The regular meeting of the Planning Commission of the City of Temple City was called to order at 7:30 p.m., September 27, 1983, by Chairman Breazeal. 2. Senior Planner Peterson led the Pledge of Allegiance to the Flag. 3. ROLL CALL: Present: Commissioners Abraham, Froehle, Stacy, Breazeal. Absent: Commissioner - Coolman. Also present: City Manager Koski, City Attorney Martin, Planning Director Shaw and Senior Planner Peterson. Commissioner Froehle moved to excuse Commissioner Coolman's absence for cause, seconded by Commissioner Stacy, and carried unanimously. 4. APPROVAL OF MINUTES - Meeting of September 13, 1983 Commissioner Froehle referred to p. 5, para. 5, wherein the owner of the business at 9514 Las Tunas Drive, a screen and shade store, stated that 25% of his sales are retail, and this should be shown in the minutes. There being no further corrections or additions to the minutes, Commissioner Froehle moved to approve them as cor- rected, seconded by Commissioner Abraham and the motion carried by roll call vote with Commissioner Stacy abstaining. 5. PUBLIC HEARING: CONDITIONAL USE PERMIT CASE 83 -691 Vincent Petralia - Applicant 9547 -9553 Garibaldi Avenue (R -3 Zone) Site: Request: Conditional Use Permit to develop a 9 -unit condominium project on the subject property. Chairman Breazeal said that this item is being postponed at the applicant's request, and will be renoticed. 6. PUBLIC HEARING: DETERMINATION OF EXISTENCE OF A PUBLIC NUISANCE 51102 Sereno Drive (Case No. 83 -101) Paul Burbank, Owner Site: 51102 Sereno Drive Director Shaw, in giving the staff report, said staff was contacted by the building inspector from the County Building Department regard- ing illegal construction (patio covers) located at the subject address. Field investigation revealed additional problems not related to the original complaint, including an inoperative vehicle, overgrown yard areas, and a deteriorated building with miscellaneous debris within it. Written requests for compliance have proven unsuccessful. Staff inspected the property on September 23rd and on this date and found minimal cleanup of the overgrown weeds. The inoperative vehicle, overgrown yard areas, and deteriorated building with miscellaneous debris still existed. He then passed to the Commissioners snapshots of the property. Responding to questions from the Commissioners Mr. Shaw said the inoperative vehicle is parked on the driveway easement by the house, that it could be stored in the garage, but the garage is used for storage and needs a garage door. The garage structure also needs tote painted. The patio structure needs building permit or removal. The public hearing was declared open. PLANNING COMMISSION MINUTES MEETING OF SEPTEMBER: 27,.1983 PAGE TWO Mr. Paul Burbank, owner of the property at 51102 Sereno Drive, said he would remove the illegal patio covers as he intends to install a pool at that location, and that he would remove the inoperative vehicle or store it in the garage, and will clean up the property but would like 45 days to accomplish all this work. The letters re- garding the condition of the property were apparently sent to his brother's address in San Gabriel as he and his brother are joint - tenant owners of the property. Mr. Paul Burbank stated he had lived there for 5 or 6 years. There are five rental units on the property There being no one else to speak to the issue the hearing was closed. The Commissioners, in discussion, agreed that 45 days should be granted to correct the objectionable conditions, that he should be required to cut back the vegetation and remove the debris from the property, install a two -car garage door and paint the garage. Commissioner Stacy moved to adopt a resolution determining the existence of a public nuisance at 51102 Sereno Drive, with conditions of . abatement for the objectionable items mentioned in Resolution 83- 1082PC as outlined by the Commissioners, with an abatement period of 45 days, and to adopt by title only the Resolution to this effect. Motion was seconded by Commissioner Froehle and carried unanimously. City Attorney Martin read title to Resolution No. 83- 1083PC, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY DETERMINING THE EXISTENCE OF A PUBLIC NUISANCE AT 51102 SERENO DRIVE AND RECOMMENDING ABATEMENT THEREOF. • 7. COMMUNICATIONS • 1 Mr. Shaw referred to information on Senate Bill No. 142 which was included in the Commissioners' packets as an information only item and that staff will keep the Commission apprised of future action on this bill which refers to on- premises advertising. 8. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK - No one came for- ward. 9. MATTERS FROM CITY OFFICIALS (a) Set Public Hearing to determine existence of a public nuisance for October 11, 1983 for: 4802 Agnes Avenue - Owner is Ernest Triplett of Fullerton, CA. The property has overgrown vegetation which is causing a hazard. It is a vacant lot. The condition is causing detriment to nearby property or property values and constitutes an unsightly appearance, the Planning Director stated. 9860 Howland Avenue - In addition to overgrown vegetation, there is an inoperative motor vehicle stored for an unreasonable period of time in the side yard area which causes depreciation of nearby property values. Commissioner Abraham moved to set both cases for public hearing for. October 11, 1983, and to adopt by title only the resolutions to this effect. Motion was seconded by Commissioner Froehle and carried. City Attorney Martin read title to Resolutions 1084PC and. 83- 1085PC, RESOLUTIONS OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY DECLARING ITS INTENT TO CONDUCT A PUBLIC HEARING TO DETERMINE THE EXISTENCE OF A PUBLIC NUISANCE FOR OCTOBER 11, 1983, FOR PROPERTIES AT 4802 AGNES AVENUE and 9860 HOWLAND AVENUE. PLANNING COMMISSION MINUTES MEETING OF SEPTEMBER 27, 1983 PAGE THREE (b) Report of Minor Zoning Modification Committee action of September 27, 1983 Mr. Shaw reported that the Minor Zoning Modification Committee, in a meeting held September 27, 1983, had considered a request to determine the front yard for a property at.10605 Freer Street. The Committee determined that the property fronts easterly, . which is towards the ingress- egress easement. Property owner is proposing a room addi- tion and was informed that, to construct the addition in its proposed location will require request and approval of a zone variance from the Planning Commission. Complete action of the meeting is contained, in the Committee's minutes on file in the Planning Department. (c) Determination as to Legality of a Dwelling Unit - 50672 Sereno Drive The Planning Director stated that an application for an electrical permit was requested by the owner of the property at 5067, 50671 and 5069 N. Sereno Drive for separate service for 5067 and 50672. The Building Dept. found no records of these addresses and forwarded the problem to the City . for review and approval prior to issuance of a permit. Staff reviewed the building records and found no permits for the initial construction. Miscellaneous permits are on record for 5069 N. Sereno, but no permits 0 affecting the structural alteration of the structure. The 1961 aerial . photograph shows the units as existing. An on -site inspection reveals that the units were constructed in the late 1940's or early 1950's. An adjacent neighbor indicated that the two units in the rear, (5.0.67 and 50672) =were constructed first and the unit in the front (5069) was con- structed at a later date. She indicated that there had always been three units:, on the property. The Commissioners were in agreement that, with the facts presented by staff, the units were legal. Commissioner Stacy made a motion to, declare" the dwelling units at 5067, 50672 and 5069 Sereno Drive legal dwelling units.. Motion was seconded by Commissioner Abraham and carried unanimously. 10.
