O ., Health Director, Tammi Mason, Senior Department Assistant; Joe Smith, Bennett Environmental, David Michniewicz, Coastal Engineering and Nirmal Acharya, Owner, Winslow Spirits & Things . 10 Chairman 's announcements A reminder again that the CDC is predicting that this year' s flu season will be the worst since 2003 . There are two main strains, Influenza A and Influenza B . Both have been included in this year' s flu vaccine . There is still time to get inoculated with the flu vaccine at your local pharmacy and we are encouraging residents to do so . Additional means of protecting yourself and others include washing your hands frequently with soap and water, covering your coughs and sneezes and staying home if you are sick to help curtail the spread of the flu to others , The 2019 Novel Coronavirus risk still remains low. They still 0 have issues from quaternary ammonia compounds . They are working with DEP on a return to compliance plan . They requested a 30 day extension . If they cannot get into compliance they will do an engineering study on the system , Mrs . Graczewski asked about them not testing the influent for nitrogen , Mr. Smith stated that there is no way to test incoming nitrates, BOH 2/ 19/2020 Minutes Page 2 Dr. Scherzo asked why some effluent levels are higher than influent levels . Mr. Smith stated that according to the 2018 data, the effluent was higher than influent due to quaternary ammonia . They will be doing a pumping next week. Dr. Scherzo asked if that would remove the wipes that have been flushed into system . Mr. Smith stated that it would . Joe Smith - Bennett Environmental — Pleasant Bay Health & Living Centers: Mr. Smith stated that the system is working well and is within the specifications required . David Michniewicz- Coastal Engineering - Brewster Landing : Mr. Michniewicz state that there were a few pieces of equipment that needed replacing in the last year, such as the Zabel filter. Wipes are still an issue, but the plant is operating fine. 4. Discussion on Tobacco Regulation revisions Mrs . Graczewski stated that Mrs . von Hone had been in touch with Cheryl Sbarra, Senior Staff Attorney & Director of the Tobacco Cessation & Prevention Program for MAHB and DJ Wilson and they are in process of writing up a sample regulation . Mrs . von Hone handed out an email that came today from MDPH with the latest correspondence regarding changes to the State' s regulations . She spoke about Mr. Dinwiddie' s questions, which she had spoken to Sarah McColgan, Tobacco Control person for MHOA about and these answers include a sample of the State's regulations (which are not complete at this point) . There was discussion on the following . There are new studies available for the Board to site in their regulations. Definition of the BOH included in regulation . Adding wintergreen, menthol and mint into prohibited flavors . Dr. Scherzo asked about disposable vaping products, he questioned if the Board should add the definition . Mrs . Graczewski thought it would be best to wait until the State regulations come out to see what they say. Ms . Hausser Holeman wants to add electronic nicotine delivery product. Mrs . Graczewski stated that the regulations have to capture what this board wants. Not necessarily to mirror what the State is doing . Ms . Hausser Holeman stated that it should be closely aligned with the state regulation . She had trouble going back and forth between the 2 regulations . Mrs . Graczewski stated that Brewster can be more stringent than the state, if something is missed in the local regulation they would still have to follow what the State says . Ms . Hausser Holeman spoke about the word " minor" and that is should just be 21 and over. A question about whether the Board should ban adult only retail tobacco store came up . Mr. Ford does not think the Board should ban them . Find out what the state says an adult only tobacco store definition is . Add not allow smoking bars" Mr. Ford stated that Massachusetts already has the strictest smoking law in the country. There' s no reason to i make the Town ' s regulation stricter. There were questions about what " incidental " meant with regards to an adult only retail tobacco shop . Mr. Nirmal Acharya, Owner, Winslow Spirits and Things stated he may be interested in having an adult only retail tobacco shop . BOH 2/19/2020 Minutes Page 3 Talk of new establishments not being within 500 feet of a school , Talk of keeping the permit limit to 10, Penalties should be the same as states , Talk about blunt wraps Talk about fines after the State comes out with their regulations . The Board agreed to hold off on revising regulations until they get some guidance from the State . 5. Approve minutes from 2/5/2020 meeting Motion : Approve minutes with minor corrections. Motion : Penny Hausser Holeman Second: Lucas Dinwiddie Vote: 5 -0-0 Action. Motion carried 6. Topics the Chair did not anticipate Dr. Scherzo asked about the new online permitting program that is supposed to be coming . Mrs . von Hone spoke about the time line. Dr. Scherzo asked about green burials. He thinks someone from the Board should be present when plotting out the sites with the DPW. The Board asked if Mrs. von Hone will reach out to the DPW. 7 . Liaison reports Mrs . Graczewski stated that the WQRC spoke about the BOH requirements for title 5 inspections . There will be a site review at Cape Sand and Recycling next month , Ms . Hausser Holeman stated that there had been no Recycling Commission meeting , Dr. Scherzo stated that Dog Park Development Committee will be meeting with the Select Board on March 2nd to discuss the direction the dog park is going in , The Friends of Brewster Dog Park have pledged $ 75, 000 to help fill the $ 200, 000 gap . He stated that they had spoken with Agway and they will hopefully be providing the dog mitts . Mrs , von Hone spoke about the meeting held between, Building, Health and Select Board' s office for a review on the process for approving temporary and mobile food permits . She also stated that she has been attending on - going committee meetings for the Pleasant Bay Alliance and wastewater issues . She spoke about the kick off meeting for the coastal resiliency studies and how it will play out over the next year. Health doesn't have a huge part in that, mostly Conservation and Zoning . Consultants will be looking at the Town's regulations and suggesting changes they may need for better protection . 8. Informational items Noted . Meeting adjourned at 9:00PM
