Chairman 's announcements The CDC has predicted that this year' s flu season to be the worst since 2003 . There are two main strains, Influenza A and Influenza B. Both have been included in this year' s flu vaccine. Flu vaccines can still be obtained at your local pharmacy and the Board encourages everyone to get their flu shot . The 2019 Coronavirus is a new virus that we've been hearing a lot about in the news lately. It is a respiratory virus first detected in China that has resulted in thousands of confirmed human infections, 99% of which have been in China . The virus is spread through respiratory secretions, such as droplets from coughs or sneezes . Mrs. Graczewski participated in a conference call hosted by the Massachusetts Department of Public Health on February 31, at which time they stated that there was 1 confirmed case in Massachusetts. The infected individual had been traveling in China, he self- reported his symptoms and he was under quarantine at the time of the call . Epidemiologists from DPH confirmed the risk remains very low for Massachusetts residents at this time. People should take the same precautions for the Coronavirus as they would for the regular flu . On December 27, 2019, the Department of Environmental Protection proposed revisions to the Drinking Water Regulations that would establish a new regulatory drinking water standard or a Massachusetts maximum contaminant level for Per- and Polyfluoroalkyl Substances . These revisions would establish a minimum contaminant level of 20 parts per trillion for the sum of concentrations of a group of 6 specific PFAS . The proposed standard is supported by recent scientific developments in understanding the health effects of PFAS and it' s aligned with PFAS cleanup standards promulgated by the Waste Site Clean Up program . The public comment period for this regulatory amendment that would create a Massachusetts maximum contaminant level for PFAS closes on February 28, 2020 at S : OOPM . The Barnstable Clean Water Coalition is hosting its annual series of free educational seminars called "Clean Water Wednesdays" at the Cape Cod Brewery. The seminar that they held on January 29th featured a local expert, George Heufelder of Mass TC and John Smith of Klean TU for a discussion on I/A technology. Mrs . Graczewski did attend the seminar and found it worthwhile and encouraged people to look at the upcoming agenda items on the Barnstable Clean Water Coalitions website . BOH 2/5/2020 Minutes Page 3 1 . SAS to be 8' from a Bordering Vegetated Wetland The plan was revised January 28, 2020. The home is being purchased by the Lavelle' s . They are proposing to demolish the existing 2 bedroom home and reconstruct a new 2 bedroom home in a different footprint. This is a low lying property and groundwater is very close to the surface . There are a lot of wetlands on the property and across the street. The house is currently on private well and has a cesspool . They will be connecting to town water. A Micro FAST 0. 5 unit to provide de - nitrification and Perc Rite technology (drip dispersal) will be installed . The elevated leaching facility will be contained by a concrete vault, 3 . 5 feet above the finished grade . They are proposing to have a 4 foot separation to high ground water. Soil testing was done and silt loam and clay were found down to about 22 feet. A sieve analysis was done . They have been before the Conservation Commission and have gotten approval . They will be going before Zoning Board of Appeals for a special permit. Mrs . Graczewski questioned the study, playroom and work out room and asked if there would there be cased openings . Mr. O' Reilly stated that there would be 5 ' openings . Dr. Scherzo asked about a deed restriction requirement for the 2 bedrooms. Mr. O ' Reilly stated that there will be a 2 bedroom deed restriction recorded . Motion : Approve the variances as requested finding that this will provide better treatment and there is no other option as the lot is very small . A 2 bedroom deed restriction must be recorded and 5 ' cased openings will be in the 3 rooms that were noted . Motion: Penny Hausser Holeman Second: Carmen Scherzo Vote: 4-0-0 Action: Motion carried 6. Cumberland Farms — 2655 Main Street — Tobacco violations, 1 /2/2020 & 1 /3/2020 Mrs. Graczewski recommended that Board look at these violations under the local regulations and not the State's at this time. Nassar Boumghait, District Manager, Donna Belliveau, local manager and Harold Eastwood Regional manager were present. Mr. Eastwood stated that the flavored product was put on shelf in an error. He stated that the Manager has no control over what is ordered and it just ended up at the store by mistake and should not have made it onto the shelf. There is a fail -safe on the register and it would have been blocked for sale and couldn 't have been purchased . He stated that Cumberland Farms has instituted a new warehouse system so this won 't happen again . The company takes these things very seriously. He mentioned that the store did acquire a list of what is banned from the Health Department so that they can use it go by when orders come in . Mr. Eastwood stated that the company also takes a sale to a minor very seriously. New team members take a very in depth training . The sale to a minor was made by a new employee and the training should have been fresh in her mind . She has since been terminated . Cumberland Farms has a zero tolerance policy. Cumberland Farms also does their own internal checks and if a sale is made, termination is immediate. Mr. Eastward stated that it was very concerning that there were 2 violations in a row. His hope is that they will get a fine and maybe postpone the suspension if possible. Ms . Hausser Holeman asked if they knew the particulars of what happened . Ms. Belliveau stated that there is no audio on the film so she could not hear what was being said but it did appear that the customer was not asked for an ID. Mr. Dinwiddie stated that he thought it was great that they were instituting all these fail - safes but believes that rules are made for a reason and the Board should fall back on the regulations that they have. Dr. Scherzo believes that the Board should do what has been done in the past, which includes fining and loss of license. He also stated that under new State Regulations, these could be a $ 1000 and $ 2000 fine but the board is not going to go by the State regulations right now. Mr. Eastward asked if a postponement for the suspension would be possible and if no violations happen during that time, could the suspension not take place. Ms . Hausser Holeman stated that she was happy with the new measures that were in place. Graczewski stated that there was nothing to report from WQRC Dr. Scherzo stated that there is not much going on with the Dog Park Development Committee Ms. Hausser Holeman stated that the Recycling Commission met and discussed tougher PAYT trash bags, Drink Brewster Tap and the water station project. Mrs . Graczewski asked if there was anything to discuss that was not anticipated . Mr. Dinwidde asked about the variance request numbers for 235 Brier Lane . He stated that the numbers didn't add up correctly. Mrs. von Hone will make sure the correct numbers are on the variance approval letter. 11 . Informational items Noted .
