Steele,
Attached is a permit application from Jan Fox (phone 713 -7332) for work at her home
at 8 Seventh Terrace. Doyle Landscaping (phone 786-7113) is the contractor. Jan wants
to be kept informed of the processing.
The questions I have before issuing the permit have to do with the impact on drainage.
The proposal is to remove concrete and then elevate /level /grade the area and install
brick pavers. Please determine if this permit can be issued. You may need assistance
from Downer but if those fees will be passed to Ms. Fox she needs to be told that in
advance.

Harold, the issue is that this is a driveway for parking & they have never been subject to the set back.
What I was thinking of that changed concerned a change to 3 -200 that you referred to & it was
changed recently to delete a provision that specifically said "carports may be placed anywhere within
the property boundaries." At the same time, 3- 070(C) was added to require carports( as accessory
structures) to be 5 ft off a property line. That is what I was recalling as possibly impacting this or what
I thought might have changed the parking situation. The bottom line is it did not change for driveways.
The greenspace issue I was referring to, dealt with permeable material being required for at least
65% of the setback area on a parcel.That was section 3 -165 that was also recently changed — in June
2011.'
I think Steele is wrong & driveways /parking is not subject to the building setback under the current
ordinances..

The top of the wall of the RV parking pad at 8 7th Terrace / Steve & Jan Fox is 15-1/2 to 16-1/2 inches from
the ground at its highest points. Attached is a photo showing what may be a flag on the property corner.
If it is the corner marker, the wall is near the property line but not past it.

Thanks Dianne. I do not recall it ever being affirmatively stated in the code that driveways can be located
anywhere such as was the case with carports. They obviously have always been that way as is apparent
all over the place

You are correct - a driveway can be on the property line but a carport has to be 5 -feet off.
I was not heavily involved with this permit and I do not recall hearing that the RV parking area was
elevated.

Thanks Dianne... so if I am correct, driveways can still be right on lot lines without regard to set backs.

Was it part of the equation of the approval that this would be less than 12 "s or did it even come up? You

Bubba,
Based on the photograph the parking pad for the RV looks too close to 12- inches to know for sure so I'll go
down after work today and measure it. Note that the permit that was issued (see page 5 of attachment
S35C) left the southern portion of the parking area as concrete, but the northern part of the parking area
was concrete to be removed and replace with pavers. There was supposed to be grass between the
pavers and the property line, but in the photograph it looks like the concrete at the front (south) was
continued to the rear (north) to form the elevated wall to hold the pavers.
The change to the ordinance you may be recalling was the moving of carports

Steele,
I have no issues on this project based on the following.
Kimberly Doyle clarified that only a portion of the concrete in the middle of the existing mass of concrete is
being removed to allow for replacement with a pervious modular brick paving area. Concrete will remain on
the east, south and west sides of the new porous brick driveway. The house will be on the north side. As such
demolition will create a hole with all removed concrete being placed in a dump truh and hauled off As a
precautionary measure Kim and Barry have agreed to place a few straw bales in the north swale of 7th Terrace.
No further structural BMP's should be necessary.
I'll observe the site as part of my routing E &S inspections next week.
