CALL TO ORDER Planning Commission Chairman Stacy called the meeting to order at 7:35 p.m., March 11, 1986 2. PLEDGE OF ALLEGIANCE TO THE FLAG Chairman Stacy led the Pledge of Allegiance to the flag. 3. ROLL CALL Present: Commissioners Abraham, Breazeal, Coolman, Muto and Stacy. Also present: City Attorney Martin, City Manager Koski, Planning Director Shaw,. and Associate Planner Saldana 4. APPROVAL OF MINUTES Corrected Minutes, February 11, 1985 - Approved as corrected. February 25, 1985.- Commissioner Coolman requested that the minutes reflect that Commissioner Breazeal led the Pledge of Allegiance to the Flag. Also reflected was an error in Resolution 86- 1231PC. Condition No. 5 states the business hours to be ._.4:30 a.m: to 2:00 a.m. This should be corrected to read 4:.30 p :m. to 2:00 a.m. (CUP 86 -779 - Domino's Pizza) The Resolution was unanimously approved as corrected, with Chairman Stacy abstaining. OLD BUSINESS - None NEW BUSINESS 5. PUBLIC HEARING - CONDITIONAL USE PERMIT NO. 82 -668 Site: 9665 Las Tunas Drive (Ivanhoe's). Temple City, CA 91780 Applicant: Thomas Belwish 2119 S. Myrtle Ave. Monrovia, CA 91016 Owner: Elizabeth Giandomen C 620 W. Wisteria Arcadia, CA 91006 Planning Director Shaw gave the Staff Report stating that this was a request for Modification of Conditional Use Permit.to amend two Conditions of Approval pertaining to a restaurant with live entertainment including music and dancing. The applicant is requesting that Conditions 13G be modified that employees under the age of 21 be permitted in the establishment until 10:00 p.m. This would allow hiring of busboys, waiters, etc. under 21. No person under 21 would be allowed to prepare or serve alcoholic beverages. The applicant also requests that Condition 131 be modified to allow for entertainment from .4:00 p.m. until closing instead of the current 9:00 p.m. until closing. PLANNING COMMISSION MINUTES Page 2 4111 March ll, 1986 • • 5. PUBLIC HEARING CUP 82 -668 Continued Chairman Stacy asked if there was a specific hour of closing for the entertainment and dancing. Planning Director Shaw replied that yes, there was Section 2, No. 5 did specify closing at 2:00 a.m. PUBLIC HEARING WAS DECLARED OPEN Chairman Stacy invited the applicant to speak, but the applicant was not in the audience. Robert Jensen.- 5941 Kauffman - Mr. Jensen stated that the neighbors would like some assurance that there would be some control over the new approach that the applicant is taking, and that it would not deteriorate into the same situation they had when Ivanhoe's was an active social center. Coliunissioner Breazeal asked if it was possible to review this after 6 months or so. City Attorney Martin said that yes, it could have a review period of any time set so that it could be monitored for problems. Jack Hill - 5931 Kauffman - He has been pleased with the way Sevan's has run the business. He also would like to have some control and assurance that it would not become a nuisance as it had been previously. Because the applicant was not in the audience to answer questions, the Planning Commission voted unanimously to continue this matter to the next meeting of March 25, 1986. A motion was made by Commissioner Breazeal to close the public hearing and continue the matter to the next meeting, seconded by Commissioner Coolman. The motion was carried unanimously, and the matter was continued. 6 PUBLIC'HEARING.- ZONE CHANGE 86 -782 - CHANGE ZONE FROM.R -1 TO R -2. Site: 4840 Glickman Avenue Temple City, CA 91780 Applicant/ Owner: Ronald L. Rapp Planning Director gave the Staff Report stating that the applicant wishes a change of zone from R -1 to R -2 for the property located at 4840 Glickman Ave. By means of this change, applicant could develop an additional dwelling unit on this site. The property is 16,992 sq. ft., would accommodate up to a maximum of 4 residential dwelling units if compliance with the codes and Conditional Use Permit requirements. The adjacent properties are also zoned R -1, but the properties on the northwest corner of Glickman and Lower Azusa are zoned R -4, and the northeast corner of Glickman and Lower Azusa Road is zoned C -2. The land uses in the area are predominantly multiple family residential. Staff recommends that the request for change from R -1 to R -2 be approved as the change is in conformance with the plan, that it is compatible : th surrounding zoning, and it is compatible with nearby and adjacent land uses. Planning Director Shaw stated that lthe request is for just one lot,many other lots are non - conforming with the_current zoning given present land uses. This issue will need to be addressed later when the General Plan is revised, and a Master Re- Zoning Plan will be available in order to -re= zone -manyi ___properties in the City. PUBLIC HEARING rae.S 7)ECLp_RFTI. _OPEN Ron Rapp - 4840 Glickman Ave. Stated that the majority of the properties are multiple dwelling.. and that he feels that his request is consistent with the