I am requesting all calls for service from 01/01/2015 to date request is complete, to the following businesses and/or
addresses:

I expect these records will include information like the nature of the call, the date and time of the call, and any incident report
numbers associated with the call if applicable, among other things. I am working under a deadline, and need these records as
soon as possible. I will be following up in three days to check on the status of this request.
Please let me know as soon as possible if any of the addresses provided are not in your agency’s jurisdiction.
Please let me know any costs associated with this request prior to executing it. Please provide the records in an electronic
format if possible.

The Town of Gulf Stream has received your public records request dated March 28, 2018. The
original public records request can be found at the following link:

The Town interprets your request for “calls for service” to seek incident reports for the property
at issue. Further, please be advised that the Attorney General’s Office has stated that upon
receipt of a public records request, the agency must comply by producing all non-exempt
documents in the custody of the agency that are responsive to the request, upon payment of the
charges authorized in Chapter 119, F.S. However, this mandate applies only to those documents
in the custody of the agency at the time of the request; nothing in the Public Records Act appears
to require that an agency respond to a so-called “standing” request for production of public
records that it may receive in the future. See Inf. Op. to Worch, June 15, 1995. Therefore, the
Town’s estimate covers records during the three-plus year time period of 1/1/2015 through the
date of your request on 3/28/2018. Based on this interpretation, the Town estimates that to
respond to your request will require approximately one hour of administrative support at $41.48
per hour, the labor cost of the personnel providing the service, per Fla. Stat. § 119.07(4)(d).
If the costs of producing these documents will exceed your deposit, the Town will provide you
with an initial production of responsive records and an estimate for the production of any
additional responsive records. If the costs of production are less than the deposit, the Town will
provide you with the responsive records and a refund.
(One hour @ $41.48) = Deposit Due: $41.48 in cash or check.
Upon receipt of your deposit, the Town will use its very best efforts to further respond to your
public records request in a reasonable amount of time. If we do not hear back from you within
30 days of this letter, we will consider this request closed.
