CALL TO ORDER Pursuant to the Agenda posted January 9, 1990 Vice - Chairman Griffiths called the meeting to order at 7:30 p.m. in the Council Chambers. 2. PLEDGE OF ALLEGIANCE TO THE FLAG Vice - Chairman Griffiths led the Pledge of Allegiance to the Flag. 3. ROLL CALL: Present: Commissioners Budds, Floyd, Seibert and Vice - Chairman Griffiths Also Present: City Manager Koski, Community Development Director Dawson and Associate Planner Kates Commissioner Seibert moved to excuse Chairman Muto for cause, seconded by Commissioner Budds and unanimously carried. 4. CONSENT CALENDAR: A. APPROVAL OF MINUTES - Meeting of December 12, 1989 B. MONTHLY CODE ENFORCEMENT REPORT - Month of December Commissioner Seibert moved to approve the Consent Calendar, seconded by Commissioner Budds and approved unanimously. 5. UNFINISHED BUSINESS: None Planning Commission Minutes Page 2 January 9, 1990 6. NEW BUSINESS: A. STUDY SESSION ITEM PROPERTY RESALE INSPECTION PROGRAM Commissioners will discuss the merits of a property resale inspection program. If such a program is to be further considered, specific program parameters and procedures should be discussed by the Commission. City Manager Koski stated that it was not expected that the Planning Commission make a recommendation at this time. Commissioner Seibert stated that he personally was against the program. Director Dawson presented the background information stating that this item has been under study for many months. The primary focus of the program would be to identify illegal units. Commissioner Budds asked what types of violations would the inspector look for and also what problems other cities have had with this program. Director Dawson stated that Monterey Park's ordinance became effective in 1976. This city found an occasional illegal unit, but mostly illegal room additions which sometimes created a need for a zone variance. In such cases it was often difficult to make the necessary findings for approval. Commissioner Seibert felt the real estate agents and mortgage companies are verifying if the structures were legal. He felt it was being sufficiently handled by the private sector and would be an infringement on the public. Commissioner Budds stated that on the other hand you get situations when people construct illegal additions.. Commissioner Seibert again stated that this was being done before the sale. He also asked what was the City going to do about setback problems. Commissioner Budds stated that the City would have to verify if the units were legal. • " " Planning Commission Minutes Page 3 January 9, 1990 Commissioner Floyd asked what kind of time would be involved to complete this inspection and if it would add to the escrow time. Director Dawson did not feel it would extend escrows under normal circumstances and that an inspection would typically take 30 to 45 minutes. Commissioner Budds asked how would the City determine an illegal room addition without taking the time to research the permits. Director Dawson stated that there are some cases when no permits are on file and the units are legal. Commissioner Floyd asked what generates a code enforcement complaint. Director Dawson stated that usually a citizen initiates the complaint. Commissioner Floyd asked if these complaints were uncovering illegal units or additions. Director Dawson stated that most complaints were for property maintenance. Commissioner Floyd asked if the Code Enforcement Program was sufficient and if there was a required time frame to correct any problems with illegal units. Vice- Chairman Griffiths stated that if the saler does not correct the problem then the buyer will. He felt the prob- lem, if one exists, should be defined more thoroughly and somewhat concurred with Commissioner Seibert about creating another function within the City. Another question was how would the City know when things were being sold or when the inspection would be needed. Director Dawson stated that the residents and realtors would be made aware of the requirement. Vice - Chairman Griffiths also noted the possibility of retain- ing a retired building inspector. He expressed concern with this. Bob Pitts, 5312 Degas Avenue, concurred with Commissioner Seibert's comments and stated that 15 years ago residents spoke out against imposing any other fees. He also stated that the State of California requires a form be filled out disclosing any illegal units. He also asked if the inspect- Planning Commission Minutes Page 4 January 9, 1990 ors would be certified. Mr. Pitts felt that escrows would be prolonged. He urged the Commission to recommend that the issue be dropped. Commissioner Budds recommended sending it back to staff for further study. City Manager Koski stated that the Planning Commission should also have the opportunity to review the State Disclosure Form. It was unanimously agreed to send the matter back to staff for further study. B. STUDY SESSION ITEM: DRIVEWAY WIDTH REQUIREMENTS Commissioners will review the current driveway width re- quirements and discuss possi- ble changes to the code. Director Dawson presented that background information on the item up for study Vice - Chairman Griffiths stated that this has been before the Commission before and recommendations were made to the City Council. The City Council did not approve of the recommendations and returned it for further study. Commissioner Budds felt that 10 foot driveway width would be sufficient and asked what the Fire Department's feelings were. Director Dawson stated that the Fire Department require- ment is 20 feet. If the 20 feet cannot be met, they require fire sprinklers be installed. Commissioner Budds stated that if the Commission ap- proved an amendment for 12 foot driveways, there would still be a number of variance requests for 10 foot driveways. City Manager Koski asked if there was a turn - around requirement in the multiple residential zones. Director Dawson stated that there was a turn - around area of 25 feet required for 90 degree parking. Robert McGinnis, 6120 Camellia, stated that before the City rely on sprinklers to solve the problem, they should look at the water company. • • • " " Planning Commission Minutes Page 5 January 9, 1990 Vice - Chairman Griffiths stated that the code amendment should be placed on the agenda for a public hearing. It was unanimously agreed that a code amendment on this matter should be set for public hearing. 7. COMMUNICATIONS: None 8. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Mr. McGinnis expressed his displeasure over his lot being zoned R -2. He stated that there are a number of absentee landlords in the neighborhood. Many of the properties are maintained by gardening services. These gardeners use blow- ers to move debris which creates a lot of dust in the neigh- borhood. He also asked if the gardeners needed to be licensed and have a Temple City sticker on their vehicles. City Manager Koski stated that they did need to be licensed. 9. MATTERS FROM CITY OFFICIALS: NONE 10. ADJOURNMENT: As there was no further business, Vice - Chairman Griffiths adjourned the meeting at 8:45 p.m. The next regular meeting of the Planning Commission will be held on Tuesday, January 23, 1990, at 7:30 P.M. in the Council Chamber, 5938 North Kauffman Avenue, Temple City.
