Specific information and the general guidelines for remote participation by members of the public and/or parties with a right and/or requirement to attend this meeting may be found on the Town’s website at www.brewster-ma.gov. For this meeting, members of the public who wish to listen to the audio broadcast may do so via the Town of Brewster livestream at http://livestream.brewster-ma.gov or on Channel 18. No in-person attendance of members of the public will be permitted, but every effort will be made to ensure the public can adequately access the proceedings in real time via technological means. The Town has established specific email addresses for each board and committee that will be meeting remotely so that residents can send their comments in writing either before or during the meeting. Please send comments for Planning Board meetings to planningboardmeeting@brewster-ma.gov. In the event we are unable to live broadcast these meetings, despite best efforts, we will post on the Town website an audio recording, transcript, or other comprehensive record of proceedings as soon as possible after the meeting.” AGENDA 6:00 PM PUBLIC HEARING Application #2020-03: On behalf of Eversource Energy, Kyle Barry will be discussing the 2020 Eversource Energy Vegetation Management Plan. In compliance with MGL Chapter 87, Section 14, the Planning Board and Tree Warden will hear the proposal for selective tree pruning on electric circuits 4-89A-553, 4-89B-573, 4-89B-618, and 4-89B-946. These circuits include the following designated Scenic Roads: Stony Brook Rd, Red Top Rd, Satucket Rd, Slough Rd, Rte 6A, Paines Creek Rd, Lower Rd, Robbins Hill Rd, Brier Lane, Tubman Rd, Point of Rocks Rd, Foster Rd, Cathedral Rd, and Old North Rd.Additionally, the potential for off-schedule hot spot pruning on all scenic roads may be necessary as issues are identified. Building Department Comments received from Victor Staley, Building Commissioner  The Building Department has no concerns with regard to the Eversource Energy proposed tree trimming. Conservation Com.Comments received from Noelle Aguiar, Conservation Administrator  Eversource has come through the Administrative Review for approvals for trees to be pruned/removed within 100 feet of wetlands and they were granted approval. Roberta Barrett and Kari Hoffmann were not present. Also present: Ryan Bennett, Town Planner and Lynn St. Cyr, Senior Department Assistant. The Chair read the Recording or Taping Notification: “As required by the Open Meeting Law we are informing you that the Town will be audio and video taping this public meeting. In addition, if anyone else intends to audio or video tape this meeting he or she is required to inform the Chair.” 6:00 PM CITIZEN’S FORUM No citizen comment. 6:01 PM PUBLIC HEARING Special Permit and Site Plan Review Application #2020-01: Applicant: Nature’s Alternative, Inc. Owner: Larry and Susan Lepard. Representative: Attorney Mark Boudreau, Boudreau and Boudreau, LLP for property located at 1195 Long Pond Road and shown on Assessor’s Map 85, Lot 111 in the Commercial High Density (C-H) and Residential Medium Density (R-M) zoning districts. The Applicant proposes to establish a retail Recreational Marijuana Establishment pursuant to §179-11, §179-38.2, §179-51, and §179-64 of the Brewster zoning bylaw. The Applicant is also seeking a special permit to use a portion of the residentially zoned area for parking pursuant to §179-5E of the Brewster zoning bylaw. Documents:  02-26-20 Letter from Attorney Mark Boudreau Attorney Mark Boudreau of Boudreau and Boudreau, LLP was present on behalf of the Applicant. Boudreau requested to withdraw the application without prejudice. Motion by Wallace to Accept Request to Withdraw Without Prejudice on Special Permit and Site Plan Review Application #2020-01. Second by Degen. Vote: 5-0-0. 6:05 PM PLANNING DISCUSSION Review written decision for The Haven Center, Inc. Site Plan Review Application #2019-21. The Board reviewed the revised written decision, comments on the decision received from Attorney Ben Zehnder, a revised site design plan and revised landscape and lighting plan. The Board decided to remove language in condition #1 regarding the Building Commissioner’s determination of de minimis changes. Motion by Chatelain to Approve Written Decision on Site Plan Review Application #2019-21, as discussed and amended. Second by Taylor. Vote: 5-0-0. 