AN ORDINANCE RELATING TO AND REGULATING AMU3EMENNT
DEVICES OPERATED IN THE VILLAGE OF McCALL REQUIRING A LICENSE
THEREFOR, AND PROVIDING PENALTIES FOR VIOLATION THEREOF.
BE IT ORDAINED By the Chairman and Board of Trustees
of the Village of McCall:
Section 1. That it shall be unlawful for any person,
firm or corporation to possess, sell, lease, rent, license or
permit the use of, or control, place, maintain or to permit the
operation of, upon premises or at any place under his or its
control within the Village of McCall, any game or amusement
device, or machine, the playing of which requires the payment
of money, or other thing of value, or requires the deposit
therein of any coin or thing, and in the playing of which the
element of skill predominates, unless or until the said machine
or device and the distributor thereof shall be licensed as here-
inafter provided.
Section 2. Any person, firm or corporation engaged .
in the business of selling, leasing, renting, licensing or' , 010, 0' `r
otherwise permitting the use to others of any machine or de-e)s►
vice mentioned in Section 1 of this ordinance shall be known
as a distributor who shall, prior to engaging and while en-
gaged therein in the Village of McCall, pay to said Village of
McCall a license fee of Two Hundred Fifty 4250.00) Dollars in
lawful money of the United States of America for each calendar
year, payable in advance, and obtain a license therefor, and
shall further pay to the Village of McCall, for each machine
or device intended by him or it to be distributed and prior
to the distribution thereof, and while the same is in distribu-
tion, a license fee of Five ( 5.00) Dollars per month in lawful
money of the United States of America, payable in advance, and
obtain a license therefor. It is further provided that there shall
only be one distributors license issued by said Village of McCall
for each two thousand five hundred (2, 500) inhabitants residing
in said village according to the latest official census,
Section 3. All licenses issued under the provisions
of this ordinance shall be issued by the Village Clerk upon the
payment of the fees herein required to be paid, providing the
Village Clerk shall issue no license to any distributor except
upon the specific instructions from the Board of Trustees so to
do and upon the payment of the license fee so required. The
Village Clerk shall prepare such forms as may be required for
such licenses, which forms may be used as evidence of the pay-
ment of the license fees herein required, and shall keep com-
plete records of all monies received therefor and all licenses
issued,
Section 4. No person under the age of eighteen (18)
years shall be permitted to play or operate such amusement de-
vices.
Section 5. No license shall be issued for any game,
table, machine, or any other article, device or apparatus which
is prohibited by the statutes of the State of Idaho, and this
ordinance shall not be construed to legalize any device, machine
or game which is defined to be illegal by the statutes of the
State of Idaho.
Section 6. Any person, firm or corporation violating
any of the provisions of this ordinance, upon conviction there-
of, shall be punished by a fine in any sum not to exceed �-
Hundred ( W00000) Dollars, or by imprisonment in the Village
Jail for a period not to exceed thirty (30) days, or by both
such fine and imprisonment,
Section 7e All licenses issued pursuant to this
ordinance shall be subject to revocation by the Board of Trustees
for violation of any of the terms or provisions of this ordinance.
4 . Section 8, This ordinance shall be in force and take
effect within days after its passage and approval,
and the Village Clerk shall cause this ordinance to be published
once in a newspaper published in the Village of McCall within
seven (7) days of the passage and approval hereof.
