CALL TO ORDER - Mayor Susman called the meeting to order at 6:04 p.m. 2. ROLL CALL: Councilmembers Owens, Florian, Vice Mayor Threshie and Mayor Susman. Councilmember Ingalls noted as absent. PLEDGE OF ALLEGIANCE - Heidi Scoble 4. PUBLIC COMMENT Denny Dickinson~ Truckee resident, invited the residents of the Town of Truckee to the Airport Noise Advisory Committee Meeting scheduled for March 23, 2004 at 6:00pm in the Town Council Chambers. He also expressed his desire to see a representative from the Town of Truckee attend the meeting. 5. PRESENTATIONS 5.t Proclamation of April 2004 as "Child Abuse Prevention Month", "Sexual Assault Awarenes~ Month" 'and April 18-24, 2004 a~ "National Crime Victims' Right~ Week." Mayor Susman stated Nevada County Victims Witness Assistance Center along with other County and Community agencies, are working to bdng awareness to the trauma that victims experience as a result of their victimization. In addition to holding their 6m Annual Candlelight Vigil on the evening of April 22, 2004 on the steps of the Nevada City Courthouse, the coalition is planning their 1't Annual Victims Memorial Luncheon on April 19~, 2004 at the Miner's Foundry in Nevada City. Town of Truckee March 1 $, 20O4 Regular Page 1 Mayor Susman wished a "Happy MaYoral Birthday" to Cleo Mayor and a happy 16~ birthday to Laura Lashbrook, daughter of Community Development Director, Tony Lashbrook. 6. CONSENT CALENDAR It was moved by Councilmember Florian and seconded by Councilmember Owens to approve the following consent calendar. The motion passed 4-0 with Councilmember Ingalls absent. 6.1 ApProved Minutes March 3e and 4~, 2004. 6.2 Adopted Ordinance 2004-02 amending Municipal Code Title 10 regarding Disabled Persons Parking and waive the second reading. 6.3 Adopted Resolution No. 2004-07 Supporting Meaningful Workers Compensation Reform in California. 6.4 Authorized the Public Works Director/Town Engineer to purchase one (1) Ford F350 Crew Cab from a vendor approved on the State of California Vehicle bid documents. 7. PUBLIC HEARINGS 7.1 Council conducted a public hetlring and adopted Re~olution 2004-08 a~Drovina Ar~l)licafion No. 01-0401EXT-ABN (Truckee Townhomes) South Shore Capital, Owner/Applicant, inclusive of 31 units ? to be affordable, armrovina modifications to Application No. 01-040, aS set forth in Exhibit"A" of the Resolution, rescindin, and voidin, Council Resolution No. 2001-43, and edor~tin~ the findimas in sur~P0rt of the project a~ set forth in Exhibit "B" of the Resolution. Heidi Scoble, Associate Planner, stated that Bob MacKay and Tom Castenaida of South Shore Capital request a two (2) year time extension for the construction of the Townhomes and an amendment to the previously approved Truckee Townhome Project to: 1. Reduce the total number of constructed units from 31 to 30; 2. Reduce the total number of the affordable housing units from 7 to 6; 3. Reduce the total number of the parking spaces from 78 to 75; 4. Allow for a dead-end road configuration for a traffic turnaround point at the end of East Jibboom Street; 5. Allow for of[site pedestrian improvements; 6.. Waive the traffic impact fee requirement; 7. Omit condition number 11; 8. Allow for the use of natural stone and composition shingled roof instead of the slate material roof that was previously approved; and 9. Request a specific window elevation treatment for the southern portion of the development. Town of Truckee March 18, 2004 Regular Page 2 The Planning Commission adopted Resolution 2004-03 recommending the Town Council support the proposed time. extension and project amendments as recommended by staff.. However, the Planning Commission requested the following items be included as recommended conditions of approval: 1. The affordable housing requirement, as detailed in the development agreement, be amended to require 7 affordable units instead of 20% of the total housing constructed. This is based on the premise that although the overall density of the project is decreasing by one unit, the affordable housing requirement should remain the same; 2. That bonding be permitted for the off-site sidewalk improvements per Condition Number 54; 3. Encourage solar orientation in the consideration of the fac~ade window design and approval per Condition Number 5; and 4. Require the use of sand instead of chemical de-icer for all on-site parking and road infrastructure per Condition Number 40.. Mayor Susman opened the Public Hearing asking for anyone wishing to speak in support or opposition to the time extension of application 