITNESSETH: WHEREAS, the City of Jefferson's Handi - Wheels Service (hereinafter "Handi - Wheels ") has requested from CCSS funds to operate in connection with its purpose and function of providing services and benefitting citizens who are disabled. NOW, THEREFORE, in consideration of the premises and of the mutual covenants and premises contained herein, it is agreed between the parties as follows: 1. Services To Be Performed. Handi - Wheels shall provide transportation which will benefit citizens who are developmentally disabled. 2. Description of Payment. In consideration of Handi - Wheel's performance, CCSS grants to the City the sum of Thirty Thousand Dollars ($30,000.00) for the fiscal year July 1, 2012 — June 30, 2013. This amount shall first be paid to the State of Missouri by CCSS on behalf of the City as its share of the Medicaid Partnership For Hope Waiver. The parties understand that paying the money to the Medicaid Partnership For Hope Waiver match the City will receive 100% reimbursement for its approved Medicaid rate. Any portion of said Thirty Thousand Dollars not paid to the State of MO for the Medicaid Partnership For Hope Waiver match shall be paid to the City directly. 3. Use of Funds. The City agrees to and understands that these funds are intended to help maintain the present level of service offered by Handiwheels and are not intended to replace existing city funds. 4. Monitoring. The City agrees to permit CCSS to monitor the services covered by this Agreement allowing CCSS to inspect public records, interview personnel and review expenditures and records. 5. Discrimination. The City agrees that it has adopted policies and practices to ensure that it will not discriminate either in employment or in the provision of services in violation of any applicable federal, state, county or municipal statutes or ordinances. 6. Termination. This contract may be terminated by either party by giving thirty (30) days written notice. 7. Liability. The parties mutually agree to the following: a. The City shall defend, indemnify and hold the CCSS Board harmless from and against all claims, losses and liabilities arising out of personal injuries, including death and damage to property which are caused by the City arising out of or in any way connected with this contract. CCSS shall defend, indemnify and hold the City harmless from and against all claims, losses, and liabilities arising out of personal injuries, including death and damage to property which are caused by CCSS arising out of or in any way connected with this contract. 8. Renewal. By consent of the parties, this agreement may be extended for four (4) additional one (1) year periods. Said agreement shall automatically renew on the same terms and conditions unless notice of cancelation is sent by one party, to the other, at least thirty days prior to the anniversary date of the agreement. 9. Illegal Immifration. Prior to commencement of the work: a. Contractor shall, by sworn affidavit and provision of documentation, affirm its enrollment and participation in a federal work authorization program with respect to the employees working in connection with the contracted services. b. Contractor shall sign an affidavit affirming that it does not knowingly employ any person who is an unauthorized alien in connection with the contracted services. c. If contractor is a sole proprietorship, partnership, or limited partnership, contractor shall provide proof of citizenship or lawful presence of the owner prior to issuance of the Notice to Proceed. 10. Notices. All notices required or permitted hereunder and required to be in writing may be given by first class mail addressed to the City, c/o City Clerk and c/o Director of Community Development, 320 East McCarty Street, Jefferson City, Missouri , 65101; and the Cole County Special Services Board, 1908 Boggs Creek Road, Jefferson City, Missouri, 65101 -5580.