6:10 PM CITIZEN’S FORUM REOPENED Suzanne Watson, 435 Sheep Pond Drive, expressed concern about the Long Pond Woodlands property recently purchased by the Town. Watson believes the property should be classified as a public park and protected under the 500’ buffer zone requirement of the recreational marijuana bylaw. The property is within 350’ of the proposed recreational marijuana retailer on Long Pond Road. Watson does not agree with the legal opinion prepared by KP Law and would like the Long Pond Woodlands to be considered a public park and used as such. Approved: Vote: PB Minutes 02/26/2020 Page 2 of 3 Richard Watson, 435 Sheep Pond Drive, asked the Board to take the information presented by Suzanne Watson to town administration. Watson stated that the property should be managed the way the town chooses to manage it. Fred Budreski, 157 Sheep Pond Drive, thanked the Board for their work and asked if they could help direct residents to the appropriate town authorities to speak to regarding the current Conservation Restriction on the Long Pond Woodlands property and consideration of the property as a public park. Hillis-Dineen suggested residents could follow-up with the Planning Department regarding concerns over the Long Pond Woodlands property. A woman who did not identify herself asked about the process to change the zoning district in this area of Long Pond Road. Bennett stated that an amendment to the zoning bylaw could be brought forward to Town Meeting for consideration. 6:22 PM PUBLIC MEETING CONTINUED Site Plan Review Application #2019-28: Applicant/Owner: The Latham Center, Inc. Representative: Jeff Kevan of TFMoran, Inc. for property located at 1439 Main Street and shown on Assessor’s Map 48, Lot 61 in the Residential Medium Density (R-M) zoning district. The Applicant proposes site improvements including renovating and expanding the existing facility and parking areas pursuant to Section 179-64 of the Brewster Zoning Bylaw. (Continued from January 22, 2020.) Documents:  Draft Site Plan Review Approval  02-20-20 Site Plan Layout  02-20-20 Grading & Drainage Plan  02-20-20 Detail Sheet  02-20-20 Lighting Plan  02-21-20 E-mail from Jeremy Belanger Jeff Kevan of TF Moran was present on behalf of the Applicant along with Brad Benavides, Director of Facilities for the Latham Center. Kevan reviewed the changes made to the plans including the addition of a bike rack, a note regarding site lighting, the relocation of three light poles, erosion and sediment control measures added to the drainage plan, the relocation of the handicap parking space, and a revised parking calculation for auditorium seating. The Board reviewed the draft decision and made additional edits to finding #2 to note the handicap parking and bus stop drop off spaces. Motion by Taylor to Approve Site Plan Review Application #2019-28,as discussed and amended. Second by Wallace. Vote: 5-0-0. 6:30 PM PLANNING DISCUSSION CONTINUED Approval of Meeting Minutes: February 12, 2020. The Board reviewed the February 12, 2020 meeting minutes. Motion by Chatelain to Approve February 12, 2020 Meeting Minutes. Second by Degen. Vote: 5-0-0. Wallace asked if there was any plan to add sidewalks on Route 6A heading towards Orleans. Degen suggested Wallace may want to ask the Bikeways Committee for that information. Committee Reports. Chatelain summarized applications reviewed at a recent WQRC meeting. Degen summarized the February 24th Select Board meeting and noted changes made to the remote participation policy including that Board members will be allowed to participate in continued applications. PB Minutes 02/26/2020 Page 3 of 3 Taylor reported that the Community Preservation Committee is working on revising the open space and recreation plan with help from consultant Horsley Witten. A survey for residents will be available on the town website. Wallace announced that he was appointed by the Select Board to the Vision Planning Committee. Hillis-Dineen announced that there will be a community engagement session on the Millstone Road housing project on March 10th at 6 pm at the Brewster Ladies Library. Motion by Taylor to adjourn.
