ORDINANCE VACATING A CERTAIN PORTION OF MCCALL AVENUE, A CERTAIN PORTION OF SPRUCE STREET, AND A CERTAIN PORTION OF FIR STREET, ALL IN THE F i/?S T ADDITION TO TIE TOWNSI`IE OF IIcCALL IN THE VILLAGE OF McCALL, IDAHO ; AND PROVIDING TIE METHOD OF ASCERTAINING DAMAGES SUSTAINED BY ANY CITIZEN OF SAID iiUNICIPALa ITY OR BY ANY OWNER OF PROPERTY THEREIN BY REASON OF SUCH VACATION AND FOR THE PAYMENT OF ANY DAMAGES THUS ASCERTAINED. BE IT ORDAINED BY THE CHAIRMIAN AND BOARD OF TRUSTEES OF TIE VILLAGE OF MC CALL, IDAHO: Section 1. That that portion of McCall Avenue from the Oregon Short Line Railroad right-of-way north to a point 120 feet south from the south boundary line of Hemlock Street , and that portion of Spruce Street from the Oregon Short Line Rail- road right-of-way west to the Alley running north and south .through Blocks 4 and 5, and that portion of Fir Street from the Oregon Short Line Railroad right-of-way west to the Alley runn- ing north and south through Block 3 and 4, all in the '=a:rs r Addition to the Townsite of McCall , in the Village of McCall, Idaho , be , and the same • are hereby vacated and closed, and that the same shall revert to the owners of the adjacent real pro- perty as provided by law. Section 2 . That any damages sustained by any citizen of said Village or by any owner of property therein by reason ofthe vacation of said portions of said avenue and Streets shall ___ ___be ascertained in the following manner: The person claiming damages shall, within thirty days after- the publication of this ordinance , file his verified claim, in writing, with the Village Clerk, setting forth the amount of damage claimed by him and the particular and specific grounds on which his claim is based. At the next regular meeting of the Village Board of Trustees said Board shall appoint an appraiser and said claimant shall appoint an appraiser, and the two appraisers thus chosen shall appoint a third one . The three appraisers, chosen as aforesaid, shall investigate such claim for damages and shall ascertain and determine the amount of damages, if any, sustained by claim- _ ant , and shall file a written report of their findings with the Village Clerk who shall present the same for payment to the Trustees of said Village at their next regular meeting. 7 Passed and approved this 5 day of .,lar-c 1934.
