HomeMy Public PortalAboutMinutes - 1989/10/10 - RegularCITY OF TEMPLE CITY PLANNING COMMISSION MINUTES OCTOBER 10, 1989 INITIATION: 1.';, CALL TO ORDER: Pursuant to Agenda posted October 6, 1989, Chairman Muto called the meeting to order at 7:30 P.M. in the Council Chambers. Chairman Muto introduced Kay Floyd as the new Commissioner, replacing Commissioner Coolman who had resigned. 2. PLEDGE OF ALLEGIANCE TO THE FLAG: Chairman Muto led the Pledge of Allegiance to the Flag. 3. ROLL CALL: Present: Commissioners Budds, Floyd, Seibert and Chairman Muto Absent: Commissioner Griffiths Also Present: City Attorney Martin, Community Develop- ment Director Dawson, and Assistant Planner Kates.. Commissioner Seibert moved to excuse Commissioner Griffiths for cause. Seconded by Commissioner Budds and approved unanimously. 4. CONSENT CALENDAR: Commissioner Budds removed Item B. Commissioner Budds moved to approve the Consent Calendar. Seconded by Commissioner Seibert approved unanimously. A. APPROVAL OF MINUTES - Meeting of September 26, 1989 Approved as written B. MZM Committee Meeting Location: 9855 Val Street • Planning Commission Minutes Page 2 October 10, 1989 City Attorney Martin reiterated that neighbors ob- jected to lack of notice in the neighborhood and to the variance itself. He asked if the Commission wanted to hear it as a new variance and send out notices to those with in 300 feet of the project. Commissioner Seibert stated that due to the fact the concern was not being noticed, it should be renoticed on a regular agenda. Director Dawson stated that could be done. Normally there is not this type of opposition and MZM's are normally only noticed to the contiguous properties, but in this particular case because of the concern of the neighborhood, it does seem warranted to .send notices to all property owners within 300 feet. Commissioner Seibert moved to have the case heard before the entire Commission and notices sent to property owners within 300 feet. Seconded by Commis- sioner Budds and approved unanimously. Commissioner Seibert thanked the audience for coming and expressing their concern. He reiterated that 300 feet notification was all that was required by State Law for a regular public hearing.. 5. UNFINISHED BUSINESS: None 6. NEW BUSINESS: A. PUBLIC HEARING: TENTATIVE PARCEL MAP 21254 CONDITIONAL USE PERMIT 89 -1000 Site: 4847 ARDEN Owner: MR. SHO KOSUGI 413 LONGDEN ARCADIA, CA 91006 Architect: FRED TORRES 4236 N. MAINE BALDWIN PARK, CA 91706 Request: To allow the development of a four (4) unit detached residen- tial condominium project for property within the R -2 Zone • Chairman Muto asked if the notices had been sent. " " Planning Commission Minutes Page 3 October 10, 1989 Director Dawson replied they had and presented the staff report. There were no questions of staff and the public hearing was opened. Fred Torres, 4236 North Maine, Baldwin Park, Architect for the project, stated he had read all the conditions and concurred with them. There was no opposition to the project. Commissioner Seibert moved to close the public hearing. Seconded by Commissioner Budds. Commissioner Seibert stated the project meets all the requirements. There is nothing to warrant denial of the request. He stated he was in favor. It is a cut and dried plan. Commissioner Budds concurred. Commissioner Floyd stated she had nothing to add and had no problem with the project. Chairman Muto stated he had no problem with the project. Commissioner Seibert moved to approve Conditional Use Permit 89 -1000 and Tentative Parcel Map 21524 based upon the findings and subject to the conditions of approval. Seconded by Commissioner Budds and approved unanimously. Chairman Muto informed the audience of the 10 day appeal period. B. PUBLIC HEARING: MODIFICATION OF C.U.P. 82 -668 Site: 9669 E. LAS TUNAS DRIVE Owner: KAISEN FANG 840 VOLANTE DRIVE ARCADIA, CA 91006 Applicant: Request: HSIU -YEN WANG 8031 ALPACA STREET SAN GABRIEL, CA 91770 A Modification of a Conditional Use Permit to allow extended hours of operation of a restau- rant. Chairman Muto asked if the notices had been sent. " " " Planning Commission Minutes Page 4 October 10, 1989 Director Dawson replied they had and presented the staff report. There were no questions of staff and the public hearing was opened. Darryl Yang, 9669 Las Tunas Drive, representative, stated they had applied