MINUTES OF THE SELECT BOARD MEETING
DATE : February 24, 2020
TIME : 6 : 00 PM
PLACE : Brewster Town Office Building, 2198 Main Street
PRESENT : Chair Whitney, Selectperson Bingham , Selectperson deRuyter, Town Administrator Peter

Call to Order/ Pledge of Allegiance
Chair Whitney called the meeting to order at 6 * 00pm .
Moment of Silence for Michelle Tero
Chair Whitney held a moment of silence for Michelle Tero, a staff member who worked in the building
department for 14 years .
Citizens Forum - Members of the public may address the Select Board at this time fora period not longer than 5 minutes. The Select Board is unable to
respond to comments as it could be a violation of the state's Open Meeting Law which requires a specific topic to appear on the agenda for public discussion to
occur. A topic raised by a member of the public may be added to a future meeting agenda if deemed warranted by the Select Board Chair.

Early voting is being held this week, February 24 until February 28th from 8 : 30 until 4 : 30 . March 3rd is Election
Day at the Brewster Baptist Church from 7am -8pm . There was a ceremony for the anniversary of the flag
raising at Iwo Jima held at the Fire Department , Col . Walter Watson and State Rep Tim Whelan , and Buster

Waters were in attendance .

Presentation and Vote on FY21 Budget Recommendations of Health and Human Services Committee
Sean Parker, Chair of the Health and Human Services Committee has taken over for the former Chair Lisa
Perkins . They are recommending a 2 . 5 % increase in funding, or $ 121, 620 . 00, which is a $ 2, 986 . 00 increase
over last year . He reviewed the organizations prior year statistics, and the current funds that are
recommended to be allotted to each in FY21 . Selectperson Bingham asked about the Family Pantry and why
we had not be involved with them before . They had not applied in the past, and the committee has decided
to open it up to additional organizations . Selectperson deRuyter moved to approve the FY21 Budget
Recommendations of Health and Human Services Committee, Selectperson Bingham second . The Board
voted 3 -Yes 0- No .
Review Current Select Board Policy on Remote Participation and Vote on Recommended Changes
The issue of remote participation had come up recently in a planning board meeting working through the
Haven Center application . There are many land use boards that have hearings, which could extend past the
current select board policy of being able to attend only 2 consecutive meetings . This will allow any member
that participated in a hearing to continue to be involved in the hearing past the current policy . Remote
participation has increased . There is difficulty to have more than one member call in remotely . If a Board has
more that wish to do so they would be unable as the recommended change is having a 2 member cap .
Selectperson deRuyter asked if anyone was monitoring the actual usage of the policy and seeing if it is being
enforced . It is limited to a few committees, and the employees that staff those committees are aware of the
policy . They will follow up and the new version will be distributed to them . Selectperson deRuyter moved to
approve the recommended changes to the Remote Participation Policy, Selectperson Bingham second . The
Board voted 3 -Yes Mo .
6 30pm Public Hearing For a New Restaurant Annual All Alcoholic Beverages License ; BANDG , LLC, d/ b/a
Apt Cape Cod , located at 2149 Main Street — Regina Castellano
Selectperson Bingham read the hearing notice and opened the public hearing at 6 : 33pm . Regina Castellano
owner of Apt Cape Cod , and her wife addressed the Board . They have been at the location since November .
They originally had a seasonal liquor license, which has since expired . They are applying for a year round
license to keep the business open year round . They will only close for a week for a vacation , but otherwise

