AN ORDINANCE RELATING TO VILLAGE OFFICERS: CREATING CERTAIN VILLAGE OFFICES: AND PRESCRIBING THE POWERS AND DUTIES OF VILLAGE OFFICERS. BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF TRUSTEES OF THE VILLAGE OF MCCALL: ARTICLE I. VILLAGE CLERK AND AUDITOR. Section 1. The Village Clerk shall be the keeper of the seal of the Village, and shall affix it to all instruments and papers which by law or ordinance are required to be attested by the seal of /4- 2' the Village. He shall have the 9ustody of and shall safely keep all records, documents, contracts, bonds, and all other papers and instruments belonging to said Village. It shall be his duty �, - to keep the original ordinances passed by the Board of Trustees _ and copy the same into a book to be kept by him for that purpose, It- He shall attach to each copy of an ordinance thus made in said Ordinance Book a certificate signed by him and 0440attested with the seal of the Village to the effect that the said copy is a true and correct copy of the Ordinance as passed. Section 2. It shall be the duty of the Village Clerk to attend all 7= meetings of the Board of trustees, keep true and accurate minutes ,�_0,r of their meetings and record the same in a Minute Book to be furnished by the Village. Heshall dram and countersign all warrants on the Village Treasurer, by order of the Board of Trustees, and . 40 " deliver the same to the proper parties when called for. Ole shall do and perform such other duties as may be enjoined upon him from )._ i ! time to time by ordinances or resolution of the Board of Trustees, He shall also make out and lay before the Board of Trustees a l complete and full statement of the receipts and expenditures and fiscal affairs of the Village, and cause the same to be publishe" COaj in the Official Newspaper of said Village at such times as l are required by law, or when ordered by the Board of Trustees l • 3. Section 3. Upon demand and payment of the same fees therefor as might be lawfully charged by a Recorder of a County in Idaho for similar services, the Village Clerk shall r` furnish any person applying therefor a certified copy of any record, ordinance, paper or document in his possession as such Clerk. All such fees shall be accounted for and paid to the Treasurer of the Village. Section 4. The Village Clerk shall be general purchasing agent for the Village and shall buy all such supplies and 1 ' materials for the Village as may be ordered by the Board of Trustees. Section 5. Tatocazttimpiatitukxfflual The Office of Village �/ Auditor is hereby created. 1" Section 6. The Village Clerk shall be Ex-Officio Village Auditor and as such Auditor shall be general accountant of said Village and shall keep an accurate account of all moneys received and paid out by said Village, and his accounts shall /-401 include an accurate debit and credit account with the Village Treasurer and with each other officer receiving, any fees or any other money for said Village. He shall keep an accurate) debit and credit account with each debtor or creditor of ilL45 said Village, and an official record of all demands on the Treasury allowed by the Village Board and warrants drawn b,/ him showing the number, date, amount, name of payee , on what account allowed, and out of what fund payable. Section 7. The Village Treasurer shall immediately notify o the Village Auditor of any moneys paid said Treasurer ) - 1/47 for said Village, and the same shall be by said Auditor ¢i charged to said Treasurer. 4. Section 8. All moneys paid to said Clerk or Auditor 1 4a 4 for said Village shall be by him paid to the Village Treas- urer on or before the first Tuesday of each month. ARTICLE kit. VILLAGE TREASURER. Section 1. The Village Treasurer shall in or before the first Tuesday in each month receive from each Village Officer who has collected any fees or other money belonging to said Village, all fees and moneys so collected by such officer, and shall /--/c 1 receipt such officer therefor and notify the Village Auditor of the payment of the same. The Treasurer shall keep a true and cor- rect account of all moneys received and paid out by him, showing from whom and on what account received, and to whom and on what ac- count paid out. Section 2. The Village Treasurer shall keep a separate account of each fund or appropriation and of the debits and credits be- longing thereto. He shall pay from the treasury such ampunts as he may be authorized to pay by warrabts duly signed by the Chairman and countersigned by the Village Clerk, provided the warrant shows on its face fro what the money is appropriated, to whom payable, and on what fund drawn, and not otherwise. Such warrant shall be his voucher therefor. ARTICLE . POLICE AND