for extended hours in order to draw more business. Dinner hour business has been slow. He stated they had a special connection with a Tour & Travel Agency overseas whereby the tours would come to the restaurant for late night snack and they had applied for extension of hours in order to accommodate the tours. He stated they wanted to run a better business. He indicated they would be willing to work with the City to improve conditions and avoid complaints from the neighborhood. Commissioner Seibert asked Mr. Yang if they were trying to get the tour business for later hours. He asked Mr. Yang if there would be buses pulling into the parking lot at 11:00 p.m. and 12:00 or 1:00 a.m. Mr. Yang said the buses would pull on the street. He was not sure where the buses would be parked. He stated that sometimes they would come by van. This is still in the working stages with the travel company. Commissioner Seibert asked why the tours come at that time of night. Mr. Yang stated it was the custom for Orientals, particu- larly those from Taiwan, to have a midnight snack after the tour. He indicated the restaurants in Monterey Park are open very late for the tour traffic. Commissioner Seibert asked if they had just purchased the restaurant and had escrow closed. Mr. Yang replied the new owner had purchased the restau- rant and the escrow was closed. Das Sheenh, 5612 Golden West, stated that all activity after 10:00 p.m. would cause inconvenience to the people in the neighborhood. Any one who purchases property or businesses should be aware of what they are buying. He stated the Planning Commission should take inconvenience to the neighborhood into serious consideration. People who are sleeping at 10:00 p.m. go to work at 8:00 a.m. and using a van at midnight would wake people up. Many people could be affected by this. He stated this should not be allowed in the City. " Planning Commission Minutes Page 5 October 10, 1989 Jack Hill, 5931 Kauffman, stated he could not see the long hours. The neighborhood went through that before and had nothing but people making disturbances at night, starting cars, arguments, etc. There is no reason for the late hours with the restaurant. He felt late night usage would be for the bar, not eating. Over half of the people in the neighborhood are senior citizens or people who have to get up early in the morning and go to work. He stated he was opposed to the modification. Commissioner Budds moved to close the public hearing. Seconded by Commissioner Seibert. Commissioner Seibert stated he had sat in on the original location in 1980 and having heard things that went on before, the people of the area had a legitimate complaint at that time about the noise factor and the rowdiness that was going on was the biggest concern. At that time there was a policing problem. He stated he did not foresee a policing problem, but did foresee a lot of noise. He envisioned buses pulling up, most buses are diesels, diesels are noisy, and at 12:00 midnight it would be very noisy to the residents living in proximity to the loca- tion. He stated he could not in good conscience vote to extend the hours of operation for those reasons. There is no purpose, for tours especially, coming in to the city at 11:00 and 12:00 at night. The City does not need business that badly. The people who purchased the restaurant should have looked at this and made it a condition prior to purchasing the location. He stated since he was a business man himself, he appreciated the need to operate at a profit, but consideration has to be given to the neighborhood. He was not in favor of granting the exten- sion. Commissioner Budds stated this condition of staff's prior recommendation of 10:30 p.m. was well known in advance of the purchase and to modify it to basically allow buses to come into the neighborhood until 1:00 a.m. is not good business for the City. He was in favor of denying the request. Commissioner Floyd stated she was also in favor of denying the request. The noise level would be compounded by the groups arriving together. Chairman Muto concurred. Commissioner Seibert moved to deny Modification of Condi- tional Use Permit 82 -668 for the reasons stated. Seconded by Commissioner Floyd and approved unanimously. Planning Commission Minutes Page 6 October 10, 1989 • Chairman Muto informed the applicant of the appeal proc- ess. • • C. PUBLIC