THE CITY OF BEL AIRE, KANSAS ORDINANCE NO. 669 AN ORDINANCE CHANGING THE ZONING CLASSIFICATION FROM R-4 RESIDENTIAL TO R-1 ESTATE RESIDENTIAL ON CERTAIN PROPERTY LOCATED WITHIN THE CORPORATE CITY LIMITS OF THE CITY OF BEL AIRE, KANSAS. WHEREAS, the legal description of the tract of land is as follows: Legal Description Chapel Landing Zone Change Description Lots 58-101 inclusive, Block C, Lots 1-15 inclusivi, Block Di, Lots 17-31 inclujive, Bloj TIRTRIMTE NUER r anG LQ1 OZ-O& Inc Isive, 60UP.=, A; Reserve B; Reserve G; Reserve R; Reserve Q; Reserve BB; Reserve CC; Reserve FF, Chapel Landing, Bet Aire, Sedgwick County, Kansas, AND That part of Reserve S in said addition described as beginning at the easterly most comer of said Reserve S, said place of beginning also being the southwest comer of Highland Street and Joshua as plafted in said Lot 69, said north line being a curve to the left, with a radius of 238.53 fe;t, arc length of 89.1 feet, chord bearing N834T37W, 88.60 feet to a point of reverse curve on said north line; thence Westerly along said north line being a curve to the right with a radius of 248.00, arc lenqth of 75.46 feet chord bearin N85*4647W, 75.17 feet to fte -torttwest coner said Lot ling 233.00, arc length of 65.83 feet, chord bearing S8602407E, 65.61 feet thence Easterly along along said northeast line being a curve to the right with a radius of 253.53 feet, arc length of 97.40 feet, chord bearing S8302927"E, 96.80 feet to the place of beginning. WHEREAS, A public hearing was convened on the matter of rezoning the afore described tract on May 14, 2021, by the Planning Commission for the City of Bel Aire, Kansas in conformance with the requirements set forth in Article Five of the Zoning Regulations of the City of Bel Aire, Kansas; WHEREAS, Following the public hearing, the Planning Commission found that the evidence does support this requested zone change based upon the guidelines set forth in Article 5.02 of the Zoning Regulations of the City of Bel Aire, Kansas; WHEREAS, The Planning Commission for the City of Bel Aire, Kansas recommends approval of the application by the property owner to change the tract of land, as described above, from R-4 Residential to R-1 Estate Residential; WHEREAS, the Governing Body has considered the factors set forth in Article 5.01 and Article 5.02 of the Zoning Regulations of the City of Bel Aire, Kansas in relation to this tract; BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE, KANSAS: SECTION 1. The Governing Body supports the recommendation of the Bel Aire Planning Commission, and approves the rezoning of the tract of land from R-4 Residential to R-1 Estate Residential;. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. This Ordinance shall take effect and be in force from and after its publication in the official City newspaper. Passed by the City Council this 1st day of June, 2021.
