Mayor Murray called the "regular session to order at 7:00 PM; Roll call; Present: Jinsie Bingham, Adam Cohen, Terry J. Smith and John Lanie; Absent Mark Hammer. II. Public Petitions and Comments III. Special Requests A. Noise Ordinance Waiver 1. April 25 -26, 2009 -12:00 PM to 12:00 PM - Relay for Life — Raija Bushnell a. Motion by Terry J. Smith to approve as requested, second by John Lanie, unanimous approval. 2. April 17, 2009 - 6:00 PM to 8:00 PM, DPU Union Board, Spring Concert — Alex Luebbert, removed 3. May 16, 2009 — DePauw University Under the Stars 8:30 PM to 11:00 PM a. Angie Nally present for this request, Motion by John Lanie to approve as requested, second by Terry J. Smith, unanimous approval. 4. May 2, 2009 — 9:00 PM to Midnight -Figi Isle - Nicholas Johnson, Andrew Headley a. Motion by Adam Cohen to approve as requested, second by Terry J. Smith, unanimous approval. 5. April 30, 2009 — 6:00 PM to 9:00 PM — "Rooftop" Concert a. Motion by Adam Cohen to approve as requested if needed, second by Jinsie Bingham, unanimous approval. 6. April 18, 2009 — Fireworks at the Legion approximately 10:00 PM — request removed from agenda. B. Street Closure 1. Main Street a. Fair on the Square May 15, 2009 — 12 noon to 9:00 PM; May 16, 2009 — 9:00 AM to 9:00 PM and May 17 10:00 AM to 5:00 PM Indiana Street — first two blocks north of Washington St. and the first block south of Washington Street and Franklin Street the first two blocks west of Vine Street i. Motion by Jinsie Bingham to approve as requested, second by Terry J. Smith, unanimous approval. b. Farmers Market — beginning May 30, 2009 through October 31, 2009 every Saturday. Indiana Street first block north of Washington Street and Franklin Street first block west of Indiana Street aV i. Motion by John Lanie, second by Adam Cohen, unanimous approval. 2. May 2, 2009 - 9:30 AM to 11:30 AM — Veteran's Memorial Program — Brad Phillips Motion by Jinsie Bingham to approve as requested, second by Terry J. Smith, unanimous approval. IV. Department Reports A. Cemetery — Ernie Phillips B. Engineer - 1. Mayor Murray announced that we now have an engineer on staff; Garth Hughes with Civil Engineering. C. Fire Department — Bill Newgent 1. Adam Cohen asked for clarification on run report. Up for the month, down for the year. Terry J. Smith thanked Chief Newgent and staff for their quick response to a house fire on Ohio Street recently. D. Park and Recreation — Rod Weinschenk E. Planner — Shannon Norman F. Police Department — Tom Sutherlin G. Department of Public Works — Brad Phillips H. Water &Wastewater Department — George Russell I. City Attorney - Laurie Robertson Hardwick 1. Clarification on private parking lots and the repairing potholes; they are not in the jurisdiction of the City. Progress on land acquisition for People Pathway. V. Approval of Minutes A. Special Meeting, 1. Adam Coher February 5, 2009 motion to approve as presented, second by Jinsie Bingham, unanimous approval. B. Regular Meeting, March 12, 2009 1. Motion by Adam Cohen to approve as presented, second by Terry J. Smith, unanimous approval. VI. Old Business A. Steve Setchell — Sustainability Group 1. Steve Setchell present to answer any questions from the report presented to the Council at last meeting. "Plant a Row" program for those in need. Applied for Grant to be used for the Gardening project. Community wide energy conservation contest may be forthcoming. "Energy War" going on at DePauw University between dormitories. "Buy local" campaign in works with the Chamber of Commerce. As well as many other groups working on projects. Adam Cohen commented that this report is very comprehensive and he was very impressed with the presentation and support for this program. B. Chief's Restaurant special event and summer request 1. Mayor Murray reminded Council regarding this request. Council took under advisement a possible permanent beer garden at this establishment. Terry J. Smith asked to have this tabled until Mr. Geabes can be present. Page 2 of 4 VII. New Business A. Ordinance 2009 -2, An Ordinance- Amending Chapter 9 Of The City Of Greencastle Code Regarding Septage Rates, First Reading 1. Mayor Murray read this Ordinance in its entirety. George Russell spoke regarding this issue. Russell reported that the increase is necessary due to the cost of processing the septage and is still a significant savings to those utilizing this service. a. Motion by John Lanie to approve on first reading, second by Terry J. Smith, unanimous approval. b. Russell also addressed the water loss issue and has verified that meters are working properly. Still trying to narrow down where this loss is. B. Ordinance 2009 -3, An Ordinance Creating A Red Flag Policy To Identify And Prevent Identity Theft, First Reading 1. Mayor Murray read this Ordinance in its entirety after Attorney Hardwick spoke why necessary at this time. a. Motion by Adam Cohen to approve on first reading, second by Terry J. Smith, unanimous approval. C. Ordinance 2009 -4, An Ordinance Amending Chapter 4, Article 2, Division I, Sections 4 -20 and 4 -23 Of The Greencastle City Code, First Reading 1. Mayor Murray read this Ordinance in its entirety. a. Motion by Terry J. Smith to approve as presented on first reading, second by Jinsie Bingham, unanimous approval. D. Ordinance 2009 -5, An Ordinance Establishing A Greencastle Commission On Sustainability, First Reading 1. Mayor Murray read this Ordinance in its entirety. a. Motion by Jinsie Bingham to accept this Ordinance on first reading, second by Adam Cohen, unanimous approval. E. Ordinance 2009 -6, An Ordinance amending Section 8 -24 Of The Greencastle City Code Regarding Schedule Of Reserved Parking Spaces, First Reading 1. Mayor Murray read this Ordinance in its entirety. This request came to Council from the Senior Center due to a change in their meal delivery times. a. Motion by Terry J. Smith to approve this Ordinance as requested, second by John Lanie, unanimous approval. VIII. Approval of City Claims A. Motion by John Lanie to approve claims as presented, second by Terry J. Smith, unanimous approval. IX. Reports A. Mayor's Report 1. Updated Council regarding Rural Transit's use. Stimulus dollars applied for is Pavement to Pavement Rehabilitation Project approximately $250,000. Garth Hughes reported this project will be submitted this evening to the Crawfordsville Area and hoping that we will be approved for this project. This is a first come first serve basis grant. The grant is restricted to minor arterials and minor collectors. Page 3 of 4 2. May 2, 2009 Arbor Day Celebration encouraging Council and others to attend. R. Martin Umbarger, Adjutant General of Indiana will be in attendance for celebration and signing of Army Community Covenant Supporting Those Who Serve. 3. Neighborhood Revitalization meetings coming up and hopeful to have support from community. 4. Mayor Murray shared that the City will have a Relay for Life Team and encouraged everyone to come out for this most important event. B. Clerk- Treasurer's Report 1. Shared report with Council showing 2008 final numbers. C. Councilors 1. Terry J. Smith thanked Bob Campbell and Ed Wilson for the Special Olympics basketball program they recently were involved in. 2. Adam Cohen asked Council to consider giving permission for Mayor to approve Special Noise Ordinance Waivers and Street Closures. Asking Council for consideration of asking for reports from various Boards and Commissions on a quarterly basis for better connection to these boards empowered by this Council. 3. Jinsie Bingham commended Officer Bunten for his assistance recently on an incident she was involved with. X. Adjournment A. Motion by Jinsie Bingham to adjourn at 8:15 PM, second by Terry J.
