CALL TO ORDER Pursuant to Agenda posted August 5, 1988, Chairman Seibert called the meeting to order at 7:30 P.M. in the Council Chambers. 2. PLEDGE OF ALLEGIANCE TO THE FLAG: Vice - Chairman Muto led the Pledge of Allegiance to the Flag. 3. ROLL CALL: PRESENT: Commissioners Budds, Coolman, Griffiths, Muto, and Chairman Seibert Also Present: City Manager Koski, City Attorney Martin, Community Development Director Dawson and Senior Planner Saldana 4. CONSENT CALENDAR: Commissioner Coolman moved to approve the Consent Calendar, seconded by Commissioner Griffiths and carried unanimously. 5. UNFINISHED BUSINESS: None. 6. NEW BUSINESS: A. PUBLIC HEARING: TENTATIVE PARCEL MAP 19832 CONDITIONAL USE PERMIT 88 -935 Site: 6042 -44 Camellia Owner: Nicholas Olaerts, Inc. 120 Los Amigos Dr. Montebello, CA 90640 Applicant: Loren Phillips & Associates 1740 E. Huntington Dr., #206 Duarte, CA 91010 Request: Approval of a Tentative Parcel Map and Conditional Use Permit to allow the development of a four " Planning Commission Minutes Page 2 August 9, 1988 (4) unit residential condominium project on an 18,500 square foot site. Chairman Seibert asked if notices had been sent to the surrounding residences. Director Dawson stated notices were sent. He presented the Commission with background information on the project. He further stated the project does meet all of the stan- dards for condominiums. The applicant did not intend to form a Homeowner's Association. Staff has made it a condition in the resolution that a Homeowner's Association be formed in order to maintain a uniformity in the pro- ject. A video presentation was made at this time by Senior Planner Saldana. There being no questions from the Commission, the public hearing was opened. Bill King, 445 Pacific St., Tustin, made the point that the project is under density and would like to answer any questions from the Commission. There being no questions or anyone else to speak on the project, Commissioner Coolman moved to close the public hearing, seconded by Commissioner Griffiths. Commissioner Coolman feels it is a good project and appre- ciates the fact that they are going with one less unit and agreed it should maintain the CC &R's. Commissioner Muto stated there is ample open space and concurred with Commission Coolman's statement. Commissioner Budds agrees with the recommendation and felt the project would enhance the property. Commissioner Griffiths was also in agreement. Commissioner Coolman moved to approve Conditional Use Permit 88 -935 and Tentative Parcel Map 19832 as presented and the Negative Declaration, seconded by Commissioner Budds and carried unanimously. B. PUBLIC HEARING: TENTATIVE TRACT MAP 46590 CONDITIONAL USE PERMIT 88 -936 Site: 6029 -33 Camellia " Planning Commission Minutes Page 3 August 9, 1988 Owner: Applicant: Request: Rose Park International, Inc. 82 W. Palm Dr. Arcadia, CA 91006 Jin -Jie Yu 2457 Country Club Dr. Glendora, CA 91740 Approval of a Tentative Tract Map and Conditional Use Permit to allow the development of a six (6) unit condominium project on an 18,500 square foot site. Director Dawson stated that notices had been sent to area residences and presented the background information to the Commission. He stated the project is very similar to the one that was just approved. Commissioner Griffiths questioned the clearance of the second story overhang for fire department personnel. Director Dawson stated that the proposal was modified in order to allow enough room for Fire Department equipment. A video presentation was made at this time by Senior Planner Saldana. The public hearing was open. Engles Shen, 600 W. Main St., Alhambra, stated the present conditions of the property are poor and felt the project would be an improvement to the area. There being no one else to speak, Commissioner Griffiths moved to closed the hearing, seconded by Commissioner Muto. Commissioner Griffiths said it meets all conditions. Commissioner Budds stated the project is under density and would enhance the property. Commissioner Muto concurred with the statements made. Commissioner Coolman liked the detached units making them look more like single family residences. Commissioner Budds moved to approve Conditional Use Permit 88 -936 and Tentative Tract Map 46590 and the Negative Declaration for the reasons stated, seconded by Commis- sioner Coolman and carried unanimously. " Planning Commission Minutes Page 4 August 9, 1988 C. PUBLIC HEARING: CONDITIONAL USE PERMIT 88 -938 Site: 9237 Lower Azusa Road,Units C &D Owner: Moran Properties 177 E. Front St. Covina, Ca 91723 Applicant: Request: