IN THE WILLIAM F. KOCH, JR. COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. Call to Order. Mayor Morgan called the meeting to order at 9:00 A.M. II. Pledge of Allegiance. The Mayor led the Pledge of Allegiance. III. Roll Call. Present & Scott W. Morgan Mayor Participating: Thomas W. Stanley Vice Mayor Paul A. Lyons, Jr. Commissioner Joan K. Minutes. A. Regular Meeting of January 12, 2017. Mayor Stanley moved to approve the minutes of January OVice 12, 2018 and Commissioner White seconded the motion with all voting AYE at the roll call. V. Additions, withdrawals, deferrals, arrangement of agenda items. There were no changes to the agenda. VI. Announcements. A. Regular Meetings and Public Hearings 1. March 9, 2018 at 9:00 A.M. 2. April 13, 2018 at 9:00 A.M. 3. May 11, 2018 at 9:00 A.M. 4. June 8, 2018 at 9:00 A.M. 5. July 13, 2018 at 9:00 A.M. Mayor Morgan called attention to the meeting dates and all assured they would be present for the March 9, 2018 meeting. VII. Communication from the Public (3 min. maximum). �J1 There was no communication from the public. VIII. PUBLIC HEARING A. Declaration of Ex -Parte Communication Commissioner White stated she had spoken to Mr. Ermers in person and to Mrs. Ermers later by phone. B. Administer Oaths. J The Town Clerk administered the Oath to Matt Wolf, Carlos Linares, Bob Ross and David Bodker. C. Items related to previous approvals. Town Commission Regular Meeting & Public Hearing February 9, 2019 @ 9:00 A.M. O1. Revision to previously approved plans submitted by Matt Wolf, Edgewater Building Group, as agent for Kristina and Ardie Ermers, owners of property located at 800 Canary Walk, Gulf Stream, Florida 33483, legally described as Lot 24 and the westerly 100 feet of Lot 30, Place Au Soleil Subdivision. Ua. Landscaping Mr. Wolf explained that they had made changes to the landscape plan that was originally approved and are now asking for approval of what is there. He explained the changes and added that the ARPB is fine with the changes in the back and side yards but wanted the plantings in the front to follow the plan that was originally approved. He said that the water meter and septic tank and drain field are located in the front on the north side of the driveway which restricts the planting in this area. The Commission agreed with the ARPB and Mr. Wolf said he would replant this area but is restricted by the septic system and water meter. Mayor Morgan believed that the landscape architect needed to illustrate a Design that takes into consideration the exact locations of these obstructions and places the plants accordingly. Vice Mayor Stanley moved that a corrected landscape plan be prepared for review by staff and then sent back to the ARPB for final review with scale measurements Oand review of the front landscape plan. The motion was seconded by Commissioner White and all voted AYE. b. Style of Outside lights Vice Mayor Stanley then moved to approve the change in light fixtures from what was originally approved to the linear fixtures and Commissioner White seconded with all voting AYE. c. Fence Installation Vice Mayor Stanley included as a part of his previous motion to approve the chain link fencing as shown on the as -built drawing and exists at this time, which includes the Clusia hedge that will grow through the fence. Motion was seconded by Commissioner White with all voting AYE. Town Manager Dunham reminded Mr. Wolf that he had agreed he would place muntins on the windows that are required to have them but they have not been added as yet. Mr. Wolf assured that they will be added. D. Applications for Development Approval J1. An application submitted by Mouw Associates Inc. as Agent for BW North Ocean Inc., owner of the property located at 1330 N. Ocean Boulevard, Gulf Stream, Florida 33483, legally described as Lots 7 & 7A Replat of Donald B. McLouth Subdivision recorded in Plat Book 25, Page 67 of the Public Records of Palm Beach County, Florida. a. LEVEL 3 ARCHITECTURAL/SITE PLAN REVIEW to permit ig Town Coimnission Regular Meeting & Public Hearing February 9, 2019 @ 9:00 A.M. Othe installation of flat, gray thru and thru, slate - like color, un -coated tile on the roof of the existing Bermuda style one-story, single family dwelling located at 1330 N. Ocean Blvd., Gulf Stream, Florida. Mr. Ross of Mouw Associates presented a sample of the the being requested and also a sample of the color that will be used to repaint the house, an off white slightly tinted cream with white trim. Commissioner Orthwein moved to approve the installation of the flat gray thru and thru slate -like color, uncoated tile on the roof of the existing Bermuda style one-story, single family dwelling located at 1330 N. Ocean Blvd. and Commissioner Lyons seconded the motion. All voted AYE. 2. An application submitted by Carlos Linares, Randall Stofft Architects, as agent for N. Ocean Capital 2929 B LLC, owner of property located at 2929 N. Ocean Blvd., Gulf Stream, Florida 33483, legally described as the South 120 feet of Lot 1, Gulf Stream, Ocean Tract recorded in Plat Book 16, Page 81 of the Public Records of Palm Beach County, Florida. a. SPECIAL EXCEPTION #1 to permit an additional 220 square feet of covered, unenclosed floor area that O exceeds the maximum FAR of 8,705 square feet. b. SPECIAL EXCEPTION #2 to permit the construction of 488 square foot gate house in the Beachfront Design District. c. NORTH OCEAN BLVD. OVERLAY PERMIT to permit the construction of a 488 square foot gate house and an 8 foot high stucco wall within the North Ocean Blvd. Corridor. The Commission believed that the structure is too high and massive, especially in the center, has too many windows that are too large and the style of which is discouraged rather than preferred, thus does not exhibit the smooth, straight design of Bermuda architecture. With regard to the gate house, there was a question as to whether or not it is in keeping with the neighborhood concept. Mayor Morgan pointed out that all members have questioned these items and that he believed this should be returned to the architect for a second look, taking into consideration the remarks from the Commission. After a brief discussion it was determined that the applicant is withdrawing this submission and will be returning through the ARPB after meeting with staff, with a different design and presentation. 