will be open at least 5 days a week . They have 2 staff members that are TIP certified . Selectperson deRuyter
moved to approve the Annual All Alcoholic Beverages License ; BANDG , LLC, d / b/a Apt Cape Cod ,
Selectperson Bingham second . The Board voted 3 -Yes 0- No .
Presentation and Vote on Fire Department SAFER grant application — Chief Robert Moran
Deputy Chief Kevin Varley and Chief Robert Moran are seeking approval from the Select Board to apply for
the SAFER grant . The Town ' s match would be covered by their budget the first year . Chief Moran has a plan
in his budget presentation on how to fund the positions . There will be a shift in call employment . it could
also be covered by the marijuana funding or the short term rental tax . He feels like the department critically
needs these positions, to have on a 5 member staff at all times . There is a potential for a firefighter 1 or 2
class at the Brewster Fire Station . Selectperson Bingham does not want to apply for the grant if they are not
going to go forward with it . She is hesitant about using the new marijuana or room tax . She is concerned that
if we apply for it and were awarded that the town match portion would not be able to be funded . The call
firefighters could be removed , and those funds could be swayed to the new positions . They are the busiest
department on Cape that still has a call department . Call firefighters are difficult to retain , as other
opportunities are more lucrative in surrounding towns . Mr . Lombardi noted that the final year is the only
non - specific funding source . There is ability to move funds within the internal budget process . Ambulance
revenues and fees have not increased in many years . In three or four years they will be in a better position to
do so, increasing revenue . Upcoming Capital projects are not large, and some of the ambulance funding
could be retained . Selectperson deRuyter noted the large revenue stream and the buffer of call wages . He is
in support with the caveat that the fire department will have to find a way to fund it internally . He has faith
with the deputy and the chief to run their department and do it the way they want to . Selectperson deRuyter
moved to approve the Fire Department applying for a SAFER grant, Selectperson Bingham second . The Board
voted 3 -Yes 0- No .
Presentation and Vote on Pilot Program to Host Firefighter I / II Academy
Barnstable County Fire Academy no longer conducts the academy due to the water contamination issues .
Chief Moran is willing to host the Firefighter 1/ II program at Brewster Fire Station . It would be a class up to 15
members . Insurance issues need to be worked out with Administration . Selectperson deRuyter wanted to
know about the facility use fee of $ 50, and if that would cover the fees of the program . There would be no
charge to the firefighters . The next closest facility would be Stowe or Bridgewater . There are no call
firefighter classes at these locations . Selectperson Bingham asked if there were call departments in the
surrounding towns . Brewster would be the bulk of the class . Selectperson deRuyter moved to approve the
pilot program to host Firefighter 1/ 11 Academy, with the contingency that the insurance issue was addressed ,
Selectperson Bingham second . The Board voted 3 -yes 0- No .

FY21 Budget Update, including Review and Vote on Proposed Appropriations to Brewster Affordable
Housing Trust Fund and Capital Stabilization Fund
Following up on the budget overview and all day sessions, Mr . Lombardi provided an update to the Board . A
few minor line item adjustments have been made . The major change was the actual assessment from Nauset
Regional which increased their line item by $ 450, 000 . 00 . Initially they had requested $ 350, 000 . 00, but due to
the increase in Nauset they have reduced the allocation of $ 150, 000 . 00 to the Capital Stabilization fund and
$ 150, 000 . 00 allocated to the Housing Trust from the Town Operating Budget . There would be a projected
$ 70, 000 . 00 remaining in the excess levy capacity . Selectperson deRuyter would like to see an ongoing
budgeted funding source for the Brewster Housing Trust, as he feels it will be critical for the success of the
Trust . He will be pushing for the Board to put in place a policy of seeking 50% of the short term rental tax to
be allocated to the Housing Trust . The share of the district increased due to a slight increase in total
enrollment . Selectperson Bingham moved the appropriations to Brewster Affordable Housing Trust Fund and
Capital Stabilization Fund , Selectperson deRuyter second . The Board voted 3 -Yes 0- No . Chair Whitney asked
for a vote to be re -taken with a full board present .
Review and Vote on Spring 2020 Capital and Special Project Article Recommendations
Page 161 of the Select Board agenda packet has a chart of capital and special project articles . The free cash
balance would be approximately $ 950, 000 . 00 after the expenditures . Selectperson Bingham moved the
spring 2020 Capital and Special Project Article, Selectperson deRuyter second . The Board voted 3-Yes 0- 1\10 .
Review and Vote on Warrant Article to Appropriate Available Free Cash Balance to Brewster Affordable
Housing Trust Fund and Capital Stabilization Fund
Selectperson Bingham moved to approve the Warrant Article to Appropriate Available Free Cash Balance to
Brewster Affordable Housing Trust Fund and Capital Stabilization Fund , Selectperson deRuyter second . The
Board voted 3 -Yes 0- No .
Continued Review of Spring 2020 Town Meeting Warrant Articles
One final citizen petition related to road betterments was submitted before the deadline . This is to increase
the vote from a simple majority to two thirds vote for road betterments . They will be invited into a future
meeting for discussion .

Selectperson deRuyter asked to have an article in regards to the Orleans Housing Trust, which was just
awarded a 2 million dollar line of credit from Cape Cod Five . The regular revenue stream was critical in
securing that for their potential future projects .
