An Ordinance Granting T.E.Bennett,his Heirs,Executors,Adminstrators
and assigns,a 50 Year Right and Franchise to Construct, Maintain
and Operate an Electric Light and Power Plant Distributing System
in the Village of McCall,idaho,and to sell Electric Current and
Power in said Villages and Regulating and Limiting said Right and
Franchise.
Be it Ordained by the Chairman and Board of Trusteds of the Village
of McCall,Idahos
Section 1. There is hereby granted to T.E.Bennett,his heirs
Executors adml.nstrators and assigns,and right, privilege and
Franchiserto build,construct, equip,mauntain and operate a system
for the distribution and sale of electric current and electric
power in the Village Of McCall,Idaho,for a period of 30 years and
during saud period of time to sell electric current,light and power
to any and all persons,individuals and corporations within the ow
limits of said Village,all subject to the following conditions,viss
1 All poles,pole lines,electric light and power li nes,conduits
and other apparatus used and installed in said Village under this
franchise shall be built,erpected and maintained in the streets and
alleys in said Village,only where the location of the same may be
designated by order of the Board of Trustees of said Village,
intending hereby that salt Board of Trustees shall ever control
and designate the particular streets and alleys and the particular
places in said steeets and alleys where said poles,lines,conduits
or other apparatus shall be built or maintained.
2 The said T.E.Bennett,heirs, executors,adminstrators and
assigns agree and bind themselves as a condition of the granting;
of this franchise that they will at all times furnish electric
current at a voltage and amperage sufficient to operate and
maintain electric lamps and ordinary electric motors for demestic
use at their indicated light or power capacity-=.--except in cases
or periods of temporary plant failure from accident or other causes
that may not be prevented or averted by the exercise of proper
diligence in opOrating the said plant.
3 The said T.E.Bennett,his heirs, executors, adminatrators
and assigns agr'- , and bind themselves to furnish electric current
of the quality,anq quanity stipulated in the prec*ding section
of this franchise,for light and power purposes,to all its patrons
at a riate or charge that shall he reasonable and equitableand
approved by the Public Utilities Commission of the State of Idaho.
This franchise shall become null and void upon a continued failure
to comply with its provisions.
Section;:2 This Ordinance and Franchise shall be in effect from
the date of its passage,approval and publication.
