HomeMy Public PortalAboutOrd. 105 - Prevention of FireI . u,./<, Viti : :: IX- PI ORDINANCE'NO. , 105 AN ORDINANCE FOR THE PREVENTION OF FIRES IN THE VILLAGE OF MCCALL; ' (7) PRESCRIBING INNER FIRE LIMITS WITHIN WHICH NO BUILDING SHALL BE • BROUGHT, MOVED, BUILT, ERECTED OR CONSTRUCTED EXCEPT OF STONE, BRICK OR OTHER INCOMBUSTIBLE MATERIAL WITH FIREPROOF ROOF; PROVID- ING THAT NO PERSON SHALL USE, HAVE OR MAINTAIN ANY STOVEPIPE PASS-- ING THROUGH A WALL, DOOR, WINDOW, FLOOR, CEILING OR ROOF OF ANY BUILDING OR PRIVY WITHIN THE SAID INNER FIRE LIMITS; PRESCRIBING c OUTER FIRE LIMITS; MAKING IT UNLAWFUL TO ERECT OR MOVE ANY BUILDING INTO THE FIRE LIMITS, EITHER INNER OR OUTER, WITHOUT HAVING FIRST OBTAINED A PERMIT TO DO SO; PRESCRIBING THE MANNER OF OBTAINING SUCH I PERMITS ; DEFINING THE TERM "BUILDING" AS USED HEREIN; PROVIDING TIMES, PLACES AND MANNER OF BURNING TRASH AND WASTE WITHIN SAID FIRE LIMITS; PROVIDING THAT IT SHALL BE AN OFFENSE FOR ANY PERSON TO CARELESSLY OR NEGLIGENTLY START ANY FIRE, OR PERMIT ANY FIRE TO START IN ANY WOOD, LUMBER, SIDEWALK, HAY, PRIVY OR BUILDING WITHIN THE SAID FIRE LIMITS; AND PROVIDING PENALTIES FOR THE VIOLATION HEREOF. Be It Ordained .13.z The Chairman and Board of Trustees of The Village of McCall : Section 1. INNER VIRE LIMITS. All that portion of McCall em- braced within the following limits shall be known as the . "inner fire limits" of McCall, to-wit: All of Block One and Two of the Original Townsite of the Village of McCall; all of Block One and Two of _the Second Addition totthe Townsite of the Villaa°.e of McCll; and all 0of Lots number One to Eleven, inclusive,of Block One in the First Addition to the Townsite of the Village of McCall , Valley County, State of Idaho. Section II. It shall be unlawful to enlarge , construct , build or erect any building within said inner fire limits except the same have outer and party walls of brick, stone or other incombustible material and a roof of metal , slate , tile , brick, concrete , or other fireproof composition. Provided that for the purposes of . this Ordinance solid wooden walls constructed of squared timbers , not less than six ( 6) inches in thickness , with all exposed sur- • faces stuccoed, shall be construed to be of incombustible material. Section III . No building within said inner fire limits shall be enlarged or added to or be wholly or partly taken down and rebuilt, except such enlargement, addition or new building or part of build- ing have outer and party walls of brick, stone or other incombus- tible material and a roof of metal, slate , tile, brick, concrete or other fire proof composition; and no building of wood or other combustible outer or party walls or with a roof of other than fire proof material shall be moved into said inner fire limits or be moved from one place to another therein. Provided that for the purposes of this Ordinance solid wooden walls constructed of squared timbers , not less than six ( 6) inches in thickness , with all ex- posed surfaces stuccoed, shall be construed to be of incombustible mat er tal. Section IV. In case any building within said inner fire limits n - shall be injured by fire, action of the elements , act of God or otherwise to the extent of half its value or more , it shall not be rebuilt with wood, shingles or other combustible material, but, if rebuilt or repaired, it must comply with the requirements of Section II hereof, i - Section V. Any building within said inner fire limits , re- paried, altered, constructed, built, rebuilt , erected or moved contrary to the provisions of this ordinance, is hereby declared a nuisance, and, upon conviction, the owner thereof shall be fined in any sum not exceeding fifty ( 50) dollars , together with the costs of prosecution, for each twenty-four hours such building is allowed to remain within said inner fire limits after being notified by the Chairman of the Board of Trustees of the said Village to take down and remove the same. Section VI . It shall be unlawful for any person to use , have or maintain any stovepipe passing through a wall , door, window, floor, ceiling or roof of any building or privy within said inner fire limits , and any such stovepipe is hereby declared a nuisance. Any person, either owner, oc- cupant or user of any building or privy who shall use, have or maintain any stovepipe passing through a wall , door, window, floor, ceiling