BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF '.I.'RI3ST E$ 07 THE VILLAGE OF MCCALL, IDAHO: SECTION 1. It shall be unlawful for any person. or persons to store o; sell fireworks at wholesale or retail within the corporate limits without first securing a permit therefor from the Village Clerk. Application far permit must be made in duplicate and state: 1. The name of person or persons by whom the permit Is desired. 2. The location of the premises in which the goods are to be • stored or sold. 3. Character of building to be used. 4. Nature of applicant's business in said premises. 5. Other occupancy of building. One copy of each application for permit, together with. copy of such permit, must be posted in. or on premises where the fireworks are to be sold. SECTION 2. Permits may be issued only after an inspection by the chief of the fire department or the chief of police, who shall file with the Village Clerk a certificate of approval or his disapproval and reasons therefore. , re /s e S - , 1,d �� % .-' SECTION 3. BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF TRUSTEES OF THE VILLAGE OF McCALL, IDAHO: SECTION 1. It shall be unlawful for any person or persons to store or sell fireworks at wholesale or retail within the corporate limits without first securing a permit therefor from the Village Clerk. Application for permit must be made in duplicate and state: 1. The name of person or persons by whom the permit is desired. 2. The location of the premises in which the goods are to be stored or sold. 3. Character of building to be used. 4. Nature of applicant's business in said premises. 5. Other occupancy of building. SECTION 3. Na permit shall be granted for the wholesale or retail of fireworks in any premises used for the following purposes: , 1. Where: paints, oils,, gasoline, or other inflammable liquid, tar.,; pitch, resin, hay, cotton, hemp, or other combustible fibre or stock are manufactured or kept for sale or storage, or in. any carpenter shop or drug store. 2. Where dry goods of any kind or other light material of a combustible nature,, excepting flags, paper lanterns, paper balloons, decorations or newspapers are kept for sale; these exceptions shall be stored or offered for sale at a safe distance. from the fireworks. The accredited represenative from the fire or police department shall ahve discretionary powers in these matters . 3. On other than a street grade floor. 4. Where gunpowder, blasting powder, or other- high explosives are sold, or in any structure considered especially hazardous by the fire or police department. 5. Where cigars, or cigarettes, liquors or spirits are kept for sale. SECTION 4. In buildings or places where fireworks are stored or kept for sale at wholesale or retail, the following regulations with all others mentioned in this chapter, must be observed, and it shall " 3 be the duty of the chief of the fire department or chief of the police department or their authorized agent to see that they are complied with: 1. Safety matches only may be kept in stock, sold, given away, or used. 2. No: fireworks shall be exposed for sale outside the walls of any building, nor in any doorway or show window, and they must be kept remote from any open flame or fire and the direct rays of the sun. 3. Lighting must be by electricity (incandescent) or other lights acceptable to chief of the fire or police department. 4. Exits, both front and rear, to be provided and kept open or provided with doors opening outward. SECTION 5. The entire amount of fireworks that may be kept on 0 hand in any building under any permit shall not be in excess of the ' maribt value of $300.00; except that, if all such fireworks are packed in shipping boxes, the amount allowed by a wholesale permit may be increased at the discretion of the chief of the fire or police department. SECTION 6. When a permit is issued to sell fireworks, the person. or persons receiving the permit shall cause the word "FIREWORKS" with. at least a six inch_ black letter on a red ground to be prominently 7 exposed inside and outside of the premises. There shall also be exposed in close proximinty to these "FIREWORKS" signs,, a sign with at least six inch black letters on white ground,, to read "NO SMOKING". It will then be a misdemeanor during the period for which the permit has been. granted for any person or persons to enter said premises with a lighted cigar, cigarette, or other exposed fire or light,, or to light or cause same to be lighted or burned therein.,, or for the proprietor, owner or occupant to knowingly allow such lighted or burning articles to be on the premises. SECTION 7. The storage:, sale and firing of the following kinds of foreworks is prohibited: Firecrackers containing chlorate of potash or other high explosives, firecrackers larger than 12 inches in length or one-fourth inch. in• ? v7 diameter, marbles coated with or containing any explosive mixture, fire- works containing picric acid or picrates, colored fire or other fire- works containing colored or plain sulphur and chlorate of potash in admixture; pistols,, cannons, canes ,, or other appliances using blank cartridges or using caps containing chlorate of potash mixture, bombard- ments or mandarins made of chlorate of potash mixture. Flash powders shall not be permitted in any one place in greater quantity than 10 pounds . Fireworks shall be sold at retail only during the 10 / days preceding and on the days on which their use and discharge is 7_34 permitted, and no fireworks shall be kept in stock at any retail estab- lishment for more than the 10 days preceding and 3 days following the days of use and discharge of such. fireworks. 7'30 No fireworks shall be kept in stock under any wholesale permit for more than 21 days preceding nor 5 days following the days on which their general use is permitted,, except in a fireproof vault or other building constructed and located to the satisfaction and approval of the chief of the fire or police department. SECTION 10. It shall be unlawful to use and discharge any fire- works within the inner fire limits at any and all times. It shall be. unlawful to u e and discharge any fireworks in the outer fire limits ?:a/4 _SO if within feet of any building or structure or inflammable material of any type, kind or nature.. Na fireworks shall be set off or fired from any moving vehicle or boat except under special permit and super- vision. Rockets, Roman candles, bombs,, mines and pieces of like charac- ter intended for aerial display shall be started only from suitable- structure and at such distance from surrounding buildings as to prevent personal injury and to give the ascending portion an uninterrupted passage to- the limits of its flight. No fireworks shall be used or fired out of the view of the person so firing. SECTION 11. The chief of the fire or police department may, at his discretion, remove or have removed, at the owners expense,, all 7i stocks of fireworks or other combustibles exposed for sale, or held in stock in violation of this ordinance, SECTION 12. The police department shall have power to confiscate , and destroy all fireworks used or discharged in. violation of this ordinn 141 ance:. SECTION 13. Lny person who shall violated any of the provisions of this ordinance shall be deemed guilty of a misdemeanor,, and upon 4. m" conviction thereof shall be fined in the sum of not exceeding $100.00 and upon failure to pay such fine shall'be committed to the village sail at thB .rate. of'. 24 hours for each $2.00 of such fine.