01-040/EXT/ABN: Bob MacKay, of South Shore Capital, stated that they have worked with the Town Engineering Department, the Cemetery District and the Fire Depa,[~,snt to come to an agreement with regard to the Jibboom Street road. He indicated that they had encountered significant delays because the previous owner, of the property incorrectly stated that there were no environmental problems with the site. As a result South Shore Capital was required to work with the State of California Department of Toxic Substances to evaluate the site and provide recommendations for the minor cleanup of the site. Upon the evaluation of the Jibboom ~ parking and circulation, South Shore Capital felt that an overall reduction from 31 units to a less dense 30 units, and a subsequent reduction of 7 affordable housing units to 6, was appropriate. If Town Council decides that 7 affordable housing units are appropriate, then South Shore Capital requests that the total housing density return to 31 total units. Mr. MacKay also indicated that South Shore Capital is willing to pay for the traffic impact fee and work with staff regarding the requested window treatments. Tony Lashbrook, Community Development Director, stated that lhe Planning Commission perceived this request as an excuse to eliminate one of the affordable housing units. Mr. Lashbrook indicated that staff would be comfortable with Mr. MacKay's suggestion of staying with the original project design of 31 total housing units, 7 of which would be affordable housing. Council Di~u~ion and Deliberation Councilmamber Flodan: Requested Heidi Scoble, Associate Planner, to elaborate on item number 4 Town of Truckee March ! 8, 2004 Regular Page 3 Response: Heidi Scoble, Associate Planner, stated the Planning Commission felt that the chemical de-icers would have a negative impact on the environment and therefore recommend that sand be used instead of chemicals to de-ice the parking areas. Councilmember Florian: Asked Dan Wilkins, Public Works Director/Town Engineer, if his department had conducted any studies with regard to the environmental impact of using sand versus chemical de-icers. Response: Dan Wilkins, Public Works Director/Town Engineer, stated from an air quality standpoint, chemicals are better because sand becomes air born and the chemicals won't. From a water quality standpoint it could be argued either way. Tony Lashbrook, Community Development Director, stated that the water quality mitigation came from hiring outside consultants to prepare the environmental document on the Barsell Project. Because of the timeline crunch they incorporated this project as well. Generally de-icer's and sand are not used in parking lots. Councilmember Owens: Asked if the Town made a determination at some~point in the future that chemical de-icer's do not have a negative impact on the environment, would it then be possible to change according to the Town's findings. Response: Tony Lashbrook, Community Development Director, stated it would be possible to amend the standard to read ,in accordance with any future Town standard,. Councilmember Owens: Stated he met with the applicant eadier in the week and agreed that there are some benefits to reduced density, largely driven by the hammerhead vehicular movements. He also stated he was uncomfortable with rewording the original agreement to change the affordable housing requirement from 20% to 7 mandatory affordable homes. Mayor Susman: Stated he did not support 30 total homes with 7 being classified as affordable housing. He stated that 20% of 31 is 6.2, not 7, and he felt if the consensus was 7 units for affordable housing, then 31 total homes should be built. Councilmember Florian: Stated that housing is needed in Town. Mayor Susman: Expressed his concern about the pedestrian connection between Peoria/Sunnyside and downtown being at risk if 20% is not achieved. Response: Dan Wilkins, Town Engineer/Public Works Director, stated that the sidewalk project could be $500,000 to $1 million because of the Town of TrUckee March 18, 2004 Regular Page 4 topography of the ama. He felt that the projected cost was high for a project of this scale. He stated that the Truckee Townhomes project, in conjunction with Peoria/Sunnyside, would have enough critical mass to justify the projected cost of the pedestrian crossing, but by itself it does not have the critical mass. The Truckee Townhornes Project, the Fitch Parcel/Stoneridge Project and the Barsell Project will be the parcels generating pedestrian traffic on the Jibboom Street corridor. Staff feels