The City's consulting engineer did a routine erosion and sedimentation control inspection at 117
Eagles Nest / Tina Gann on October 24, 2011. Downer Davis' comments are below and attached are
two photographs. Your client was extremely cooperative with the City in resolving the deficiencies.
Compliance with erosion control measures and protection of state waters is mandatory. Please be
aware that non - compliance at a future project within the City of Tybee Island by Architectural Pools
and Spas will not be tolerated. I strongly encourage you to seek training from the Georgia Soil and
Water Conservation Commission (GSWCC). Information on education and certification is available at

to be of no value for protection of state waters. 25
1) The Sediment Barrier (Sdl) appears to be installed in and not upstream of the 25' state waters buffer.
2) The Sediment Barrier (Shc) does is not properly installed. It is not trenched in anywhere.
3) The Sediment Barrier (Shc) was installed only on the south side. The downstream west end has no BMP's to
control sediment from entering state waters.
I met with the residents and discussed this matter. It is my understanding that Tina is going to your office in the
morning to obtain one more copy of the permit drawings. As the Contractor has not exhibited and ability to
install and maintain BMP's properly, Tina advised she would take control of this.

At this point, with the pool and deck installed and completion nearing, Tina and I agreed to the following:
a) Install a Sediment Barrier located upstream of the 25' buffer.
b) After establishing proper grading elevations, provide a mulch cover over all disturbed areas in the 25' buffer.
c) Provide a mulch cover over all remaining disturbed areas.
d) Commence with establishment of permanent grassing within 6 months.
This appears to be the most expedient method of bringing the site into compliance. As I will not be available
after mid afternoon Wednesday afternoon until Thursday morning, I will discuss with you and Steele the
follow -up inspection schedule tomorrow morning.

All swimming pools, spas, and saunas shall comply with the following requirements: t ..1.13
(A) Application for a permit to construct a swimming pool, spa, or sauna must be submitted to the building official. The structural plans must be approved by the
building official prior to the issuance of a permit and the beginning of construction and/or excavation. A drainage plan prepared by a registered professional
engineer will be required unless the city staff determines that due to the size, method of construction, location, or other characteristics of the proposed swimming
pool, spa, or sauna, a drainage plan is unnecessary under the circumstances.
(B) Swimming pools, spas, and saunas and supporting electrical and mechanical equipment may be located in either the side or rear yard and shall be at least five feet
from the property line.
(C) Swimming pool, spa, and sauna construction must meet all requirements of the codes adopted by the City of Tybee Island.
(D) Once a swimming pool, spa, or sauna and its accessories have passed a final inspection it shall be a violation of this ordinance to remove or alter any of the
equipment that is required by: the International Residential Code — Appendix G, the International Building Code — Section 3109, the National Electrical Code, and
the Georgia State Amendments. Failure to maintain the safety related and/or electrical equipment in good and working order shall constitute a violation of this
ordinance.
(E) No swimming pools, spas, or saunas shall be placed across, on, or beneath any utility easements nor shall any utility easement be granted which bisects a
swimming pool, nor be located within five (5) feet of any marsh buffers as delineated by the Georgia Department of Natural Resources.
(F) When a swimming pool, its deck, or other accessory to a swimming pool is proposed for construction on a site that has already been improved, the swimming pool
plans and permit application will be reviewed by the City Engineer.
(a) If there is an approved drainage plan for the site the City Engineer will review the plans for the swimming pool, deck and accessory structure to ensure that
the proposed improvements will not materially affect the drainage of the site. If they will materially affect the drainage of the site the applicant will have to
have a drainage plan prepared by a design professional before a permit for the swimming pool, deck or accessory will be issued.
(b) If the site was improved without a drainage plan, the City Engineer will review the pool plans and permit application to ensure that the swimming pool, deck
or accessory structure will not increase the amount of run -off leaving the site.
(G) Any permit for a swimming pool is required to contain a soil and erosion plan for the proposed site prior to the issuance of a permit and commencement of any
construction related activity. (Code as amended 10/28/2010)