Pei Liang Liu 3059 Jackson Avenue Rosemead, CA 91770 A Conditional Use Permit to allow the operation of an automobile repair garage in the M -2, Heavy Manufacturing Zone. Director Dawson stated that notices had been sent. He presented the Commission with background information. He stated there presently exists a parking problem. Vehicles are being parked on the fire lanes thus causing conges- tion. Allowing another similar business would cause additional traffic. He stated that when the building was constructed a designation was made for half the units to be used for warehousing and the other half for industrial use. A video presentation was made at this time by Senior Planner Saldana. Commissioner Budds asked if the original 'plans showed a warehousing use and if the owner is the same. Director Dawson stated yes to both questions. He stated the owner was proceeding in good faith and was not trying to deceive the City. Commissioner Budds stated that the City has to keep check- ing on the problem. He asked if the owner has any respon- sibility. Director Dawson stated the owner has no responsibility at this time. The public hearing was opened. Larry Moran, 177 E. Front St., Covina, is the owner of the industrial units. He stated that the tenant in question has been notified verbally and in writing. The business' lease comes up for renewal within the month. He feels once this tenant is gone the problem will be resolved. He is confident that the applicant has taken some of these problems into consideration. " Planning Commission Minutes Page 5 August 9, 1988 Commissioner Muto stated that at 11:30 a.m. that day he visited the location and found 15 cars between units C & D and the wash. There was no way a car could get through. He asked Mr. Moran how he was going to eliminate this problem. Mr. Moran stated that the tenant in Unit B is the problem, and once gone the problem will not exist. Ron Gass, 91 42 Ardendale St. San Gabriel, is a consultant for opening auto repair shops. He stated the problem is with the tinting business because they do not have enough room inside. He asked the Commission not to judge them by what other businesses are doing. Commissioner Coolman asked Mr. Gass how many cars can be maintained inside the units. Mr. Gass said between 10 -12 cars. Commissioner Seibert asked what he proposed for the new customer that pulls into the shop and parks in front. Mr. Gass said that signs will be posted directing the customer to pull the car into the building. Commissioner Seibert asked about parts delivery. Mr. Gass stated the parts company will be instructed on the delivery parking. He felt that one car is not the problem. The problem is a number of cars are being left outside. He said the applicant wants to adhere to any of the conditions imposed by the City. Commissioner Griffiths asked about cars that need more time to repair and where they would be left. Mr. Gass stated that all cars will be inside, no cars will be left outside. Those to speak in opposition to the project: Anthony Carrean, 9245 Pitkin St., Rosemead, stated there are problems with noise, the regulation of business hours, loitering, and reckless driving. Rebuttal: Mr. Gass stated that business hours can be included in the lease as a condition. Commissioner Coolman moved to close the public hearing, seconded by Commissioner Budds. " " " Planning Commission Minutes Page 6 August 9, 1988 Commissioner Budds would like to see a business thrive. The owner has a problem with a tenant and he seems to be taking some action to remedy the problem. City Attorney Martin stated staff has recommended denial. If the Commission does not agree with the recommendation, staff would need to prepare a resolution with conditions which would mean a continuance. Commissioner Muto stated that both units C & D face the fire lane. The applicant would have to operate entirely inside. This is very difficult to believe it is the way it will work out. Commissioner Griffiths would like to see conditions of approval before denying the request. Commissioner Coolman felt the applicant was doing all they could to avoid parking problems. She felt the Commission should not deny a request based upon what another business has done. Commissioner Seibert stated that part of the problem is the distribution of warehousing and industrial business is not equal, and felt that the site and lay out was a prob- lem. Commissioner Seibert asked if the applicant had any objec- tion to a continuance. The applicant stated he had no objection. Commissioner Budds moved to continue the public hearing to August 23, 