A CAPITAL PROJECT AUTHORIZING RESOLUTION OF
THE VILLAGE COUNCIL OF THE VILLAGE OF KEY
BISCAYNEO FLORIDA, APPROVING THE PURCHASE OF
POLICE EQUIPMENT FROM FEDERAL EASTERN
INTERNATIONAL' LLC; PROVIDING FOR
AUTHORIZATION; PROVIDING FOR A \üAIVER OF
COMPETITIVE BIDDING PROCEDURES; PROVIDING
FOR IMPLEMENTATION; AND PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, pursuant to Section 3.07(b) of the Village of Key Biscayne ("Village")
Charter, the Village Council desires to authorize the expenditure of Village funds for a capital
project consisting of the purchase of protective arrnor ("Armor") and mobile rescue kits ("Rescue
Kits") (collectively, the "Equipment") for the Village's Police Department to continue patrolling
the Village for the safety of its residents and visitors and to facilitate the provision of day-to-day
operations of the Village's Police Department; and
WHEREAS, the type of purchase contemplated by the Village for the Armor has been
competitively bid by the State of Colorado and awarded by the State of Florida as Alternate
Contract Source No. 46151504-NASPO-17-ACS (the "State Contracts"); and
WHEREAS, in accordance with Section 2-86 of the Village Code of Ordinances
("Code"), the Village Council seeks to authorize the Village Manager to purchase the Armor
from Federal Eastern Intemational,LLC ("Vendor") consistent with the State Contracts and the
Vendor's Quote, attached hereto as "Exhibit "A," (the "Quote"); and
\ryHEREAS, pursuant to Section 2-85 of the Village Code, the Village Council finds that
it is impractical to apply the Village's competitive bidding procedures for the purchase of the
Rescue Kits and desires to waive competitive bidding requirements as the Vendor is the sole
source in the State of Florida capable of distributing the Rescue Kits described on the Quote,
which include technology that will assist the Police Department in responding to rescue
operations, and the pricing offered to the Village is competitive; and
WHEREAS, in accordance with Section 2-85 of the Village Code, the Village Council
seeks to authorize the Village Manager to purchase the Rescue Kits from the Vendor, consistent
with the Quote; and
\ilHEREAS, the Village Council finds that this Resolution is in the best interest and
welfare of the citizens of the Village.
NO\il, THEREFORE, BE IT RE,SOLVED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF KEY BISCAYNEO FLORIDA AS FOLLOWS:
Section 1. Recitals. That each of the above-stated recitals are hereby adopted,
confirmed, and incorporated herein.
Section 2. Approval. That the Village Council approves the purchase of the
Equipment.
Section 3. Authorization. That the Village Council hereby authorizes the Village
Manager to purchase the Equipment from the Vendor consistent with the terms and conditions of
the State Contracts and the Quote, in an amount not to exceed $63,000.
Section 4. Waivine of Competitive Biddine. That the Village Council hereby finds,
pursuant to Section 2-85 of the Village Code, that it is impractical to apply the competitive
bidding procedures of the Village Code for the purchase of the Rescue Kits, given that the
Vendor is the sole source capable of distributing the Rescue Kits listed on the Quote.
Section 5. Implementation. That the Village Council hereby authorizes the Village
Manager to execute any purchase order or required documentation for the purchases described in

this Resolution, subject to approval by the Village Attorney as to form and legality, and to take
any action which is reasonably necessary to implement the purpose of this Resolution.
Section 6. Effective Date. That this Resolution shall be effective immediately upon
adoption.

Federal Eastern lnternational (FEl) is the sole source provider of the Mobilize Rescue
Systems' Compact Rescue System with Law Enforcement Training designed for Law
Enforcement Agencies in the State of Florida. Mobilize Rescue Systems is the sole
proprietor of the algorithm included in the technology associate with each system. FEI
provides the Compact Rescue System in combination with the Law Enforcement
Training, demonstrations and other services to customers. The Compact Rescue
System with Law Enforcement Training is sold only as a direct transaction between FEI
and Florida Law Enforcement Agencies.
