Chairman 's announcements On December 20 , 2019 , President Trump signed legislation amending the Federal Food , Drug and Cosmetic Act raising the minimum age for sale of tobacco products from 18 to 21 years of age . It is now illegal for retailers to sell any tobacco product, including cigarettes, cigars and e - cigarettes to anyone under the age of 21 . Flu season has started much earlier this year and it is predicted by the CDC to be the worst since 2003 . There are two main strains , Influenza A and Influenza B . Both have been included in this year's flu vaccine . More children are being affected this season with 27 flu related deaths recorded so far . Flu vaccines can still be obtained at your local pharmacy . The VNA will be holding a free wellness clinic which includes blood pressure , glucose and cholesterol screenings on January 28 , 2020 from 10AM - 12PM at the Council on Aging . Citizen 's Forum No one was present. 3 . Captain Freeman Inn, 15 Breakwater Road — new owners Laurie & Cason Stuehmer- Food Service permit ( Bed & Breakfast) Laurie & Jason Stuehmer were present . They have purchased the Captain Freeman Inn . They will be keeping things the same as previous owners . Mrs . McCullough stated that she had gone over everything will them and all is in order. She thanked the previous owners Byron and Donna Cain for all their hard work over the past few years at the Inn . Motion : Approve the Food Establishment application pending a final inspection . Motion : Joe Ford Second : Penny Hausser Holeman Vote : 5 - O - O Action : Motion carried i 4 , Cumberland Farms — 2655 Main Street — Tobacco violations, 1 / 2/ 20 & 1 / 3 / 20 Cumberland Farms asked that this be continued until the next meeting on February 5 , 2020 . Mrs . von Hone spoke about the violations . The office received a complaint about them selling flavored tobacco on January 2 , 2020 . She went out and found that they were selling it . The other violation was on January 3 , 2020 . The BOH 1/ 15/2020 Minutes Page 2 violation was for selling tobacco to a minor . Bob Collett from the Cape Cod Regional Tobacco Control Program was the one who informed the Health Department of this violation . Mrs . von Hone spoke about the State regulations that are taking effect on June 1 , 2020 . The flavored tobacco violation would only fall under the local Board of Health regulations, which would require a $ 100 fine . According to the State regulations, a sale to a minor would be a $ 1000 fine . This would be a second violation in accordance with the Town regulations . DJ Wilson , Tobacco Control Director for the Massachusetts Municipal Association and Cheryl Sbarra , Senior Staff Attorney for The Massachusetts Association of Health Boards suggested sticking with the Town regulations for now until the state comes out with their guidance documents . Dr . Scherzo spoke about the federal law that went into effect in December and stated that they only issue a warning for a 1St violation . 5 . Informational update on Subdivision plan revisions for 382 Satucket Road Mrs . von Hone stated that this agenda item was informational only . She explained to the Board that it went to the Planning Board for approval on Jan 8 , 2020 . Peter Johnson , Brewster Conservation Trust member stated that they had been waiting for a sign off from Land Court . He stated that there will be an easement on the deed for the new septic to be installed further than 300 feet from the pond . He has a copy of the well water testing results which he will forward to the Health Department . He asked about the septic upgrade . Mrs . Graczewski stated that there was a provision in the approval that they would have 2 years to upgrade the septic (from the date of the closing ) . Dr. Scherzo stated that groundwater flow is parallel to the way they have the septic and suggested that they should make it perpendicular which would help with the phosphorus . Mr. Ford liked what Dr. Scherzo said but stated that it would be voluntary and not a requirement . 6 . Consent Agenda Peter & Carol Trull — Title 5 inspection 300 ' Pond Setback Variance, 18 Elbow Pond Drive Motion : Approve the consent agenda as proposed . Motion : Penny Hausser Holeman Second : Lucas Dinwiddie Vote : 5 - 0 - 0 Action : Motion carried 7 . Liaison report Dr. Scherzo stated that the Friends of the Dog Park group did send a letter to many town officials saying that Gages Way field is not an appropriate place for a dog park. The Dog Park Development Committee will be meeting soon . 8 . Informational items Noted . Meeting adjourned at 7 : 30PM