1988, so that staff can prepare conditions of approval, seconded by Commissioner Coolman. D. PUBLIC HEARING: ZONE VARIANCE 88 -943 Site: 6002 Cloverly Street Owner /Applicant: Robert Hepler 6002 Cloverly Street Temple City, CA 91780 Request: A Zone Variance to allow a portion of a single family residence within eight (8) feet from the street side property line in lieu of the required ten (10) foot setback. " " Planning Commission Minutes Page 7 August 9, 1988 Director Dawson presented background information on the project. The variance would allow the owner to construct a bay window no closer to the property line than an exist- ing fireplace. Commissioner Muto asked if this is a new building or a remodeling of an existing structure. Director Dawson stated that it is a remodeling of an existing residence. The public hearing was opened. Robert Hepler, 6002 Cloverly, stated there was an existing porch with steps where the bay window will be placed. Commissioner Coolman asked what the eave overhang was. Mr. Hepler stated the overhang is one (1) foot. Commissioner Coolman moved to close the public hearing, seconded by Commissioner Budds. All the Commissioners were in concurrence and had no problem with approving the zone variance. Commissioner Coolman moved to approve Zone Variance 88 -943, seconded by Commissioner Griffiths and carried unanimously. E. PUBLIC HEARING: CODE AMENDMENT - R-1 DEVELOPMENT STANDARDS Summary: The Planning Commission will consider an amendment to the Zoning Code that relates to devel- opment standards in the R -1 zone pertaining to required yard areas and height. Director Dawson stated that a notice was published in the newspaper and presented background information. City Attorney Martin asked if the scale would work if the lot was not level and how it would be measured. Director Dawson said the measurements would be from the sidewalk level. " Commissioner Coolman asked if the rear yard setback was to remain at 15 feet. " " " Planning Commission Minutes Page 8 August 9, 1988 Director Dawson said yes the rear yard will remain the same. He said staff sees a problem with the side yard setbacks. There are quite a few narrow lots in the City and this amendment may cause an increase in variances. The option would be to change the side yard and leave it at 5 feet. Commissioner Coolman would like to maintain the 10 foot side yard setback. The public hearing was opened. Carl Lublin, 4824 Birchland Place, stated that any exist- ing homes should be able to build second stories, but any new construction should be required to maintain 10 foot setback. Commissioner Muto moved to closed the public hearing, seconded by Commissioner Budds. Commissioner Griffiths was not comfortable with the side yard requirements for narrow lots. Commissioner Budds said it is not possible to satisfy everyone. He is prepared to deal with any variances that come before the Commission. Commissioner Muto stated when one comes across a narrow lot it is a substandard lot and is more subject to variances. He would be in favor of the amendment as pro- posed. Commissioner Coolman concurs with Commissioner Muto and would like to maintain the 10 foot setback. City Manager Koski stated that variances create a cost to the applicant and utilize much staff time and the City has a predominant number of 50 foot lots, but not many less than 50 feet. Commissioner Seibert felt that the Planning Commission should not pass an ordinance that would create additional variance requests. Commissioner Coolman moved to adopt the ordinance as written, seconded by Commissioner Muto. A roll call was requested. Commissioner Coolman - yes; Commissioner Muto - yes; Commissioner Griffiths - no; Commissioner Budds - no; and Chairman Seibert - no. The motion failed. " Planning Commission Minutes Page 9 August 9, 1988 Commissioner Budds moved to continue the item to the Planning Commission meeting of August 23, 1988 and di- rected staff to return with more alternatives for consid- eration, seconded by Commissioner Coolman. 7. COMMUNICATIONS: There were no communications. 8. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Brian Smith, 9814 Nadine St., making reference to Agenda Item 6C, stated that there are always cars lined up at 7 a.m. waiting for a repair shop to open. 9. MATTERS FROM CITY OFFICIALS: There were none. 10. ADJOURNMENT As there was no further business, Chairman Seibert adjourned the meeting at 9:20 p.m. The next regular meeting of the Planning Commission will be held Tuesday, August 23, 1988, at 7:30 P.M. in the Council Chambers, 5938 North Kauffman Avenue, Temple City.