majority of other properties in the same area. PUBLIC HEARING WAS DECLARED CLOSED Commissioner Breazeal stated that he was in favor of this zone change. Commissioner Muto agreed, and added that this case presents an opportunity to go forward with something that will be done in the near future. Commissioner Coolman favored the change, also. Commissioner Abraham was in agreement with the other Commissioners. Commissioner Breazeal made a motion to adopt the resolution for Zone Change from R -1 to R -2, and seconded by Commissioner Abraham. and carried unanimously. City Attorney Martin read title to Resolution No. 86- 1237PC approving Change of Zone from R -1 to R -2.for property located at 4840 Glickman Ave., Temple :.City. (ZONE CHANGE 86 -782) Applicant was notified that this must also come before the City Council and be approved by them before it is finalized. 7. PUBLIC HEARING - CONDITIONAL USE PERMIT 86 -783 Site: 5105 Farago Ave. Temple City, CA 91780 Applicant/ Owner Neil McGinley 2017 Highland Oaks Arcadia, CA 91006 Planning Director Shaw presented the staff report regarding this request for allowing the construction of four multi - family residential dwelling units. The property presently consists of a single family dwelling. There is no garage on the site. The site and all adjacent properties are zoned R -2. Staff recommends approval of the Conditional Use Permit as the proposed development is acceptable, the lot is adequate in size and shape for the proposed use for the site, there is adequate access to the street, and the proposed use does not appear to have an adverse impact on adjacent properties. Based on these considerations, staff is recommending that the request be approved per the findings and Conditions of Approval as contained in the staff report. A videotape was shown of the site. PUBLIC HEARING WAS DECLARED OPEN Chairman asked the applicant or representative to come forward and speak. Neither the - applicant or ::hrarrepresentative- -was -- in- the -- audience. " " _PLANNING COMMISSION MINUTES Page 4 March 11 1986 James Koppelman - 5109 Farago - Spoke in opposition to the project. He stated that the area is heavily traveled and that there are many children on the street. There have been some problems with speeding on the street, and some of the residents have been concerned that there will be an accident. The new project would add even more cars to this already busy street, and more cause for concern. He also objected to the privacy factor when a two -story unit will be adjacent to his property. Chairman Stacy advised Mr_.. Koppelman that it was within the applicant's rights to build a two - story, and that, in fact, Mr. Koppelman himself could build a two -story unit if he so desired, and_that the project meet all requirements and codes.Plannin2 Director Shaw also stated that Mr. Koppeltan.is on the north and is approximately 28' from the proposed structure, in addition to the 5 setback of Mr. Koppelman's house from the property line. Mr. Koppelman stated that the previous owner put in a block wall fence, as requested by the City, but that it was not constructed properly. Parts of it are now falling down. Mr. Koppelman stated that he did notify the city of the poor workmanship (a shallow footing). The wall is not 6' high. Planning Director Shaw indicated that the applicant had indicated that a wall would be placed on the northerly property line, and that is why it was not conditioned in the CUP. However, it would .be proper to - include a condition requiring a 6' wall on the north side if-the Commission -would Like to do so. Alicia Koppelman - 5109 Farago - Ms. Koppelman objected to the two -story structure being built on the adjacent property, especially since it is in the middle of the block.. There is one other two -story single residence across the street, and some condominiums down the street. The rest of the houses are___ all single story, single dwelling homes . Future _home sales m_i�rt= = -__ ___be impeded if the two -story duplexes were constructed right next to _their lot, and the driveway would pass right next to their bedroom; windows. She expressed concern that more and more multi - family apartments might be coming in. Jan' Soter - 5123 Farago - Ms. Soter stated that she has lived in her home since 1973, and many homes have turned into rentals. The traffic has increased tremendously, and many children. These duplexes will add to the traffic and congestion. She objects to rentals being constructed where the owner does not live on the property also. Liz Parker, 5027 .Farago - Ms. Parker asked if -the access: tothe garages would be called a private driveway. The answer was yes, this would be called a private drieway. She questioned whether or not the schools could accommodate more children from this area. Commissioner Coolman explained that the new units being built have many conditions and restrictions not imposed upon single dwelling owners or builders. PUBLIC HEARING WAS