AN ORDINANCE PROHIBITING THE PARKING OF MOTOR VEHICLES WITHIN THE INNER
FIRE LIMITS DURING THE NIGHT-TIME; PROHIBITING THE PARKING OF MOTOR VEHICLES
ON ANY STREET OR ALLEY NHEN THE SAME IS POSTED BY THE CHEIF OF POLICE OR THE
STREET COMMISSIONER; PROVIDING FOR THE CLOSING, TEMPORARILY, OF ANY STREET
OR ALLEY; PROVIDING FOR THE REMOVAL OF MOTOR VEHICLES PARKED IN VIOLATION OF
THIS ORDINANCE; LIMITING LIABILITY OF OFFICIALS ENFORCEING THIS ORDINANCE;
f PROVIDING FOR A PENALTY FOR THE VIOLATION HEREOF.
BE IT ORDAINED by the Chairman and Board of Trustees of the Village of
0 McCall, Idaho:
It is hereby declared to be the policy of the Village of McCall, for the
best interests, protection, safty, and convenience of its inhabitants to regu-
late, control and prohibit the parking of motor vehicles within the said
village due to heavy snow conditions in the winter-time so that the streets
and alleys therein may be cleaned of said snow; and further, to allow certain
temporary closures of streets or alleys when, in the interests of public
demands and convenience the same should be done.
SECTION I. The parking of motor vehicles upon both the north and south
sides of Lake Street, between the intersections of First and Third streets
shall be prohibited at all times between the hours of 3:00 A.M. and 7:00 A.M.
SECTION II. The parking of motor vehicles in any alley within the inner
fire limits shall be prohibited in the night-time, and for the purposes of this
ordinance the night-time is defined as that period of time between one hour
after sun-set and one hour before sun rise.
SECTION III. Whenever, in the judgement of the Chief of Police or the
Street Commissioner, snow or other weather conditions warrant the restriction
of parking motor vehicles upon any other street or alley in said village in
order that said street may be repaired or the snow removed, they shall cause
posters to be posted on said streets or alleys which posters shall carry the
notification that parking thereon is prohibited ari shall designate the time
when the same is prohibited. Parking shall be prohibited thereon until such
posters are removed by the proper authority. Should any motor vehicle be
parked on a street or alley at the time the same is posted, as above, then
personal notice of the restriction shall be given to the owner, operator or
other person in charge of said vehicle that said street or alley has been
restricted to parking between certain hours designated in said posters, and
lithe said motor vehicle shall be removed prior to the restricted hours.
SECTION IV. Whenever, in the judgement of the Chief of Police or the
11Street Commissioner, public convenience or demand requires that any street or
alley be temporarily closed to motor vehicles, they shall cause barriers to
be erected at all entrances to said street or alley so closed and in the night-
time there shall be placed on said barriers red lanterns or other warning
devises including flares or reflectors, visable at least 200 feet in the
direction of traffic approaching said barrier, and said street or alley shall
remained closed until such barriers are removed by the proper authority;
PROVIDED, HOWEVER, no street or alley shall be temporarily closed for a con-
tinous period exceeding 24 hours unless repairs are being made on said street
or upon water or sewage mains thereunder, or snow is being removed therefrom,
band in such event said street or alley shall remain closed until said work
is completed and traffic may safely resume use of said street or alley and the
0 barriers are removed by the proper authority.
SECTION V. Any motor vehicle which is parked upon any street or alley
after the same has been posted, as above, and during the restricted hours, or,
being already parked thereon and which is not removed after proper notice as
herein provided, may be removed by the Chief of Police or the Street Commissioner
by having said motor vehicle towed to and stored in a public garage and the
owner, operator or other person in charge of said motor vehicle shall be respon-
sible for the towing charge, storage fee and all other expenses incurred in
moving said motor vehicle from a restricted area and storing the same and shah
pay said charge, fees and expenses before removing said motor vehicle from
storage.
SECTION VI. No action or proceeding of any nature or description shall
lie against the Board of Trustees, Chief of Police, Street Commissioner or any
other village authority charged with the administration of this ordinance
because of their complience with any of the terms of this ordinance or the
exercise of any authority of the performance of duties granted or prescribed
by this ordinance, nor shall they be responsiable for any loss or damage to
said motor vehicle while the same is being towed or stored as herein provided,
except that caused by gross negligence.
SECTION VII. Any owner, operator or other person in charge of any motor
vehicle who violate the provisions of this ordinance shall be deemed guilty of
a misdemeanor, and upon the conviction thereof shall be fined in a sum not
less than $25.00 nor more than $100.00, together with costs of prosecution,
or may be sentenced to a term in the village jail of not less than 1 nor more
than 10 days, or may suffer both such fine and imprisonment. Upon failure to
pay such fine as may be imposed, the guilty person or persons may be impri-
soned in the village jail for a term not exceeding 1 day for each $2.00 of
the fine so imposed and unpaid.
This ordinance shall be in full force and effect from and after its
passage, approval and publication.