3. An application submitted by Dave Bodker Landscape Architecture/Planning Inc. as agent for Paul and Nancy ^ Zarcadoolas, owners of Property located at 1357 North JOcean Blvd, Gulf Stream, Florida, legally described as the South half of Lot 4 and the North half of Lot 5, 3 Town Commission Regular Meeting & Public Hearing February 9, 2019 @ 9:00 A.M. OBlock D, Revised Plat of Block D and E, Palm Beach Shore Acres. Mr. Bodker pointed out there will be a new wall along the front of the property with a white opaque gate across the driveway that will be constructed with white blocks of concrete separated with artificial turf. He described the individual plants that Owill be in front of the wall and along the driveway. He further gave detail on the planting along the sides in the front and back of the property. a. NORTH OCEAN BLVD. OVERLAY CORRIDOR PERMIT to allow the re -landscaping of the entire Corridor at 1357 N. Ocean Blvd. Vice Mayor Stanley moved to approve the North Ocean Boulevard Overlay Corridor Permit with the condition that any minor modifications to the approved landscape plan shall be submitted to the Town Manager for review and approval and any major modifications to the approved landscape plan shall be brought back to the ARPB for review and approval, prior to commencement of landscaping. Commissioner Orthwein seconded the motion and all voted AYE. b. LEVEL 3 ARCHITECTURAL/SITE PLAN REVIEW to permit the re -landscaping of the entire landscaped area of this property. OVice Mayor Stanley then moved to approve a Level 3 Architectural/Site Plan based on a finding that the proposed re- landscaping to an existing landscape plan meets the minimum intent of the Design Manual and applicable review standards with the following conditions: Any minor modifications to the approved landscape plan shall be submitted to the Town Manager for review and approval and any major modifications to the approved landscape plan shall be brought back to the ARPB for review and approval prior to commencement of landscaping. Commissioner Orthwein seconded the motion and all voted AYE at the roll call. IX. Reports. A. Utility Undergrounding-Danny Brannon (Engineer) Mr. Dunham reported that to date there have been 11 homes on Polo, 9 on Gulf Stream Road, 3 on Golf View Dr. connected to the underground service along with the street lights in those areas. Commissioner Lyons said the workers were very professional and courteous when they connected his home and Mr. Dunham said he has been pleased with the contractor, Wilco. He said when all street lights are powered up there will be adjustments to the intensity of each. B. Town Manager 1. Town Hall Addition Progress Report The Town Manager said they are expected to pour concrete in the foundation on Monday. 2. Discussion Re: Time Limits on Construction Sites. Mr. Dunham reported that due to complaints about the length of time that it takes for construction projects, he and Mr. 4 Town Commission Regular Meeting & Public Hearing February 9, 2019 @ 9:00 A.M. ONazzaro have been researching this problem with regard to other towns. He pointed out that at this time a building permit stays valid as long as there is at least 1 building inspection every 180 days as per the Florida Building Code. Mr. Nazzaro said that Palm Beach has a code with a sliding scale based on the number of square feet between 4,000 and 40,000 in the buildings 0and between 16 months and 3 years. He said this was established through historical data which could be done for Gulf Stream. He added that in their Code there is a window prior to expiration of the time limit during which the owner can ask for an extension explaining why the time limit is not being met along with a daily schedule for completion and a daily fine of 10 cents per sq. ft. if they exceed the extension that has been granted. There have been fines of over $200,000 collected so that does not necessarily solve the problem. The Mayor directed that staff follow on this by collecting the historical date and preparing a time schedule for consideration at a future time. 3. Status of Capital Improvement Project The Town Manager said he is pleased with the work Mathews Engineering is doing and especially with the range of alternatives they will be presenting at the March meeting. O C. Architectural Review & Planning Board 1. Meeting Dates a. February 22, 2018 at 8:30 A.M. b. March 22, 2018 at 8:30 A.M. c. April 26, 2018 at 8:30 A.M. d. May 24, 2018 at 8:30 A.M. e. June 28,2018 at 8:30 A.M. f. July 26, 2028 at 8:30 A.M. D. Finance Director 1. Financial Report for January 2018 Mr. Dunham said this report represents one third of the year and that if there are no questions, it be accepted as presented. 2. Water Usage as of January 31, 2018 The Town Manager said this is a normal water report and there were no questions. Mayor Morgan declared both the Financial Report and the Water Report as accepted since there were no questions. E. Police Chief 1. Activity for January 2018 JChief Allen asked that the report be accepted as presented, adding that one of the officers saw a young man go over a fence in Place Au Soleil, take a bicycle and pass it back over the fence to another young man on the other side of the fence. They both were apprehended but the owner of the bicycle refused to file charges for the theft.
