Appellate Fees Dispute
Dear Bob:
This letter is to confirm that the Town of Gulf Stream (the "Client") is engaging me to
perform a review and give an opinion on the reasonableness of appellate fees claimed in Town of
GulfStreani v. Martin E. O'Boyle, Case Nos. 4D16-2286 and 4D16-3634.
My work will be limited to performing a review and giving expert witness testimony, if
needed, by deposition, at trial, or both. I will work on this matter at a courtesy hourly rate of
$375/hour. If paralegal services are required, they will be billed at $180/hour.
My services will be provided and billed on an hourly basis. Invoices will be transmitted to
the Client on behalf of Pankauski Hauser PLLC (the "Firm"). The Firm bills for time in tenths of
an hour, rounded up to the nearest tenth, plus costs. Invoices are due and payable upon receipt.
We transmit invoices to the Client by e-mail each month. The Client agrees to carefully
review these invoices and to compensate the Firm for its services. The Client also authorizes the
Firm to incur ordinary costs related to the matter (sometimes including, for example, legal
research, postage, courier, commercial carrier, and printing/duplication/binding/scanning costs)
and agrees to reimburse Firm for costs.
This agreement does not become effective until it is signed and returned to the Firm.
Scanned, emailed, electronic, copied and .pdf s shall be treated as originals.
