HomeMy Public PortalAboutRES-CC-1998-03CITY OF MOAB RESOLUTION NO. 03-98 A resolution establishing a severance pay and benefits policy for employees holding statutory appointments by the Mayor of the City of Moab. WHEREAS, the City of Moab has no existing policy as to severance pay for employees holding statutory appointment positions; and WHEREAS, in the absence of any such policy there is a risk of arbitrary or inconsistent awards to individual employees; and WHEREAS, it is the intent of the governing body to reward statutory appointees for quality service and exclude from severance benefits those appointees who are terminated for cause. NOW THEREFORE, the City of Moab, upon action of the governing body, resolves as follows: 1. Employees holding statutory appointments who lose re- appointment or are otherwise terminated without cause shall be entitled to severance pay pursuant to the following schedule: Years of Service Benefit less than one year no benefit; one to four years two weeks; four to six years four weeks; more than six years six weeks. a. Benefits accrue as of the anniversary of the employee's appointment and in no instance shall there be any proration of benefits to include any length of service during any year or fraction of a year, other than as expressly set forth above. b. Appointees who resign their employment or are terminated for cause shall not be eligible for severance pursuant to this resolution. c. Benefits shall be calculated based upon the appointee's gross rate of pay as of the date of termination. -1- 3. Statutory appointees subject to this resolution shall additionally be entitled to receive employee health insurance benefits, to the extent paid by the City during the appointee's employment, for a period of time calculated by the same method established in Section One herein, for a period not to exceed six weeks. 4. A11 statutory appointees shall remain as "at -will" employees serving at the pleasure of the Mayor and the governing body. Nothing in this resolution shall be construed to repeal or modify that status. 5. The governing body may modify or rescind this resolution in the future based upon fiscal or other considerations. Benefits shall accrue as provided herein until such time as this resolution is rescinded or modified. 6. This resolution shall take effect immediately upon passage.