or roof of such building or privy within said inner fire limits shall , upon conviction thereof, be fined in any sum not exceeding fifty ( 50 ) dollars to- gether with the costs of prosecution, for every twenty- four hours he shall use , have or maintain the same after - having been notified by the Chairman of the Board of Trustees of the said Village to cease using, having, or maintaining such stovepipe. Section VII . OUTER FIRE LIMITS. All that portion within the incorporated limits of the Village of McCall not heretofore designated as the "inner fire limits" of McCall shall be known as the "outer fire limits" of McCall. Section VIII . BUILDING PER!-"ITS. It shall be unlawful for any person or persons, firm or corporation, to erect , enlarge, build, construct, add to or rebuild any building or construct any building or structure within the fire limits of McCall, either inner limits or outer, without having applied for and obtained a permit so to do from the Chairman of the Board of Trustees. Application for a permit from the Chairman of the Board of Trustees shall state the exact and correct site upon which said building or structure is to be erected, the materials and dimensions , and the estimated cost and the estimated time to be occupied in the building, erecting or constructing the said building. Section IX. APPEAL FROM DECISION. Whenever any person or persons , firm or corporation shall feel aggrieved at the action of the Chairman of the Board of Trustees, either at his refusal of a building permit, or by reason of any ruling, order or regu- lation in connection with the fire ordinance of McCall , such person, firm or corporation shall have the right of appeal from such decision, order, ruling or regulation to the Board of Trustees of McCall , and the decision of said Board shall be final. Section X. The term "buildings" as used thruout this ordinance shall include any and all buildings and structures of any kind, name and nature, r , except privies. Section XI . For every building permit issued under this ordinance the Chairman shall collect from the person, firm or corporation to whom it is issued the sum of one (1 ) dollar which said fee or sum the said Chairman shall immediately deposit with the Village Treasurer. Section XII. Nothing herein contained shall prevent any alteration, addition to, repair, rebuilding or building of any building which shall have been . commenced and on which work is being done in good faith at the time this ordinance becomes effective. Section XIII . No inflammable trash or waste shall be thrown, or be allowed to accumulate, in any street , alley, lot or building in the fire limits of McCall, but persons having such trash or waste shall either haul the same out of the said fire limits , or burn the same therein on days when the wind is not blowing and at a distance of not less than twelve feet from any sidewalk, woodpile , lumber pile, fence, building or privy. The person so burning trash or waste shall constantly watch the same until such fire is extinguished and keep the same from spreading. Section XIV. Any person who shall by any act or omission of his carelessly or negligently fire or ignite any wood, lumber , sidealk, fence, hay, building or privy within said fire limits shall, upon conviction thereof, be fined in any sum not over one hundred (100 ) dollars together with the costs of prosecution. Section XV. Any person, either owner, agent, contractor or workman , who shall repair , alter , enlarge, construct , build, rebuild, erect or move any building contrary to the provisions hereof, or cause ttie same to be done, shall he guilty of a violation of this ordinance, and, upon conviction thereof, shall be fined in any sum not less than twenty-five (25) dollars and not more -than one hundred (100) dollars together with the costs of prosecution. The prosecution, conviction or fining of either owner, agent, contractor, or workman here- under shall not interfere with or prevent the prosecution, conviction or fining of either, any or all other parties con- nected with the same violation hereof. Section XVI . Upon default of any person convicted under any section of this ordinance to pay the fine and costs imposed, or any part thereof , such person shall be committed to the County Jail for a period of time equal to one day for each one dollar and fifty cents of such unpaid fine and costs.
