HomeMy Public PortalAboutOrd. 98 - Regulating Use and Fixing Rates of Water & Sewer1 <17 11 f OORDINANCE NO. 91 r AN ORDINANCE RELATING TO AND REGULATING THE USE OF THE WATER AND SEWER SYSTEMS OF THE VILLAGE OF MCCALL , IDAHO; FIXING THE RATES TO BE CHARGED FOR THE USE OF WATER; PROVIDING FOR THE PAYMENT AND COLLECTION OF WATER RENTALS; FIXING THE FEES FOR AND REGULATING CONNECTIONS WITH SAID SYSTEMS ; PRO- VIDING A PENALTY FOR THE VIOLATION OF ANY OF THE TERMS AND - CONDITIONS OF THIS ORDINANCE; AND REPEALING ORDINANCES 66 and 86 AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. Be it Ordained by the Chairman and Board of Trustees of the Village of McCall , Idaho: Section 1. That the Village of McCall , Idaho, shall sell water from its water system to the inhabitants of said Village for domestic. and irrigation purposes on the terms and conditions in this ordinance set forth. Section 2. All connections to and with the water mains of the Village of McCall shall be through water meters, and the Omonthly meter rates for the use .of water shall be as follows : Minimum charge for 3000 gallons or less --$1.75. All over 3000 gallons at the rate of 10V per " 1000. gallons or a fraction thereof. Section 3. The water rental shall be paid monthly on the 1st day of each month following the use of the water. Section 4. If two or more occupants in any building or on any premises use water from the same tap or thru the same meter, each occupant shall be charged the minimum rate, and the minimum number of gallons shall be multiplied by the number of occupants before any user shall be entitled to the reduction in rate for any additional number of gallons over and above such product of the minimum. Section 5. The Village Clerk shall have the power and it shall be his duty to collect all water rentals and give receipts therefor, and if any water rental is not paid within ten days from the due date he shall shut off the water from the premises of such delinquent user, and before turning the water on again • shall charge and collect the sum of $2.50 as a connecting charge. " f ,41` Section 6. No connection with or to the Village water main shall be made , and no water shall be introduced into any connection heretofore or hereafter made therewtih, unless a permit has been first issued by the Village Clerk on the application of the owner of the premises or his duly author- ized agent, which application shall contain a full , true and accurate statement of the size of the connection, the manner of connecting, the point at which the connection is to be made and a description of all the premises with which such connection is to be made, together .with the full name or names of all the owners thereof, and such further facts as may be useful in the management of said system; and such application shall contain a full , true and accurate statement of the approximate quantity and the uses and purposes for which such water is being obtain- ed, and an agreement on the part of the owner or owners to conform to all the rules and regulations provided for said water works , and that the charges therefor, as well as for the use of all the water, shall be a lien upon the premises upon which said water is used, and with which said connections are made, as a condition for the use of said water; and if said application is made by an agent, said agent shall deposit with the Village Clerk his written authority from the owner or owners of said premises , authorizing said agent to make said application. Section 7. At the time of issuing said permit the Village Clerk shall charge and collect from the applicant for the costs of the tap, meter and installation of meter, as follows : r"", For a 3/4 inch meter the sum of 020.00 For a 1 inch meter the sum of $25.00 For a 1i inch meter the sum of 030.00 For a 12 inch meter the sum of $40.00 For a 2 inch meter the sum of $50.00 Section 8. It shall be unlawful for any person, firm or corporation using water from the Village water system for sprinkling or irrigation purposes to use water for such purposes during a fire, and all such consumers of water shall immediately shut off the water being used for such purposes when the fire alarm is apounded, and shall not turn it on again until the fire department has ceased using water for fire extinguishing purposes. Section 9 . All users of water from the Village water system shall have the free use of the Village sewer system, provided, that no person, firm or corporation shall connect to or with said sewer system without first obtaining permiss- ion from the Village Clerk. Section 10. The Village Clerk shall charge and collect a fee of $2.00 for each permit to connect with said sewer system. Section 11. Every person, firm or corporation making a connection to or with said sewer system shall have said connection and the sewer line running to the main sewer inspected by the Village Watermaster before covering the same , and the said Village Watermaster shall inspect said connection and line and require the same to be installed in a proper and workmanlike manner. Section 12. It shall be unlawful for any person to dig up, open up, break, cup, injure or destroy said sewer system or any part thereof, or to place anything in said sewer that may plug up or stop the flow of sewerage through said sewer system, or any part thereof. Section 13. All money collected under and pursuant to this ordinance by the Village Clerk shall be paid by him to the Village Treasurer who shall credit the same to the water and sewer fund. (% Section 14. Any person, firm or corporation violating this ordinance or any part hereof shall be guilty of a middemeanor and upon conviction shall be punished by a fine of not less than $5.00 nor more than $100.00, together with costs of pro- secution, and in case of failure to pay such fine and costs, or any portion thereof, shall be confined in the Village Jail for a period of time equal to one day for each $1.50 of such unpaid fine and costs. Section 15. Ordinances Nos. 66 and 86 and all other ordinances and parts of ordinances in conflict herewith shall be and the same are hereby repealed. Section 16.