STREET DEPARTMENT. Section 1. There is hereby established a Police Department for the Village of McCall, which shall consist of a Chief of Police ., and such Assistant Police as may be appointed from time to time by the Board of Trustees. Section 2. Such police officers shall hold their appointments 1 gA1 during the fiscal year unless sooner removed by the Board of Trustees 5. Section 3. The Chief of Police shall be chief of the acting police and all assistant officers shall be subordinate to him and subject to his orders. It shall be his duty to cause the public peace to be preserved and to see that all laws and ordinances are enforced within the Village limits, and when any violation thereof shall come to his knowledge or be re- Je44)3 ported to him, he shall cause the requisite complaint to be made and see that all possible evidence is produced for the successful prosecution of offenders. Section 4. It shall be the duty of the assistant0 police to aid and assist the chief of police in the execution of his duties herein enjoined, both as Police, Street Overseer and License and Tax Collector, and to perform his duties when he is / - absent from the Villages,, and to perform his duties when he is absent from the Village, sick, or when ordered by him. ARTICLE STREET OVERSEER. Section 1. The office of Street Overseer of the Village of /-a/VC McCall is hereby created. Section 2. The Chief of Police shall be ex-officio V*llage /_fQ :. Street Overseer. Section 3. It shall be the duty of the Village Street Overseer under the direction of the Board of Trustees and the Committee 3. ro on Streets, Alleys, Bridges, and Public grounds! to superintend all public works and improvements that may be made from time to time on the streets and alleys of the Village. Section 4. It shall be the duty of the Village Street Overseer to find employment upon the streets of the Village for any person who may be required to labor upon the streets in default of paymen4 of judgment against them by the Village for breach of Ordinance thereof. 6. ARTICLE VZ. LICENSE AND TAX COLLECTOR. Section 1. The office of License and Tax Collector of the,l0 Village is hereby created. Section 2. The Chief of Police shall be Ex-Officio LicenseHb,L and Tax Collector. Section 3. It shall be the ditty of the License and Tax Collector to collect all dog, occupation, license and tther taxes levied,l�o assessed, laid or created by ordinance and by-law and all taxes and license provided by law to be oolledted by the Tillage or its officers, unless such law provides that such tax is to be collected by some other officer of said Village. Section 4. A sufficient number of receipts for all licenses and taxes shall be prepared or printed by or under the direction of the Village Auditor, signed by him in blank and delivered and charged to the License and Tax Collector at the proper time in each month, quarter or year to provide receipts for each and /_1001 every license and tax that may be levied 'laid by the Board of Trusteew. The license and Tax Collector shall countersign and issue one of said receipts to each person liable for such license or tax when the same is paid, and shall, on or before the first1litliin each and every month turn over to the Village Treasurer all money collected by him and take said Treasurer' s receipt therefor. Section 5. On the first Tuesday in each and every month, the License and Tax Collector and the Village Auditor shall have a settlement. The License and Tax Collector shall return to said Auditor all unissued and spoiled receipts together with the Village Treasurer' s receipts for money paid to him, and the Village Auditor shall give such License and Tax Collector credit for such returned receipts and Treasurer' s receipts and shall charge the Village Treasurer with the amount paid him by the License and Tax Collector as shown by said Treasurer' s receipts. . ARTICLE / vI'. ACCOUNTS OF OFFICERS. Section 1. It shall be the duty of each and every Village officer, on or before the first Tuesday in each and every month to turn into the Village Treasury all fines, fees and other moneys collected by him for said Village and to turn the Treas- urer' s receipts therefor over to the Auditor with a report of the fees, fines and moneys collected, together with the date of 1 . 4 cola ction and from whom and on what 014 account collected. Said written report, after being duly verified, shall be filed with said Auditor on or before the date set for each regular meeting of the Board of Trustees , and shall be brought to the attention of the Board for its approval. 7 ARTICLE =Ls. TIME ORDINANCE TAKES EFFECT. Section 1. This ordinance shall take effect upon its passage, approval and publication in the � .