that the Stoneridge Project should be required to build the offsite improvement and the Truckee Townhome Project would reimburse the Stoneridge Project 20% of the costs, based on how much of the Truckcc Townhomes Project is on Jibboom Street. Bob MacKay, of South Shore Capital, stated that South Shore Capital would pay 100% of the improvement in front of their property, in addition to their portion of the Kaiser Street to downtown improvements. Mayor Susman: Questioned if the hammerhead turnaround would eventually be a part of a continuous road with upon the advent of the proposed Peoria/Sunnyside Project. Response: Heidi Scoble, Associate Planner, confirmed Mayor Susman's supposition. Councilmember Threshie: Asked South Shore Capital where the 31 ~ home would be put, if the 31 total homes; 7 affordable, 24 market value were approved. Response: Bob MacKay, of South Shore Capital, stated that I of the units on Jibboom Street could be expanded to accommodate the 7t~ affordable unit. Heidi Scoble, Associate Planner, stated that the additional unit could also be put on Donner Pass Road, as indicated on the previous plan. Councilmember Threshie: Stated that he was uncomfortable with making the developer stay with 7 affordable homes when the original agreement called for 20%. Councilmember Owens: Stated that it was an issue of integrity, that the council should fight for affordable housing, but the original agreement was for 20% and that 20% of 30 is not 7. He stated his support of going back to 31 total homes with 7 being affordable housing units, if the developer was comfortable with it. He also asked Tony Lashbrook, Community Development Director, how many units the parcel is permitted to have. Response: Tony Lashbrook, Community Development Director, stated he believed it wes 34. Town of Truckee March 18, 2004 Regular Page 5 Councilmember Florian; Stated he was not comfortable with 30 total units and 6 units of affordable housing, but that he is supportive of 31 total units and 7 affordable housing units. Mayor Susman: Asked the applicant for their thoughts on the new direction of the project. Response: Bob MacKay, of South Shore Capital, stated that South Shore Capital would be willing to work with staff to incorporate the 31~t home and make it the 7th affordable housing unit. Tom Castenaida, of South Shore Capital, stated that the parking spaces would need to be changed as wall to accommodate the increased population density. Tony Lashbrook, Community Development Director, stated that the 31`~ unit could be smell to decrease the parking requirement. Mayor Susman closed the Public Hearing It was moved by Councilmember Owens and seconded by Councilmember Florian to adopted Resolution 2004-08 approving Application No. 01-0401EXT- ABN (Truckee Townhomea) South Shore Capital, OwnerlApplicant,.inclusive of 31 units 7 to be affordable, approving modifications to Application No. 01- 040, as set forth in Exhibit "A" of the Resolution, rescinding and voiding Council Resolution No. 2001-43, and adopting the findings in support of the project as set forth in Exhibit "B" of the Resolution. The motion passed 4-0 with Councilmember Ingalls absent. 8. COUNCIL PRIORITIES - None 9. STAFF REPORTS - None 10. COUNCIL REPORTS Councilmember Florian: · Attended the Downtown Parking Committee meeting yesterday, March 17, 2004. The first draft report was released to the Committee for comments. They will have a 3 week period to review and comment on the draft. · Attended the Chamber Board of Directors Meeting. The Board of Directors supported the Worker's Compensation Reform. May 24th, 2004 at Coyote Moon is the Annual Golf Tournament. March 22n~ is the next Chamber Mixer at the Tahoe Donner Northwoods Clubhouse. There are 532 members in the Chamber .... to date. Town of Truckee March 18, 2004 Regular Page 6 ,-- Mayor Susman: · Attended the NCTC meeting yesterday, March 17th, 2004. The Western County has less money than they thought they are going to have, so they are looking for ways to find money or perhaps cut back on transit services. · Attended the CRA Conference last week (March 8~ ~ March 12=, 2004) in Monterey, CA along with Councilmembers Florian and Ingalls and Town Manager Steve Wright. There is still money available for re-development. Green Building and Smart Growth is becoming mainstream. · Announced that on April 1~ ~ 4~, 2004, the Tama Band is doing a Tribute to Legends at the Tahoe Biltmore. The Pro~cds will benefit the Truckee-Tahoe Music Students Continuing Education program. 11. ADJOURNI~ENT - at 6:41pm.