HEARING: CONDITIONAL USE PERMIT 89 -1017 Site: 9144 E. LAS TUNAS DRIVE Owner /Applicant: WEI -HAN CHOU, M.D. 2403 SAN GABRIEL BLVD ROSEMEAD, CA 91770 Engineer: Request: SIMON LEE 365 WEST GARVEY AVE, STE 203 MONTEREY PARK, CA 91754 To allow a 2,750 square foot two story retail /office building with three (3) separate units in the C -2 Zone. Chairman Muto asked if the notices had been sent. Director Dawson replied they had and presented the staff report. He stated that staff was in the process of re- viewing the application and compiling the recommended conditions of approval and one of the conditions received from the Public Works Division was a requirement for a 10 foot dedication. That created a particular problem in that it would require redesign of the building. The applicant was contacted after the notices had been sent. The applicant indicated a desire not to dedicate the 10 feet and presented arguments to support that position. Basically, at this juncture, staff would be agreeable to a continuance of this case to a date uncertain in order to meet with the applicant, his architect, the property owner and the City Manager, Traffic Engineer and Public Works Coordinator and see what would be an equitable resolution to this problem. He stated that applicant's representa- tive was in the audience. The staff's recommendation is to require the 10 foot dedication if any action is taken at this meeting. Chairman Muto asked if Director Dawson's recommendation was to continue the hearing. Director Dawson replied it was and that the hearing would be renoticed. Simon Lee, 365 West Garvey Avenue, #203, Monterey Park, Architect, stated he had no problem with a continuance. He stated it would provide more time to discuss the pro- ject with City staff to find the best solution. He stated that for information purposes, the lot was not large and a " Planning Commission Minutes Page 7 October " 10, 1989 10 dedication would make the project not feasible. He stated that Dr. Chou had proposed to build a two story building with office space for himself and also retail and office retail. Currently, Loma is 50 feet wide, further down it is 60 feet wide. On the north side of Las Tunas, Loma is 50 feet. Chairman Muto asked if Mr. Lee would object to a continu- ance. Mr. Lee stated he would not. Commissioner Floyd asked about the handicapped parking that seemed to be a distance from the entrance to the proposed building. She stated that any possible redesign should provide easier access to the elevator or entrance for the handicapped. Commissioner Budds moved to continue the public hearing on Conditional Use Permit 89 -1017 to a date unspecified. Seconded by Commissioner Seibert and approved unanimously. 7. COMMUNICATIONS: " None 8. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Das Sheenh, 5612 Golden West, talked about the Floor Area Ratio. He stated he had read in the paper about increasing the F.A.R. in the R -1 area to 35 or 40% He requested the Planning Commission and staff reconsider increasing to 40% or 45% for the R -1. He stated he understood the concerns of neighbors about the building of large homes next to them. But he felt that good professionals who wanted to come to the City are being penalized. He stated there should be limits on the side yard setbacks and the front and rear yards. People do not need to build humongous homes, but a reasonably good home. There are too many small lots in the City. He stated that if someone next door to him wanted to build a nice two story home he would have no objections as it would upgrade the neighborhood. He stated his request for consideration would be 45% for either single or two story home in the R -1 and very strict on set- backs. Chairman Muto informed him that it could not be considered at this time. " " Planning Commission Minutes Page 8 October 10, 1989 Mr. Sheenh stated he was aware they could not discuss it at this time, but when it does come up for discussion he would like it considered. He further stated the City needs good professional people living here. 9. MATTERS FROM CITY OFFICIALS: None 10. ADJOURNMENT: As there was no further business, Chairman Muto adjourned the meeting at 8:15 p.m. The next regular meeting of the Planning Commission will be held on Tuesday, October 24, 1989 at 7:30 P.M. in the Council Chamber, 5938 North Kauffman Avenue, Temple City.
