S ., C . H .O ., Health Director and Tammi Mason, Senior Department Assistant 1 . Chairman 's announcements On November 27, 2019, Governor Baker signed a bill banning the sale of all flavored tobacco products including E -cigarettes, menthol cigarettes and chewing tobacco . The Ban on the sale of vaping products took effect on November 27th 2019 and the ban on the sale of more traditional tobacco products will take effect on June 1 , 2020 . In addition, the bill will add an excise tax of 75 % on wholesale of E - cigarettes and devices bringing parody with cigarettes in the state and will also increase fines for sales to minors . The VNA free wellness clinic which has been offered at the Brewster Ladies Library for the past 15 years will be moving across the street to the Council on Aging . All clinics will be held on the 4th Tuesday of the month from 10AM until 12 :OOPM . There will be no clinic in December. Clinics will resume on January 28, 2020 at the new location . Citizens forum There was no one present for this item . 3 . Subdivision approval for 382 Satucket Road Mrs . von Hone explained to the Board that one of the requirements when a new sub - division is going before the Planning Board is that the BOH review the subdivision plan and make recommendations to the Planning Board . This property at 382 Satucket Road is currently a single lot which consists of a single family dwelling with an apartment that is situated close to Upper Mill pond . The owners are in the process of obtaining approval of a proposed subdivision plan . The majority of this lot is going to be separated into a lot to be purchased by the Brewster Conservation Trust. The existing house that will be on proposed Lot B had a septic inspection this past BOH 12/4/2019 Minutes Page 2 spring which failed because the existing leaching pits were not 300' from the pond . The owner did come before the board previously for a variance for the existing leaching pits that was denied so they will need to upgrade the system . When Mrs . von Hone did a review of the property history, the way the lot lines have been configured on this proposed subdivision, the new septic system, that is going to be required for the existing house, is not going to meet the 300' setback to edge of pond . Other than that, everything else that would be applicable to this property, i . e. it is in a zone II and has a private well, would limit the property on the number of bedrooms based on the square footage of the lot. The lots are being configured so that there is still enough land left on lot B, which is where the house will be, to accommodate the number of bedrooms that are currently there, which is 4 . The only issue is that they can 't meet the 300' setback to edge of pond . Mrs . von Hone has spoken to the engineer that did the subdivision plan in addition to Mark Robinson who is representing Brewster Conservation Trust with the negotiations . The last correspondence she received from Mr. Robinson was that the deed for the land that will be owned by the Brewster Conservation Trust will include an easement in favor of lot B 's dwelling , which will allow for minimal intrusion to allow the leaching field to meet the 300 ' setback requirement. Dr. Scherzo stated that if they can move the system beyond the 300 feet it would satisfy the Board ' s regulation and he would be in favor of this . He spoke about using pressure dosing or drip dispersal systems . He thinks that they should require an easement. Mrs . Graczewski stated that in addition to requiring the subdivision plan accommodation to allow lot B 's septic system to be 300' from the pond, the well water on lot B will have to be tested and as a P requirement, the system should be replaced within 2 years . Mr. Ford thinks they should have to upgrade the system before the sale takes place . Mrs . von Hone stated that she thinks that a closing date is already scheduled . Mrs . von Hone stated that they are not technically selling their lot. Mrs . Graczewski stated that they are selling a part of the property and making lot B a non - conforming lot. There was back and forth discussion on this. Motion : Approve the subdivision application for 382 Satucket Road with the following requirements : 1 . The existing well must be tested to confirm potability for human consumption if the well is to remain as the primary source of drinking water. 2 . Accommodations must be provided for the septic system servicing the dwelling on lot B to maintain the minimum 300' setback between the closest leaching facility and the closest pond edge and the existing or proposed wells as required in the local Brewster regulations with regards to upgradient or downgradient positioning, relocation of lot lines or creation of a septic easement may be required . 3 . The system on lot B must be replaced within 2 years of the Planning Board 's approval of the subdivision . Motion : Joe Ford Second : Penny Hausser Holeman Vote: 5 -0 -0 Action : Motion carried 4. Review and approve minutes from 11 /6/19 & 11 /20/19 meetings There were a few changes the Board members pointed out. Motion : Joe Ford Second : Penny Hausser Holeman Vote: 5 - 0 -0 Action : Motion carried Dr. Scherzo spoke about item #5 (Informational items) in the 11 /20/ 19 meeting minutes . He believes that the statement Ms . Hausser Holeman made about the residents voting to approve a bylaw banning plastic bottles was incorrect, The Town actually voted to ban Town personnel from purchasing single use plastic bottles for distribution as of September 15, 2020 . Motion : Approve the 11 /20/19 minutes with corrections . Motion : Joe Ford Second : Penny Hausser Holeman Vote: 5 - 0 -0 Action : Motion carried 5 . Topics the Chair did not anticipate Scherzo . stated the _he= attended the PainQ5 ,Creek Limited Liability Corporation 's community,outr_each : meeting recently. They are trying to see if they can put an adult use Marijuana facility next to Luke's Liquors in one of the attached buildings . They seem to think that the Town is not limited to 1 facility. There is another problem which is that it is not a stand - alone facility. They will be coming before the Planning Board next Wednesday. Mrs . Graczewski asked if the Board would like to entertain discussion about transferring some of the authority for approving subdivisions to the Health Director or the Health Department. There can 't be any discussion tonight as it is not on the agenda . It would need to be placed on the next agenda if the Board wants . Mr. Ford stated that he thinks it is important for residents to understand that there is a difference between the Board of Health and the Health Department, 6 . Liaison reports Ms . Hausser Holeman stated that she went to a Recycling Committee meeting on November 21 , 2019 and their next meeting is January 16, 2020 if this Board has anything they would like to communicate with them . i Dr. Scherzo stated that the Select Board is reviewing and chartering a path forward for the dog park now that it has been determined that the Dog Park Committee can't go any further.
