CALL TO ORDER: CITY OF TEMPLE CITY PLANNING COMMISSION MINUTES FEBRUARY 14, 1989 Pursuant to Agenda posted February 10, 1989, Chairman Seibert called the meeting to order at 7:30 P.M. in the Council Chambers. 2. PLEDGE OF ALLEGIANCE TO THE FLAG: Commissioner Budds led the Pledge of Allegiance to the Flag. 3. ROLL CALL: Present: Commissioners Budds,Coolman,Griffiths and Chairman Seibert Absent: Commissioner Muto Also Present: " City Attorney Martin, Community Develop- ment Director Dawson and Senior Planner Saldana Commissioner Griffiths moved to excuse Commissioner Muto for cause, seconded by Commissioner Budds. 4. CONSENT CALENDAR: Commissioner Budds moved to approve the Consent Calendar. Seconded by Commissioner Coolman and approved unanimously. A. APPROVAL OF MINUTES - Meeting of January 24, 1989 Approved as written B. MONTHLY CODE ENFORCEMENT REPORT - Month of January Received and filed 5. UNFINISHED BUSINESS: None " " " Planning Commission Minutes Page 2 February 14, 1989 6. NEW BUSINESS: A. PUBLIC HEARING: ZONE VARIANCE 89 -974 Site: 10517 KEY WEST AVENUE Owner: John Torres 10517 Key West Avenue Temple City, CA 91780 Applicant: Request: Beaver Builders 909 S. Glendora Avenue West Covina, CA 91790 A Zone Variance to allow a proposed second story addition with a 6'4" side yard setback instead of the required 10' side yard setback for a sin- gle- family residence in the R -1 Zone. Commissioner Seibert asked Director - Dawson if the no- tices had been sent. Director Dawson stated they had and continued with his presentation of the background information. The Commission viewed the video of the site narrated by Senior Planner Saldana. There being no questions, the public hearing was opened. Mrs. Torres, 10517 Key West, pointed out that at the time they applied the City allowed this type of project and would appreciate the Commission's consideration. There being no further comments Commissioner Coolman moved to close the public hearing, seconded by Commis- sioner Budds. Commissioner Budds stated that the timing was unfortu- nate, but felt that the 10 foot requirement is realistic and would deny the request. Commissioners Coolman and Griffiths and Chairman Seibert also agreed with Commissioner Budds. Commissioner Budds moved to deny Zone Variance 89 -974 based upon the findings listed in the attached resolu- tion, seconded by Commissioner Griffiths. " " " Planning Commission Minutes Page 3 February 14, 1989 Chairman Seibert informed the applicant of the 10 -day appeal period in which the Planning Commission decision may be appealed. B. PUBLIC HEARING: Site: Owner /Applicant: Request: ZONE VARIANCE 89 -975 9179 FORTSON DRIVE Stephen Huang 9179 Fortson Drive Temple City, CA 91780 A Zone Variance to allow a room addition, originally built without a permit, with a three (3) foot side yard setback instead of the re- quired five (5) foot side yard setback for a single - family residence in the R -1 Zone. Commissioner Seibert asked Director Dawson if the no- tices had been sent. Director Dawson stated they had and continued with his presentation of the background information. The Commission viewed the video of the site narrated by Senior Planner Saldana. There being no questions, the public hearing was opened. Those speaking in favor of the project: Miles McClan, 9173 E. Fortson Drive, lives in the house next door. He sees no problem with the applicant's request. There being no other remarks Commission Coolman moved to close the public hearing, seconded by Commissioner Budds. Commissioners Griffiths, Budds, and Coolman had no problem with the project. Chairman Seibert felt the previous addition could be corrected to conform with the code requirements. Commissioner Griffiths moved to approve Zone Variance 89 -975 with the conditions as shown on the attached resolution, seconded by Commissioner Coolman. Chairman Seibert stated the Zone Variance was approved and there is a 10 -day appeal period. After 10 days the applicant may apply for building permits. C. PUBLIC HEARING: CONDITIONAL USE PERMIT 88 -963 TENTATIVE TRACT 47106 Site: 8916 -22 LONGDEN AVENUE Owner /Applicant: . Request: Charles C. Wang et al 467 Oxford Street Arcadia, CA 91006 A Conditional Use Permit and Tentative Tract Map to allow the construction of an eight (8) unit attached condominium project on property zoned R -3, Heavy Multiple Residential. Commissioner Seibert asked Director Dawson if the no- tices had been sent. Director Dawson stated they had and continued with his presentation of the background information. The Commission viewed the video of the site narrated by Senior Planner Saldana. Commissioner Coolman asked if there was going to be some kind of sign stating that there is guest parking on the site. She sees it as a potential traffic problem if guests are not aware of the on site parking and park on the street. Director Dawson stated there was no condition to that effect, but that one could be imposed. There being no questions, the public hearing was opened. Ming Nang Chen, 404 E. Las Tunas, San Gabriel, stated that a lot of planning has gone into the project and feels it would be an improvement to the area. Chairman Seibert asked Mr. Chen if he read all the conditions and agreed with them. 1 Planning Commission Minutes Page 5 February 14, 1989 Mr. Chen stated that the applicant has read all the conditions and agrees with them. He also stated that the garages have doors on them and the guest parking is open. Chairman Seibert asked if there was some reason why a sign could not be put on the front wall. Director Dawson stated that a sign would be placed on the front wall and would be a condition on the resolu- tion if the Commission approves the project. Commissioner Griffiths asked about traffic in the area. Senior Saldana stated that the plans were reviewed by the Traffic Engineer and he found no complications. • There being no one else to speak, Commissioner Coolman moved to closed the public hearing, seconded by Commis- sioner Budds. Commissioner Coolman had no problem with the project and would approve it with the additional condition regarding guest parking. Commissioners Budds and Griffiths agreed that the pro- ject was acceptable. Chairman Seibert asked Mr. Chen if he had any problems with the new condition. Mr. Chen stated he did not. Commissioner Coolman moved to approve Conditional Use Permit 88 -963 and Tentative Tract Map 47106 with the additional condition of a "guest parking" sign seen from the street, seconded by Commissioner Budds. 7. COMMUNICATIONS: None 8. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Greg Mike of Beaver Builders, 901 S. Glendora, West Covina, did not understand the problem with the side yard setback proposed for the project at 10517 Key West (Zone Variance 89 -974). Chairman Seibert informed Mr. Mike that the project was denied because the project did not meet the side yard set- back. Also that the applicant may appeal the decision to the City Council within the 10 -day appeal period. " " Planning Commission Minutes Page 6 February 14, 1989 9. MATTERS FROM CITY OFFICIALS: None 10. ADJOURNMENT: As there was no further business, Chairman Seibert adjourned the meeting at 8:15 p.m. The next regular meeting of the Planning Commission will be held on Tuesday, February 28, 1989 at 7:30 P.M. in the Council Chamber, 5938 North Kauffman Avenue, Temple City.