DECLARED CLOSED Commissioner Muto stated that this was within the zoning requirements, and that the Conditional Use Permit covered the requirements, and was in favor of the project. " " " PLANNING COMMISSION MINUTES Page 5 March 11, 1986 Commissioner Abraham asked if there would have -been as many l Conditions of Approval as there-are-on-this case had-the-project been processed before trio-new Ordinance--requir.ing- a -C'uP -for construction on lots with 3 or more units. Planning- Director Shaw explained that-this was the first nearing- under the new Ordinance. Not all of -the Condi- Lions of Approval would have been included under -the prior -plan cteck review- process. �% Commissioner Breazeal motioned to approve request for Conditional Use Permit 86 -783 to allow construction of four multi - family residential dwelling units to be located within two duplex structures with all the conditions and findings as .required by code, and seconded by Commissioner Coolman and carried unanimously. City Attorney Martin read title to Resolution No. 86- 1235PC providing that the Conditional Use Permit 86 -783 be approved with conditions as recommended by staff amending Condition No. 13 to require a 6' high block wall along the northerly property line. 9. PROPOSED ORDINANCE AMENDMENT TO TEMPLE CITY ZONING ORDINANCE CODE REQUIRING A MINIMUM` PARKING SPACE SIZE OF 10' x 20' FOR ALL PARKING SPACES WITHIN ENCLOSED GARAGES, REGARDLESS OF THE ZONE CLASSIFICATION. Planning Director, Shaw gave an overview of the proposled _ amendnnt n 9$1 this provision- as a-aoptea-by -the - -City of nci basica y for_ R zones. The ordinance amendment had been utilized in all zones by the Planning Department, but was actually not spelled out in the Code Book. This amendment would amend the code to provide that all spaces within a garage shall be a minimum of 10' x 20'. regardless of the- zone classification. Staff recommends- that- this Ordinance Amendment-be adopted. A Negative Declaration -has been prepared. Commissioner Coolman asked how much this would increase the width by, and Planning Director Shaw answered that the width was increased by one foot for each parking space, or 2 feet for a 2 -car garage. PUBLIC HEARING WAS DECLARED OPEN No one wished to speak. PUBLIC HEARING WAS DECLARED CLOSED Commissioner Breazeal motioned to adopt the Ordinance Amendment requiring a minimum parking space of 10' x 20' for all parking spaces within enclosed garages regardless of zone classification, and seconded by Commissioner Coolman. The motion was carried unanimously. 10. COMMUNICATIONS Planning Director Shaw mentioned that the checks for the Commissioners Institute in San Diego had been distributed, and that three of the Coumiissioners would be attending the conference this week. 11. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK A question was asked from the audience regarding meeting dates for the City Council. Chairman Stacy stated that the meetings were held on the 1st and 3rd Tuesdays of each month at 7:30 p.m. in the Council Chambers. PLANNING COMMISSION MINUTES Page 6 IDMarch 11, 1986 12. MATTERS FROM PUBLIC OFFICIALS (a) Planning Director Shaw reported on the Minor Zoning Modification Committee Meeting, March 11, 1986 Minor Zoning Modification 86 -170 Applicant: Drafting Unlimited 766 Monterey Road South Pasadena, CA 91030 Site: 9537 Gidley Temple City, CA 91780 Action: APPLICANT HAS REQUESTED CONTINUANCE UNTIL MEETING OF MARCH 25, 1986 Minor Zoning Modification 86 -180 Applicant: Rick Minick 10134.La Rosa Drive Temple City, CA 91780 Action: The north area was determined to be the front yard, the south area the rear yard, and the east and west property the side yards. The garage. will be re-converted into a garage. (b) Sign Plan - Jomel's Place The roof sign does not conform to code and will have to be removed. The applicant will be coming back with a new sign plan at a future meeting. (c) Code Enforcement Program A question was raised.as to what "Mobile Equipment" consists of. Planning Director Shaw. said it would be explained at the next meeting. (d) Request for Issuance of Building Permits for property located at northeast corner of Woodruff & Cloverly. Robert Hepler had applied for Building Permits for the subject property, but due to delays in Public Works and imposed Conditions of Approval from them he delayed in applying for the permits. When he did apply, he was one day beyond the new ordinance coming into effect which required a Conditional Use Permit for all units over 3 in number being.constructed. Because he was not informed of the pending CUP requirement, it was recommended by Staff that he be excused from the $300. fee for filing for.the Conditional Use Permit, and from the CUP process itself: Tom Breazeal motioned to support staff's recommendation_to direct Planning Director Shaw to notify Mr. Hepler _permits can be issued without the Conditional Use Permit cycle, seconded by Commissioner Abraham, and concurred -- unanimously.
