Carteret preceding the Regular Meeting, February 16, 2012, was
held on February 2, 2012, 6:00 P.M., Council Chambers, Memorial
Municipal Building, 61 Cooke Avenue, Carteret, New Jersey.
The following were noted present:
Councilmember Vincent Bellino
Dennis DiMascio
" Randy Krum
" Joseph W. Sitarz
Noted Absent was Mayor Daniel J. Reiman and Counci President
Jorge Diaz and Councilmember Susan Naples.
Also noted present was Municipal Clerk, Kathleen M. Barney and
Borough Attorney, Robert Bergen.
In the absence of Mayor Reiman the meeting was conducted by
Councilmember Bellino.
The Clerk stated that on January 9, 2012 the 2012 Annual Meeting
Notice was mailed to The Home News Tribune, The Star Ledger
and posted on the Bulletin Board. It was published in the Home
News Tribune on January 9, 2012 and The Star Ledger on January
10, 2012.

Pledge of Allegiance Pledge of Allegiance led by Councilmember Vincent Bellino.

present, the Minutes of January 26, 2012 were approved,
transcribed and engrossed by the Clerk.

unanimous affirmative vote of the four (4) Councilmembers
present Councilmember Bellino declared the Public Hearing to be
opened.
Kevin Urban spoke. He said he was at the Planning Board Meeting
and they told him that no trucks will be on the Carteret streets.
Attorney Bergen interrupted Mr. Urban explaining that this
ordinance is about fees for zoning permits.
Kevin Urban said he would wait on the question.

Councilmember Bellino explained Ordinance #12 -2 referred to the
lighting systems and the paving of the sidewalks.
The Clerk stated that Ordinance #12 -3 was introduced and
adopted on First Reading at an Agenda Meeting of the Borough
Council of the Borough of Carteret held on January 19, 2012. It
was duly published in The Home News Tribune on January 24,
2012, with notice it will be considered for final passage after
Public Hearing to be held on February 2, 2012 at approximately
6:00 P.M. The Ordinance was posted on the Bulletin Board and
copies were made available to the general public and according to

store you could live upstairs, but, if you went through the
Planning Board you could rend to anyone.

Ken Freeman questioned the ordinance.
Attorney Bergen said the intent of the ordinance is to allow mom
and pop stores in the neighborhood commercial zones, where
people can occupy the upstairs, become a permitted use and they
will not need a variance.

VcV ULben Kevin Urban questioned if they could back out of it and if there
was any bond money collected and who the owner was.
Attorney Bergen Attorney Bergen replied he was not sure who the owner was and
the bonds would not be posted until after the work was started as
in any other project.
Public Portion Upon MMS &C by Councilmembers Sitarz and DiMascio and
closed unanimous affirmative vote of the four (4) Councilmembers
present, the public portion of the meeting was closed.

Upon MMS &C by Councilmembers Sitarz and DiMascio and
unanimous affirmative vote of the four (4) Councilmembers
present, the Public Portion on Resolutions /Agenda Items and New
Business was opened to the public.
Kevin Urban spoke. He said at the Planning Board they stated that
they would not use any town road to bring in 65 to 70 loads
aggregate . He asked how it would be enforced.
Councilmember Bellino explained we have the Industrial Highway
and that is probably the connecting road to where they want to
go.
Councilmember Krum said there are no trucks allowed on
Roosevelt Avenue over four (4) tons and there are signs posted
for this.
Kevin Urban said if there was any kind of accident or calamity on
the Industrial Road the public roads would be used and he
referred to Washington and Roosevelt Avenues.
Councilmember Bellino replied that Washington and Roosevelt
Avenues are county roads and other than traffic safety, we do not
have jurisdiction over them.
Attorney Bergen explained that this is going to be a process that is
going to be regulated by permits to the DEP. It has to be approved
in a number of places throughout the state and then the town will
determine whether they want to bring it in and they will pay the
town significant fees to bring it in. He said the town can regulate it
in a number of ways explaining if they don't take the path they
said they could they could fine the property owner as being in
violation of a site plan approval and could change the weights on
the trucks so they don't drive on any local roads.

Councilmember Krum stated this was the final step for these two
(2) gentlemen and reported that he and Chiefs Malik and
O'Connor had interviewed three (3) other members.
Upon MMS &C by Councilmembers Krum and and Dimascio and
individual roll call vote, Councilmembers Bellino, Dimascio, Krum
and Sitarz voted in the Affirmative. Council President Diaz and
Councilmember Naples were noted Absent.

Councilmember DiMascio, Committee Chairperson for Public
Works, reported Progress.
Councilmember Krum, Committee Chairperson for Fire &
Domestic Preparedness, said he would give his report at the
Regular Meeting on February 16, 2012.
Councilmember Sitarz, Committee Chairperson for Police
,reported Progress.
After no further discussion, upon MMS &C by Councilmembers
Sitarz and DiMascio and unanimous affirmative vote of the four
(4) Councilmembers present, the meeting was Adjourned at