SOIL EROSION /STORM -WATER CONTROL PLAN
117 EAGLES NEST DRIVE

Proposed work shall be completed at 117 Eagles Nest Drive, Lot 13 Fort Ward, Tybee
Island, Georgia in order to accommodate the installation of an in- ground fiberglass pool
on the side yard adjacent to 119 Eagles Nest Drive. Work to be performed shall be in
compliance with DNR as well as City of Tybee regulations.
Visual site inspection and consultation with City Engineer, suggests there is minimal risk
of soil erosion and disruption of current storm -water drainage patterns associated with
117 Eagles Nest Drive, Tybee Island Georgia.
Work shall begin on or about September 1, 2011 and will be completed no later than
December 30, 2011. No construction entrance shall be required. Contractor shall use the
existing concrete driveway in order to access the property.
117 Eagles Nest Drive is a previously improved lot. The existing topography of the lot is
as follows:
High ground exists in the front and rear of the property. The proposed pool site it located
in the middle or "Valley" of the property. Pool shall be placed in- ground approximately
2 to 3 feet above the current grade as to allow rainwater to flow around the pool rather
than into the pool. This should not alter the current drainage of the property. Great care
shall be taken to ensure that any minimal grading of the lot will not change the current
drainage patterns of the property and all storm -water runoff will continue to flow towards
the mosquito ditch.
In order to protect the adjacent lot, 119 Eagles Nest Drive, from any potential soil erosion
or runoff, a temporary silt fence shall be erected along the property line. A buffer zone of
5 feet between the silt fence and work site shall be maintained so that adjacent lot will not
be disturbed. After construction is complete, a small berm approximately 3' feet high
will be created along the property line in order to ensure that future runoff will not impact
the neighboring property. Berm will be constructed with soil excavated from the pool
site and landscaped with native vegetation. Contractor will remove any soil remaining
from the pool excavation from the work site.

Many of the issues related to permitting a swimming pool at 117 Eagles Nest Drive have been
resolved. An issue related to the marsh buffer remains open to interpretation. Section 3- 190(E) of the
swimming pool ordinance (see the bottom of the attached "pool appl) states, "No swimming
pools...shall be...located within 5 feet of any marsh buffers as delineated by the DNR." As shown on
the attached site plan" pavers for the proposed pool would be within 5 feet of the buffer. The
actual swimming pool would be 5 -feet off the buffer. Rather than concrete decking, these are
porous pavers and they would not be structurally connected to the pool. Would these porous pavers
in the buffer violate the intent of Section 3- 190(E)?

diagram must show the DNR marshline and the 25 -foot DNR buffer. It is our understanding that the property
owner has a more recent survey that includes this required information. To avoid unnecessary fees the plan
review stopped when it was discovered that this information was not provided. Plan review will resume when
the requested information has been provided.

SOIL EROSION /STORM -WATER CONTROL PLAN
117 EAGLES NEST DRIVE

Proposed work shall be completed at 117 Eagles Nest Drive, Lot 13 Fort Ward, Tybee
Island, Georgia in order to accommodate the installation of an in- ground fiberglass pool
on the side yard adjacent to 119 Eagles Nest Drive. Work to be performed shall be in
compliance with DNR as well as City of Tybee regulations.
Visual site inspection and consultation with City Engineer, suggests there is minimal risk
of soil erosion and disruption of current storm -water drainage patterns associated with
117 Eagles Nest Drive, Tybee Island Georgia.
Work shall begin on or about September 1, 2011 and will be completed no later than
December 30, 2011. No construction entrance shall be required. Contractor shall use the
existing concrete driveway in order to access the property.
117 Eagles Nest Drive is a previously improved lot. The existing topography of the lot is
as follows:
High ground exists in the front and rear of the property. The proposed pool site it located
in the middle or "Valley" of the property. Pool shall be placed in- ground approximately
2 to 3 feet above the current grade as to allow rainwater to flow around the pool rather
than into the pool. This should not alter the current drainage of the property. Great care
shall be taken to ensure that any minimal grading of the lot will not change the current
drainage patterns of the property and all storm -water runoff will continue to flow towards
the mosquito ditch.
In order to protect the adjacent lot, 119 Eagles Nest Drive, from any potential soil erosion
or runoff, a temporary silt fence shall be erected along the property line. A buffer zone of
5 feet between the silt fence and work site shall be maintained so that adjacent lot will not
be disturbed. After construction is complete, a small berm approximately 3' feet high
will be created along the property line in order to ensure that future runoff will not impact
the neighboring property. Berm will be constructed with soil excavated from the pool
site and landscaped with native vegetation. Contractor will remove any soil remaining
from the pool excavation from the work site.
