DIAZ X X DDMItD X - Indicate Vote AB - Absent NV - Not Voting NOR- Indicates Vote to Overrule Veto Adopted at a meeting of the Municipal Council Ai 11 1 / CLERK yH1VjoRAIYDMj Or UNDDERSUVNDLIc This Memorandum of Understanding dated as below set forth, is made by and between Borough of Carteret, a Municipal Corporation having its offices at 61 Cooke Avenue, Carteret, County of Middlesex, New Jersey 07008, hereinafter the "Municipality" And The Bricklayers and Allied Craftworkers Administrative District Council of New Jersey, Locals 2, 4 & 5, having offices at 3281 Route 206, Bordentown, New Jersey, 08505 hereinafter the "Local Local Union ". WITNESSETH: Wr EREAS, the Municipality intends to employ BAC /ADC of NJ masons on an as needed, temporary basis to supplement its existing workforce; and WHEREAS, the Local Union has, in its ranks numerous individuals residing in or near the Municipality who are qualified to perform such services. NOW, THEREFORE, BE IT AGREED AS FOLLOWS: 1. The Municipality shall hire, as temporary employees, such BAC /ADC of NJ masons referred by the Local Union as may be required by the Municipality, from time to tune, to perform maintenance, repairs and/or construction work on a temporary basis. 2. Both parties acknowledge that the number of workers required and the length of time for which they may be required is indefinite. Both parties agree that the Local Union's shall provide such labor as may be required by the Municipality in the Municipality's sole discretion. 3. The scope of work shall include maintenance, repair and construction work provided by and under the direction of the Superintendent or Director of the Department of Public Works and/or his designee(s). The Local Union agrees to provide BAC /ADC of NJ masons to perform such work as may be required to said specifications and to perform same under the direction of the Superintendent/Director or his designee(s). The BAC /ADC of NJ masons employed will work in harmony with the Municipality's fiill -time employees. 4. The wages, benefits, benefit contributions collection procedure, and arbitration provisions shall be as specified in the most recent collective bargaining agreement negotiated on behalf of the Local Union for the State of New Jersey, a current copy of which is annexed hereto and incorporated herein as Exhibit "A ". 5A. This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey. 5B. This Agreement shall not be modified or amended except pursuant to an instrument in writing signed by all parties hereto. 5C.
